Trade Practices - Power to exclude party from private hearing - Power to prohibit publication of evidence - Whether tribunal can prohibit legal representatives from disclosing evidence to their clients - Principles applicable to exercise of discretion to exclude party and prohibit publication of evidence - Natural justice - , (2) (a), (b). In the course of proceedings before the Trade Practices Tribunal, a witness called by the Trade Practices Commission gave certain evidence in a private session. Application was made by counsel to permit disclosure of that evidence by him to his clients, who were excluded from the private session. The application was refused and orders of prohibition and mandamus were sought from the Federal Court of Australia.
