REASONS FOR DECISION
- These reasons concern the claims of Mr Tim Hurst, the Chief Executive of the Office of Local Government, that the respondent, Councillor Michael Gerard Neville, a long standing Councillor and former Mayor of Griffith City Council, failed to disclose his pecuniary interest in MGN Business Services Pty Ltd (MGN) over an extended period.
- Councillor Neville says he does not wish to dispute the findings of an investigation report prepared pursuant to s 468 of the Local Government Act 1993 (the Act) (the Investigation Report), in which an investigator found that the evidence supported the view that he had failed to disclose his pecuniary interests as required by s 449 of the Act in the period 1 July 2002 to 30 June 2015. Nor does he dispute additional allegations made by the applicant in respect of the period 2016 to 2017. Councillor Neville concedes that he did not provide the required information required by s 449 of the Act, and that he ought reasonably to have known that his returns were false and misleading. However, he says that he did not intend to deliberately conceal any pecuniary interest he held in MGN.
- The Tribunal finds the complaints established. For the following reasons, the Tribunal has decided to reprimand Councillor Neville, and to suspend his right to be paid for a period of two months.
