122 As to that, evidence was given by Messrs Smith and Rainford for Expectation and by Jacques, Kennedy, Sharp, Wantrup, Hains and Loganathan. The extent of the disagreement between the main witnesses in that group was profound. Speaking generally, I put that down to the fact that this was a particularly stressful time, for different reasons, for those involved and much was happening. Smith and Rainford were under pressure to achieve the result that I have mentioned and they were having difficulty obtaining access to persons acting for Pinnacle for any extended period of time. Those persons were dealing with a number of issues which were pressing upon them, as the minutes of the Board meeting of 2 August reveal. They were concerned with the shareholders' meeting at least informally held on 31 July after the Board's attempt to adjourn it, the action which had been initiated in the Supreme Court of Victoria, appointments to the Board, the appointment of Mr Wantrup as Chairman which was only made at that meeting, although it seems to me that earlier than that he was dealing with Expectation on the basis that he was the Chairman, dealings with Federation and matters of that kind.
