4 This proceeding appears to have its origins in an application issued out of this Tribunal in July 2003. That application referred to the matter as a credit dispute, and was placed in the Credit List. Linton and Vink were described as applicants, and the respondent was described as Murray Bottrell, Credit Manager, of the CBA. Ultimately the CBA became the respondent. Substantial correspondence apparently placed on the Tribunal's file with, or at the time of, the application reveals that there had been a dispute in progress for a considerable period. Essentially, Linton and Vink were alleging various breaches of the Consumer Credit (Victoria) Code. They were seeking the return of the sum of $6,973.60 paid by Vink to the CBA in relation to a bank guarantee, and return of the Certificate of Title of Linton's property at 4 Bennett Avenue, Belgrave ("the Belgrave property") which, as revealed by the correspondence and documentation, was, according to the CBA, mortgaged to it as security for various bank guarantees.
