Reasons for decision
- The Applicant (Mr Keogh) holds a contractor licence in the class of: Plumber; Drainer; Gasfitter; LP Gasfitter and Roof Plumber. Mr Keogh's contractor licence history commenced in 2012 when he was first issued a tradesperson certificate in the classes of Plumber and Roof Plumber, Drainer and Gasfitter.
- The class of LP Gasfitter was added to his licence in July 2013 and ran until October 2014 when Mr Keogh's licence was cancelled by the Respondent (Commissioner for Fair Trading 'the Commissioner'). The basis of the cancellations was that Mr Keogh had provided false and misleading information to the Commissioner in relation to his practical experience. The licence was reissued in March 2017 following the period of cancellation.
- In June 2018 Mr Keogh applied to have his licence varied to include General Building Work. In support of that application for variation Mr Keogh submitted a Certificate IV Building and Construction Certificate dated 17 July 2013 and a Diploma of Building and Construction dated 12 December 2013. The 2013 Certificate and Diploma were false in that Mr Keogh did not lawfully obtain those qualifications. On the basis of preliminary findings in respect of the Certificate and Diploma, the Commission issued a Notice to Show Cause under the Home Building Act 1989 (the 'HB Act') on 9 January 2020.
- Following consideration of Mr Keogh's response in February 2020 to the Notice to Show Cause, the Commissioner's delegate determined under the HB Act to take disciplinary action against Mr Keogh. On 12 June 2020 the Commissioner cancelled Mr Keogh's Contractor Licence and determined to disqualify him from holding any authority under the HB Act for a period of two years.
- On 25 June 2020 Mr Keogh applied to the Tribunal for administrative review of the decision of 12 June 2020.
