Introduction
- The appellant was employed as a corrections officer with the respondent and on 17 November 2021 in the performance of his duties, he entered the Emu Plains Correctional Centre ("EMCC") whilst carrying a work issued firearm (the "Conduct").
- On 22 June 2022, the respondent informed the appellant that for the reason of the Conduct his employment will be terminated with an opportunity to resign pursuant to ss (the "Decision"). The appellant resigned from his employment on 10 July 2022 (the "Dismissal") rather than being dismissed.
