- The applicant, John Carson Craker, who is now aged 37, pleaded guilty in the County Court at Melbourne in October 1996 to a presentment containing five counts of obtaining property by deception, one count of attempting to obtain property by deception and one count of perjury. The theft charges related to a series of offences arising from dishonest conduct by the applicant and a co-offender, Wright, as agents of the Australian Mutual Provident Society (AMP) which were designed to defraud and have the effect of defrauding AMP of substantial sums of money. The offences were committed between 22 November 1989 and 15 May 1990.
- When AMP officers began their investigation into the matter the applicant and Wright denied any wrongdoing. They confirmed this in a statutory declaration which each made on 15 May 1990. On his own admission, by way of plea of guilty, the applicant knew that what he was stating in that declaration was false.
