Overview
- Mr Eager, the Appellant, brings an appeal from a decision summarily dismissing most of his claim in respect of financial reporting aspects of the management of a retirement village in North Sydney. The decision was to dismiss three of the four orders sought by Mr Eager. It was a decision made under s 55 (1) (b) of the Civil and Administrative Tribunal Act 2013 (NCAT Act) to dismiss his claim on the grounds that the proceedings were frivolous or vexatious or otherwise misconceived or lacking in substance.
- For the reasons set out below, we have decided to allow Mr Eager's appeal in so far as it concerns his claim for the operator of the retirement village to provide to residents audited accounts of the village for the year ended 30 June 2015 which comply with the Retirement Villages Act 1999 (the Act).
