Summary
- The respondent, Ms Webb, is the site administrator for a public website, NSW Freedom of Information (NSWFOI). This appeal concerns what happened after Ms Webb made an application to the appellant for access to information held by it under the Government Information (Public Access) Act 2009 (NSW) (GIPA Act). The application sought information about an organisation called the NSW Information and Privacy Practitioners Network (NIPPN). A Ms Gibbs-Steele holds two, unrelated, positions as both Chair of the NIPPN and Privacy Officer for the appellant.
- In processing the application, another employee of the appellant, Ms Tzinberg, sent an email to Ms Gibbs-Steele in her capacity as the Chair of NIPPN, consulting her on the release of the information requested. That email included that Ms Webb had submitted the access application and was acting on behalf of NSWFOI. Ms Webb has applied to review a decision about the conduct of the appellant under the Privacy and Personal Information Protection Act 1998 (NSW) (PPIP Act), alleging a breach of information protection principle (IPP) 11.
- I am to determine the appeal on the papers, the Appeal Panel having previously dispensed with a hearing with the consent of the parties. In these reasons, I have used the name and lack of capitalisation of the appellant used in the proceedings at first instance and the notice of appeal. I suspect some correction is called for.
- The appeal concerns whether the Tribunal erred in not setting aside a summons issued at the request of Ms Webb for Ms Gibbs-Steele to attend and give evidence in the substantive hearing of the proceedings at first instance. For the reasons that follow, I am satisfied it did.
