65. Even if the westerly view were secondary, we do not say that it need not be considered or that it is not material. In fact, we find that it is the primary view, notwithstanding the positioning of the other windows and balconies. If a division is to be made between the west facing picture window and the north facing windows to the balcony, it is only necessary to step into the living room to realise that the primary view is that from the western window, and the secondary is to the north. Another way of looking at it, and the way we have viewed it, is that it is one view, a minor segment of which (amounting to perhaps 10 to 20% of the whole) is obtained through the north facing viewing facilities. In so far as Mr. Peake chooses to argue in terms of legitimate expectations, Ms. Brown could expect that a correct or best decision on the merits of the Zumpano application would result in a concern for a protection of her westerly views to be taken into consideration, and for them to be protected, at least to a substantial extent. An appropriate decision, which the Responsible Authority thought it was making, would protect a substantial view of the sea around the sweep of the view with any obstruction being well below the sea-sky horizon. The opportunity of viewing the sea and sky in their changing colours and modes, the passing of boats and ships, sunsets and moonscapes with moonlight reflections and water reflection paths, the view of distant features and lights at night are all part of it. In the circumstances of this case all this should have been preserved, and would have been if the intention of the Responsible Authority had been realised. It could be preserved without unduly inhibiting the scope for development of the Zumpano land.
