- The applicant (Bald Hills) has a permit for a wind energy facility.[2] The permit will expire if the development is not started by 19 August 2012 and is not completed by 19 August 2015.
- The permit contains various conditions which require certain plans to be approved to the satisfaction of the Minister for Planning before the development starts (the development plans). All the required plans have been submitted to the Minister, but the Minister has failed to approve the plans. This proceeding is an application for review under section 149(1)(d) of the Planning and Environment Act 1987 by Bald Hills (as a specified person under section 148 of the Act) to review the failure of the Minister to make a decision to approve the development plans within a reasonable time after they were referred to him.
- The Minister opposes the application on the basis that it is premature. It is the Minister's position that a reasonable period of time had not elapsed between the submission of the plans for approval pursuant to the terms of the permit and the making of this application to the Tribunal.
- Since the application was made, the Minister has not made a determination in respect of the merit of the proposed plans. In the event that the Tribunal does not accept the Minister's primary submissions about the prematurity of the application, the Minister made no submissions either supporting or opposing the plans submitted by the applicant. Instead, the Minister's submissions were directed towards assisting the Tribunal to evaluate the merit of the plans. This included submission of a peer review of the acoustic materials prepared for Bald Hills by Marshall Day (which were submitted in support of the proposed development plans) by Mr Gustaf Reutersward of SLA Consultants. Mr Reutersward was called to give evidence about his peer review.
