193 The difficulty with the submissions made on behalf of Mr Gangemi in this regard is that, if accepted, it would be necessary to find that Mr Jafari and Mr Americo are telling lies about the issue. For reasons previously given in connection with the general credibility of Mr Gangemi, I am not prepared to prefer his evidence over that of Mr Jafari or Mr Americo. However, there is a more fundamental reason, based upon the probabilities, for rejecting Mr Gangemi's evidence. Mr Gangemi accepts that it was him who signed the Pre Need cheque for $30,000 and gave it to Mr Jafari. This cheque was provided after Mr Jafari had advanced $370,000. By this time, the parties had agreed that Mr Jafari's investment in the Buckley Street project would be $350,000 in total. Mr Gangemi has not explained why he wrote the cheque for $30,000. Taking the evidence as a whole, and having regard to my findings above, I infer that Mr Gangemi wrote the $30,000 cheque for the purposes Mr Jafari alleges. First, as to $20,000, to balance Mr Jafari's contributions down from $370,000 to the agreed contribution of $350,000. Second, as to the remaining $10,000, to repay the separate advance of $10,000 in cash made by Mr Jafari to enable Mr Gangemi to on-lend that money to Mr Americo.
