- The applicant, who is now aged 24, pleaded guilty in the County Court at Melbourne on 25 May 1998 to a presentment alleging one count of causing serious injury recklessly contrary to s.17 of the . The applicant had in fact pleaded guilty at the committal on 6 March 1998 to the same charge and had been granted bail pending the plea hearing. The count was representative of a number of assaults committed by the applicant upon his daughter, Victoria Grace Gardeniers, between 28 August and 22 September 1997. She had been born on 25 August 1997 at the Box Hill Hospital. The baby and her mother, Julie Ann Morris, who was 19 years old at the time of the baby's birth, remained in hospital for three days until they returned home to live with the applicant on 28 August.
