The applicant has used force and broken through the front door and grabbed the victim and pinner her to the floor and slapped her face with an open hand and again grabbed her by the throat. The victim has managed to get herself free and ran outside to find her children in a hysterical state. Police have arrived shortly after and observed children crying hysterically outside the front of the house. Police located the victim and children hiding around the side of the house.
- As a result of this incident, an Intervention Order was made by the local Magistrates' Court on the application of police officers. This resulted in TKM being excluded from his house for a period of 14 days, during which time he resided in a caravan. After 14 days he was allowed to return home. He was charged in the Magistrates' Court at Swan Hill with two offences under Section 18 of the Crimes Act 1958, presumably as an alternative, that he without lawful excuse, either
