Introduction
- On 12 January 2022, we published our decision in this appeal. The proceedings at first instance had been commenced by the Respondent and had been dismissed. The Appellant had then sought an order that his costs at first instance be paid by the Respondent. That application was dismissed on 30th March 2021 and the Appellant appealed.
- The appeal was upheld and we made an order that the Respondent was to pay the costs of the Appellant in the Tribunal proceedings at first instance. We also made directions for the parties to the appeal to make submissions as to whether an order should be made in respect of costs of the appeal. Those submissions have since been received.
- The Appellant seeks an order that the Respondent pay the Appellant's costs of the appeal. The Respondent submits that there should be no order with respect to costs of the appeal.
- At the outset we observe that the Appellant's solicitor seems to be under a misunderstanding as to the extent of the directions we made on 12 January with respect to costs. This is encapsulated in the orders that the Appellant's solicitor submits that we should make. The first order is that we should set aside the order made at first instance on 30 March 2021. That was the order by which the Appellant's application for an order for costs in the proceedings at first instance was dismissed. Secondly, the Appellant's solicitor seeks an order affirming the order made on 12 January 2022 and thirdly an order is sought in favour of the Appellant both with respect to costs at first instance and costs of this appeal.
- The effect of the orders that we made on 12 January was twofold. We made the explicit order that the Respondent was to pay the Appellant's costs at first instance and implicitly we set aside the order at first instance dismissing the Appellant's application for costs at first instance.
- Accordingly, this appeal is concerned only with whether the Appellant's costs of the appeal should be paid by the Respondent or whether they should be no order as to costs of the appeal.
