Criminal law - Sentence - "Culpable driving" - Sentence of 5 years with non-parole period of 3 years not manifestly excessive. New evidence - Circumstances in which appellate court will receive such evidence in "sentence appeals".
- The applicant, Brendan O'Connor, is 29 years of age. On 10 November 1998 a County Court jury in Melbourne convicted him on one count of culpable driving arising out of events which occurred on 21 July 1996. The Crown alleged, and the jury must have accepted, that the vehicle driven by the applicant had drifted on to the wrong side of Thompsons Road in Cranbourne and collided head on with a vehicle driven by one Gary Holmes, a police officer who was on his way to work. Gary Holmes was killed instantly. Subsequent investigation and testing of the applicant found him to have had a blood alcohol content at the time of driving in the vicinity of .2 percent. The Crown alleged that it was the culpable driving by the applicant which caused the death. Pursuant to s.318 of the , the culpable driving was said to consist of gross negligence or driving whilst under the influence of alcohol to such an extent as to be incapable of having proper control of the vehicle.
