Introduction
- The applicant, who will be referred to in these proceedings as BJC, has been refused a working with children check clearance by the Children's Guardian, who is the respondent in this matter. BJC has applied to this Tribunal for a review of that decision.
- The notice by the Office of the Children's Guardian advising the applicant of the refusal of his application for a working with children check clearance is dated 12 May 2014. In his application for review to this Tribunal, which was filed on 5 June 2014, the applicant stated that he received notification of the respondent's decision on 12 May 2014. This means that he has applied to the Tribunal within 28 days after notice of the decision was given to him, in accordance with subsection 27(1) of the Child Protection (Working with Children) Act 2012.
- The issue before the Tribunal is to decide in these proceedings what "the correct and preferable decision is having regard to the material then before it" including material which may not have been before the Children's Guardian: section 63 Administrative Decisions Review Act 1997.
- Due to the sensitive nature of these proceedings, an order was made, under subsection 64(1) of the Civil and Administrative Tribunal Act 2013, prohibiting the publication of information about the applicant, any victims, witnesses, or evidence given and received in the Tribunal hearing or in relation to the proceedings which is likely to identify those persons.
