The 1960 amendments added section 6A (power to sell Schedule 2 land) and section 8A (Ministerial appointment for conveyances), while the 2017 amendment updated the trustee appointment mechanism to reference the modern Crown Land Management Act. These are procedural modernisations and minor expansions of administrative flexibility, not a fundamental shift in scope. The Act has not grown beyond its original intent of governing this specific parcel of community land."},"complexity_factors":["Short length (9 sections plus 2 schedules, approximately 1,500 words)","Minimal cross-referencing (only references to Crown Land Management Act 2016, Conveyancing Act 1919, and Real Property Act 1900 for specific procedural matters)","Straightforward conditional logic (most powers require 'consent of the Minister' but no nested exceptions)","Only 3 defined terms used implicitly ('trustees', 'Minister', 'lands') with no dedicated interpretation section","Simple structural layout (sequential sections, two schedules describing land boundaries using historical surveying terminology)","Historical surveying language in schedules (chains, perches, rods, folio references) is archaic but not legally complex"],"plain_english_summary":"This law sets up a trust to manage a showground and sports ground in Wellington, New South Wales, for the benefit of the local agricultural society and the public.\n\n**What it does:**\n- **Establishes trustees** to look after specific parcels of land (about 28 acres plus an extra strip) in Wellington, NSW. These trustees are appointed by the Minister.\n- **Sets the purpose:** The land must be used for the Wellington Pastoral, Agricultural, and Horticultural Society, as a sports ground, and for other public recreation activities approved by the Minister.\n- **Gives the trustees powers to:**\n - Buy more nearby land (with Ministerial approval)\n - Sell certain land listed in Schedule 2 (with Ministerial approval)\n - Borrow money using the land as security (mortgage)\n - Make by-laws (local rules) about how the land is used, with fines up to $500 for breaches\n- **Protects buyers:** Anyone who buys land from the trustees gets it free of the trust obligations, so they own it outright.\n\n**Who it affects:**\n- The trustees (who manage the land)\n- The Wellington Pastoral, Agricultural, and Horticultural Society (who benefit from the land)\n- Local residents who use the sports ground or attend shows\n- Anyone buying or leasing land from the trustees\n\n**Why it matters:**\nThis is a classic example of a 'special statute'—old legislation that still governs a specific piece of community land. It ensures the showground remains available for agricultural shows and public recreation rather than being sold off for private development. The 1960 and 2017 updates modernised the trustee appointment process and added flexibility to sell surplus land, but the core purpose—protecting community land for public use—remains unchanged since 1929."},"flash_summary":{"complexity_score":4,"scope_assessment":{"changed":true,"description":"Compared with the original 1895 framework (now repealed, s 2), the Act expands trustee powers beyond holding land for the Society: it expressly authorises trustees to purchase nearby land (s 5), to sell the specific land in the Second Schedule (s 6A), and to raise money by mortgage (s 7). It also clarifies mortgagee powers to acquire free of prior trusts (s 8, s 8B), permits ministerial appointment of conveyancing agents (s 8A), and ties trustee appointment/removal to the Crown Land Management Act process (s 6). These additions shift decision‑making and financial capability to trustees (subject to Ministerial consent) and alter the legal status of title on sale or mortgage."},"complexity_factors":["Multiple Ministerial consents required for key transactions (purchase, sale, mortgage, s 5, s 6A, s 7, s 8A) increase administrative discretion and compliance steps.","Cross‑references to other property statutes (Conveyancing Act 1919; Real Property Act 1900) mean external statutory rules affect how mortgages and transfers operate (s 8, s 8A).","Appointment and removal of trustees is governed by powers aligned to the Crown Land Management Act 2016 (Schedule 5) creating an external procedural framework (s 6).","Mortgagee powers can vest land free from existing trusts and conditions, altering beneficiary protections and title outcomes (s 8, s 8B).","Sale power is limited to the land described in the Second Schedule, while Schedule 1 defines the retained trust land—spatial specificity creates transactional constraints (Schedules 1 & 2; s 6A).","By‑law making with Governor approval and monetary penalties (up to $500) adds local regulatory and enforcement features (s 9).","Amendment and insertion history noted in the Act (e.g. s 6 substitution 2017; s 6A, s 8A, s 8B inserted 1960) indicates layering of powers over time, which may require tracing historical scope and application."],"plain_english_summary":"This Act vests the lands in Schedule 1 in trustees to hold for the Wellington Pastoral, Agricultural and Horticultural Society and for public recreation, and gives those trustees powers—with Ministerial consent—to buy nearby land, sell the land in Schedule 2, raise money by mortgage, and make by‑laws (with limited penalties). It affects the trustees, the Society, purchasers and mortgagees, and the Minister because it determines who decides land transactions, who receives or pays sale/mortgage proceeds, and how the grounds may be regulated."},"summary":{"complexity_score":2,"scope_assessment":{"changed":false,"description":"Based on the extremely limited amendment history (only one substantive update since 1929, in 1987, with a minor update in 2018), the Act appears to have remained largely true to its original purpose of governing the Wellington Show Ground.
