97 Counsel for the plaintiffs submitted, correctly in my view, that the answer to this question is to be found in cl 1 of the Deed of Settlement creating the JEMA Trust, which defines each of the words 'Guardian' and 'Appointor' to 'mean successively the person or persons successively named or described as such in the Schedule'. When regard is had to the terms of the Schedule, it is clear that the word 'successively' in this context bears its natural and ordinary meaning of 'following in order' with each person listed in the Schedule succeeding, or taking the place of the person previously named. In the Schedule, Mr John Ainsworth is the first person named as each of appointor and guardian. In each category, the next person named is 'such other person or persons as the first named person may' appoint. Accordingly, when such a person or persons is appointed, he, she or they succeed, or take the place of John (or Jock) Ainsworth. So, when on 11 May 1999 Jock Ainsworth appointed Judy Roberts as appointor and guardian of the JEMA Trust, she succeeded (or replaced) him in those capacities, and he ceased to hold those functions or responsibilities.
