Originally focused on emergency drought responses for specific regional towns (Dubbo, Tamworth, Orange, etc.), the 2020 amendment added Bathurst to Schedule 1 and Schedule 2, expanding the geographic scope. More substantially, Schedule 3 was added (and expanded in 2021) to cover major dam infrastructure projects (Wyangala, Mole River, Dungowan, Western Weirs) — these are large-scale, permanent infrastructure projects rather than emergency drought responses. The Act has effectively become a vehicle for bypassing normal planning approval for major water infrastructure of state significance, not just critical town water supplies during drought."},"complexity_factors":["Multiple overlapping approval pathways: distinguishes between Schedule 2 projects (Minister authorisation), Schedule 3 projects (declared critical State significant infrastructure), and general regulation-making powers","Extensive cross-referencing to at least 6 other Acts: Environmental Planning and Assessment Act 1979, Water Management Act 2000, Biodiversity Conservation Act 2016, Fisheries Management Act 1994, Heritage Act 1977, Local Land Services Act 2013, Water NSW Act 2014, Local Government Act 1993","Multiple concurrence requirements: Minister must obtain concurrence from other Ministers (especially Biodiversity Conservation Minister) before making regulations or giving authorisations (Sections 5(3), 7(3), 8(6), 11(3), Schedule 1.1(3), Schedule 4.1(2))","Conditional exemptions with exceptions: Section 7(4) creates a specific prohibition on using regulations for new dams/weirs, forcing use of Schedule 3 instead","Nested definitions: \"development\" is defined by reference to another Act, then modified by exclusions in Schedule 3 clauses (e.g., excluding survey work from \"development\" for dam assessment purposes)","Sunset provisions with extension mechanisms: Section 21 creates automatic expiry with regulatory power to postpone","Savings and transitional provisions with backdating protections: Schedule 4.1(4) contains complex protections for rights existing before publication","Immunity and liability provisions with carve-outs: Sections 17-19 contain multiple conditions and exceptions (e.g., good faith requirement, personal injury exclusion)"],"plain_english_summary":"**What this law does:**\n\nThis Act is an emergency water infrastructure law designed to fast-track critical water supply projects for drought-stricken regional NSW towns. It creates a special \"fast lane\" for water projects that bypasses normal planning and environmental approval processes.\n\n**Who it affects:**\n\n- **Regional communities** in specific drought-affected areas (Dubbo, Tamworth, Orange, Cobar, Walgett, Bourke, Warren, Bathurst and others listed in the Schedules)\n- **Government agencies** (public authorities) building water infrastructure like pipelines, dams, and weirs\n- **Local councils** in affected areas\n- **Landholders and environment** near these projects (with reduced rights to object or claim compensation)\n\n**Key things the law does:**\n\n- **Declares specific towns as having \"critical\" water supplies** that need urgent intervention (Section 5 and Schedule 1)\n- **Exempts emergency water projects from normal planning laws** — projects listed in Schedule 2 don't need development consent or other approvals usually required under the Environmental Planning and Assessment Act 1979 (Part 3)\n- **Lets the Minister personally authorise projects** with conditions, overriding local planning rules (Sections 7-8)\n- **Fast-tracks major dam projects** — Wyangala Dam raising, Mole River Dam, Dungowan Dam, and the Western Weirs program are declared \"critical State significant infrastructure\" (Schedule 3)\n- **Allows regulations to override the Water Management Act 2000** if needed for these critical supplies (Part 4)\n- **Forces government agencies to cooperate** on these projects and gives the Minister power to direct them (Part 5)\n- **Removes compensation rights** for people affected by these projects, unless someone is injured or killed (Section 17)\n- **Protects against \"nuisance\" lawsuits** for projects built under this Act (Section 18)\n\n**Important limitations:**\n\n- **Does NOT apply to Sydney** or the Sydney catchment area (Section 4)\n- **Cannot be used for new dams or weirs** (except temporary weirs) or increasing dam storage capacity under the fast-track authorisation process — these must go through the Schedule 3 process instead (Section 7(4))\n- **Sunset clause:** Most of the Act (Parts 2-5) automatically expires 2 years after it becomes law, though this can be extended by regulations if drought risks continue (Section 21)\n\n**Why it matters:**\n\nThis law trades environmental scrutiny and community rights for speed. During severe drought, it lets the government build water infrastructure quickly to keep regional towns from running dry. However, it significantly reduces the usual checks and balances — no public objections, no normal environmental assessments, no compensation for affected property owners, and limited ability to challenge projects in court."},"flash_summary":{"complexity_score":6,"scope_assessment":{"changed":false,"description":"The supplied text does not indicate a change from an earlier stated original intent.
