15 While I am not bound by the earlier findings of the Tribunal, they are clearly relevant to my consideration of the merits of the current proposal and it is appropriate that I address the issues which were of concern to the Tribunal in that matter. During the course of the hearing I was provided with copies of the plans which formed part of the earlier application and I think it is very clear that the current proposal is substantially different from that previously considered by the Tribunal. The principal difference between the two proposals relates to the scale and massing of the extensions which in the earlier application extended continuously along 21 metres or 81% of the depth of the review site's interface with the properties to the south. The interface treatment presented as a solid mass comprising a combination of copper cladding panels, dark tinted glass and timber screens, all to a height of between 12 and 10 metres. Although the extension in the current proposal is of a similar height (5 metres above the existing parapet), its mass has been reduced so that it occupies approximately 50% of the review site's depth. Toward the rear of the site, an increase in height of the existing parapet of 2.125 metres is also proposed, but this is separated from the higher extension by a gap of 2 metres. A glass balustrade between the extension and the Charles Street frontage is also proposed to a height of 2 metres above the parapet, but sitting 1.2 metres above the parapet, the effect of which is to further break down the continuity of the built form.
