and\n\n(c) the printed image contains an image and a message indicating—\n\n(i) the toll zone in which the vehicle or trailer to which the image relates was used; and\n\n(ii) the date on and the time at which that vehicle or trailer was used in the toll zone.\n\n(2) For the purposes of subregulation (1), a digital file is created by a digital toll camera unit if the digital toll camera unit is used in the manner referred to in regulation 9 and the digital toll camera unit processes the image taken by the unit by—\n\n(a) converting the image taken into a digital format (with or without compressing the image); and\n\n(b) generating data—\n\n(i) indicating the toll zone in which the vehicle or trailer to which the image relates was used; and\n\n(ii) from which the date on and the time at which that vehicle or trailer was used in the toll zone can be calculated; Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nThis includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms. \nSee section 36(1A)(2A)(2B).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThere are no amendments made to the West Gate Tunnel (Truck Bans and Traffic Management) Regulations 2025 by statutory rules, subordinate instruments and Acts.\n\n3 Explanatory details\n\nNo entries at date of publication.","sortOrder":0}],"analysis":{"issue_detection":{"absurdities":[],"contradictions":[]},"summary":{"complexity_score":4,"scope_assessment":{"changed":false,"description":"Based on the available text, the regulations appear consistent with their stated purpose — implementing truck bans and traffic management rules for the West Gate Tunnel. They cover:\n\n- **Who doesn't have to pay tolls**: Emergency vehicles (ambulances, fire trucks, police cars, defence force vehicles) and certain other vehicles can travel for free.\n- **Who doesn't need to register**: The company running the tunnel can exempt certain vehicles from having to register with the tolling system.\n- **Signage**: Requires warning signs to be placed on approach roads (like the West Gate Freeway and CityLink) so drivers know they're about to enter a toll zone and can turn off if they want to avoid it.\n- **Tolling technology**: Specifies exactly what cameras and electronic tags can be used to record vehicles, how they must be tested (every 24 months or after repairs), and who can test them (qualified engineers or accredited testing officers).\n- **Evidence**: Sets out how photos from toll cameras can be used as proof in court, including digital verification checks (called \"checksums\") to ensure the images haven't been tampered with.\n- **Paperwork**: Prescribes the exact format for official certificates used in court cases about toll violations.\n- **Admin fees**: Sets the $40 administrative fee that applies when someone is found guilty of a toll offence.\n\n**Who it affects:**\n- Drivers using the West Gate Tunnel\n- The private company operating the tunnel (the \"relevant corporation\")\n- Emergency services\n- People challenging toll fines in court\n\n**Why it matters:**\nThese rules ensure the tolling system is fair, transparent and legally robust. The detailed technical requirements for cameras and data verification protect drivers from being wrongly fined, while the exemption rules ensure emergency services aren't delayed by tolling bureaucracy during crises."},"flash_summary":{"complexity_score":6,"scope_assessment":{"changed":false,"description":"The Regulations implement and specify operational matters authorised by section 77 of the Act (reg 2 and reg 1 objectives).
