Introduction
- This is an application for review of a decision by a delegate of the Commissioner of Police ("the Respondent" or "the Commissioner") under the Firearms Act 1996 ("the Act"). The Applicant, Mr Walter Greenhalgh, has held a Category AB firearms licence for the genuine reasons of 'animal welfare - animal handler' and 'recreational hunting/vermin control'. He previously held firearms training permits as a minor. His firearms licence was issued in May 2019 and was due to expire in June 2024. However, a delegate of the Commissioner determined to revoke the licence in July 2021.
- The delegate formed the view that it was no longer in the public interest for him to hold a licence. This followed an incident that occurred in February 2021.
Background
- The Respondent has identified two instances in which the Applicant has come to the attention of Police in relation to the use of firearms. The chronology of events is not in dispute in any material sense.
