After a trial in the District Court, the appellant was convicted of indecently dealing with a boy under the age of 14 years, and sentenced to imprisonment for a period of two years, with a recommendation that he be eligible for parole after serving six months. He has appealed against his conviction on two grounds:
Firstly, that the learned trial Judge erred in the exercise of his discretion in ruling that the indictment should not be stayed; and
