The applicant and respondent will be referred to throughout as plaintiff and defendant. The plaintiff's solicitors applied by summons filed 24 October 1997, returnable 17 November 1997 in Chambers for a protection order, and for an order that the costs of and incidental to the application be paid by the defendant on that date. Mr Matthews then appeared for the applicant and Mr Tait for the Nominal Defendant. The plaintiff was not present. Mr Matthews informed the Court that notwithstanding that the summons itself was expressed to be on behalf of the plaintiff, it was in fact an application on behalf of the solicitors who simply desired that a protection order be made in order that settlement moneys held in their trust account on behalf of the plaintiff may be paid to the Public Trustee. The material read, in addition to the summons, were two affidavits by the plaintiff's solicitor filed 24 October 1997 and 14 November 1997. Exhibited to the first affidavit was a large bundle of some 18 lengthy medical and other professional reports dated from 26 September 1991 up to 1 May 1996.
The action was commenced without a next friend. The chronology is as follows:
