REASONS FOR DECISION
- This is an application by Christopher Lee Ellicott (the Applicant) seeking review of a decision made by the Commissioner of Police, NSW Police Force (the Respondent) to refuse his application for a Category AB firearms licence (the Application) under the Firearms Act 1996 (the Act). The Application was made on 18 May 2021 and the decision to refuse the Application was made on 10 February 2022. The refusal was based on the Applicant's ongoing mental health disorder and the Respondent's view that the issue of a licence was not in the public interest.
- On 17 March 2022, an internal review of the decision was sought on behalf of the Applicant. The Applicant was not notified of the outcome within the timeframe required by the Administrative Decisions Review Act 1997 (the ADR Act). However, on 14 November 2022 a delegate of the Respondent conducted an internal review and affirmed the decision to refuse the Application. The Applicant applied to this Tribunal for review on 9 December 2022.
