It makes it illegal to hunt, kill, capture, interfere with, or trade in whales and whale products in Tasmania, except in very limited circumstances.\n\n**Who it affects:**\n\n- **Everyone in Tasmania** – you cannot take whales, buy or sell whale products, or interfere with whales without a special permit.\n- **Fishers and marine farmers** – they need permits if their operations might affect whales.\n- **Scientists and educators** – they can apply for permits to study whales or use whale products for research.\n- **Police and rangers** – they have powers to enforce the law, including arrest, search, and seizure.\n- **Volunteers** – they can help rescue stranded whales under the direction of authorized officers.\n\n**Key rules:**\n\n- **No taking whales** – You cannot catch, kill, tranquilize, or injure whales (section 6).\n- **No trading** – You cannot buy, sell, or export whales or whale products (section 6).\n- **No interference** – You cannot chase, harass, herd, brand, tag, or mark whales without permission (section 6).\n- **Exceptions** – You can act without a permit if it's to save human life, prevent suffering, or if a whale is accidentally caught during fishing (section 7).\n- **Permits** – The Secretary can grant permits for scientific research, education, or commercial fishing operations (sections 9–11).\n- **Stranded whales** – Authorized officers and volunteers can enter land to rescue stranded whales, even private property in emergencies (sections 12–17).\n- **Enforcement** – Officers can search premises, seize equipment, arrest suspects, and demand permits (sections 18–24).\n\n**Why it matters:**\n\nThis law protects whale populations in Tasmanian waters. It balances strict protection with practical exceptions for human safety, accidental bycatch, and scientific research. It also establishes a framework for responding to whale strandings, ensuring trained people can help without legal barriers.\n\n**Penalties:**\nFines range from 1 to 1,000 penalty units depending on the offence. Serious offences like killing whales or trading whale products attract the highest penalties."}},"importantCases":[],"_links":{"self":"/api/acts/whales-protection-act-1988","history":"/api/acts/whales-protection-act-1988/history","analysis":"/api/acts/whales-protection-act-1988/analysis","conflicts":"/api/acts/whales-protection-act-1988/conflicts","importantCases":"/api/acts/whales-protection-act-1988/important-cases","documents":"/api/acts/whales-protection-act-1988/documents"}}
