55. Before moving from the subject of relevant policies, it is important to remark on the question of whether this is a landmark site. Mr Cicero correctly indicated that there is nothing within the current Scheme policies or Melbourne 2030 that identifies the subject site as a landmark opportunity or specifically that a building on the subject site should be designed to be a landmark. However, when referring to the Development Guidelines (which we discuss below) the reality is properly acknowledged - the site is prominent (particularly when viewed from the west and east) and a development, over 3 storeys, would also be visible. A building may become a landmark for possibly no other reason that it will be seen. It is, however, relevant that Clause 19.03, which we have referred to above at paragraph 22, gives weight to the proposition that there will be occasions where it is appropriate for a landmark to be created. Given that a building on the subject site will be visible in a very wide arc, even at the Council's preferred maximum height of 5 storeys, we are cognisant that high quality design and architecture is very important in this case as the development would, in practice, be a landmark or marker for the local and wider communities. It may provide a "crown" as described by Mr McNabb. Therefore, we give weight to the physical circumstances of the site and its context that give justification for a landmark building on the subject site.
