- The plaintiffs are the joint owners of the property known as 20 Orrong Crescent Caulfield North. The relevant certificate of title is Certificate of Title volume 8462 folio 515. They purchased the property in 1960 and have remained in possession of the property ever since. On 4 May 1971 they became the registered proprietors of the adjoining property known 22 Orrong Crescent Caulfied. The relevant certificate of title was Certificate of Title volume 4711 folio 036. On 19 December 1972 they purported to transfer the land in Certificate of Title volume 4711 folio 036 to John and Marjorie Richardson. They were duly registered as joint proprietors of that land. On 21 August 1987, Marjorie Richardson was registered as the surviving proprietor of the land. She sold the land to the defendant, Boris Procopets. On 2 November 1987 Boris Procopets became registered as the proprietor of the land.
