NEGLIGENCE - medical negligence - negligent advice concerning hysterectomy - assessment of damages.
- The plaintiff claims damages for negligence against the defendants who are the Austin Hospital, the Airlie Maternity Hospital ("Airlie") and Dr Ian McGoldrick ("Dr McGoldrick"). The claim is made both in contract and in tort but I do not think nor was it suggested that in the circumstances the duty or standard of care differs between those causes of action. The two hospitals, which were represented by Mr Moore of counsel, came to concede that Dr McGoldrick had been negligent, in respects to which I will shortly refer, but initially submitted that they were not vicariously liable for that doctor's negligence nor in direct breach of any duty of care owed to the plaintiff. Ultimately, the two hospitals admitted liability and, as against them, the Court's task is to assess the damages to which the plaintiff is entitled. The case proceeded as against Dr McGoldrick in his absence, there being no appearance by or on his behalf at trial. His defence put all material matters in issue. It is therefore necessary, notwithstanding the admissions by the hospitals, to independently consider the evidence and decide the question of liability as against Dr McGoldrick.
