1 This is the judicial determination of a dispute between Carol Ashby ("the worker") and the State of South Australia for and on behalf of the Department of Education and Children's Services ("the employer").
2 The dispute arises out of the employer's rejection of the worker's claim for compensation wherein she asserted that from the morning of the 16 October 2001 she has been incapacitated for work as a result of anxiety and depression arising out of her employment at the Open Access College at Marden ("the College").
3 For the alleged disability to be compensable, it has to satisfy the special requirements of s 30A of the Workers Compensation and Rehabilitation Act, 1986 ("the Act").
