REASONS FOR DECISION
- Mr Hussein is a thirty-year-old man whose firearms licence has been revoked following allegations of intimidation against his partner. Criminal charges and an application by police for an apprehended violence order were dismissed and Mr Hussein is now seeking a review of the decision to revoke his firearms licence.
- Firearm possession and use is a privilege that is conditional on the overriding need to ensure public safety and to improve public safety by imposing strict controls on the possession and use of firearms: s3 Firearms Act.
- It is not in dispute that I have the power to review the decision to revoke Mr Hussein's licence and that it is my role to decide the correct and preferable decision having regard to the material then before it.
- For the reasons that follow, I have decided to affirm the decision to revoke Mr Hussein's firearms licence.
