ORDER Appeal allowed with costs. Set aside the orders of the Court of Appeal of the Supreme Court of New South Wales and in lieu thereof order that the appeal to that Court be dismissed on the issues whether the trial judge erred in finding that the injury to the appellant was reasonably foreseeable and whether the trial judge erred in finding that proper supervision of the coders would have made the risk of injury to the appellant minimal. Remit the matter to the Court of Appeal to determine the outstanding issues. Liberty to the appellant to apply within fourteen days of this order with respect to the costs of the proceedings in the Court of Appeal. In the absence of further order by this Court, the costs of the proceedings in the Court of Appeal to date to be dealt with by that Court on the further hearing in that Court.
