112 With respect to the after situation, I do not accept Mr Rowbottom's opinion that the Bewsher Consulting and WBM Oceanics report of January 2002 incorrectly identified the M7 as a source of unacceptable localised impacts. I prefer the opinion of Dr Webb that the hypothetical buyer, at the acquisition date, would reasonably perceive the M7 as having increased the flooding levels on the land. Nevertheless, I do accept Mr Rowbottom's opinion and the respondent's submission that, in the after situation, the hypothetical buyer would be aware of, and have regard to, the conditions imposed on the M7 determination. The conditions establish a regime for the preparation of sub-plans and drainage designs, and their approval, which are intended to ensure that the M7 does not exacerbate existing flooding (for example, conditions 1, 134, 135, 141, 142, 143, 144, 145 and 146). The existence of these conditions, to a very large extent, would ameliorate the risk perceived by the hypothetical buyer of exacerbated flooding of the land caused by the M7 being left unaddressed. For the same reasons, the hypothetical buyer would not consider that the level of Ash Road would need to be raised to provide access in the after situation. That having been said, the M7 caused other effects on the land that must be taken into consideration.
