159 In his affidavit, Mr Mihailovski stated that the project experienced a number of delays and disruptions, which, in his opinion, were largely caused by the conduct of the principal's representative, Mr Karantzis. On 17 May 2011, Mr Mihailovski attended a project meeting, which had been called in response to the respondent's notice that it intended to commence dry commissioning of the plant on that date. Mr Mihailovski stated that the respondent had decided that it would use his own Permit to Work System ('PTW System') for the commissioning stage of the project. He considered that the appellant's system was not appropriate. At the meeting, Mr Mihailovski had a heated dispute with Mr Karantzis as to that subject. Later that day, the respondent intended to commence dry commissioning. Its PTW System was implemented and in place for that testing. The respondent proposed to use temporary power for the purposes of the commissioning because the appellant had refused to allow the respondent to use the permanent power supply from the transformer. However, (Mr Mihailovski stated) the appellant took steps to prevent the respondent from proceeding with the testing. In particular, the respondent's personnel was informed by the appellant's personnel that the appellant would cut all power to the site because it was unsafe. Mr Mihailovski stated that that conduct by the appellant placed the respondent's workers at risk. The appellant then issued a written direction dated 17 May, stating that no further commissioning work be carried out by the respondent, unless permission was first obtained from Mr Karantzis on a day to day basis pursuant to the appellant's PTW System. Mr Karantzis, together with several other personnel of the appellant, entered the respondent's work site, and removed the respondent's safety barriers, signs and tags from the switch room number 5. On the evening of 17 May, the appellant took steps to lock the respondent's personnel out of switch room number 5. That room was a critical part of the site in the project. Mr Mihailovski therefore alleged (in his affidavit) that as a result of Mr Karantzis' conduct, the respondent had been obstructed from completing any further works. As a result, on 31 May, the respondent issued the Show Cause Notice to which I have referred.
