26 As I have said, when you were apprehended by the police, you initially denied any knowledge of the alleged unlawful acts and denied knowing the co-accused, Afrim Medini. The depositions do not contain any statement from you as to the events alleged against you and more importantly, any evidence as to your reason or motive for the appalling unlawful conduct constituting the two counts. As I have said, the reports of Professor Mullen and Mr Cummins set out some facts concerning the background leading to the offences. But there is not any direct evidence from you as to your motive. Both experts opine a view as to your conduct, your state of mind and an explanation for your outrageous and bizarre conduct. Some of the witnesses were cross-examined at the committal. However, in considering and determining what the facts are, I am left with sworn evidence in the depositions and no direct evidence from you as to the events and more particularly, as to your reason or motive for the conduct. Faced with that situation, I am bound to accept the evidence in the depositions concerning the important matters unless for good reason it should not be accepted or, of course, it is inherently improbable or, through cross-examination of any witness at the committal, the evidence is altered or weakened.
