- In this matter the accused has been arraigned on an indictment containing five counts, involving three counts of sexual intercourse with the complainant and two counts of committing an act of indecency upon the complainant.
- These proceedings are being conducted under relatively new procedures that were instituted as a result of a wide-ranging review of the practices of the court in relation to the prosecution of sexual assault cases and, in particular, we are now engaged in what is called in the relevant legislation a "pre-trial hearing", where the evidence of the complainant is taken from a remote witness room and transmitted by closed-circuit television to the court room and the evidence of the complainant then recorded to be used in that form at trial.
3. The purpose of this is set out in the revised explanatory memorandum to the Sexual and Violent Offences Legislation Amendment Bill 2008 (ACT). And I quote:
