- This matter was of some debate in the review of Amendment C58[24] but it was not a matter that was the subject of extensive discussion in the hearing before us. We have recited evolution of the provision that seeks a new development to provide a front setback up to 3 metres from the property boundary along Chapel Street. This will advance the Scheme's public realm objectives for this Precinct.
- The footpath width, to the property boundary, proposed in the design is generally 4.2 metres along Toorak Road and 1.9 metres along Chapel Street. The width lessens in some locations due to the irregular title boundary. We are satisfied that the proposed footpath widths are acceptable.
- The potential for level differences between the footpaths and shop entries were discussed at the hearing. This is a matter that is again relevant to the safety and convenience of the public realm.
- The Forrest Hill Structure Plan specifically seeks to avoid level differences[25] although our aim is to ensure a lesser differential than 1.2 metres cited in that Plan.
- We are satisfied this matter can be addressed by permit conditions by requiring further detail of the finished floor levels to be achieved within the shops/restaurants at access points from both Toorak Road and Chapel Street as well as the entry to the residential foyer from Almeida Crescent.
