It also sets priorities between classes of licences (cl 15) and rules for available water determinations and their registers (cls 16–17).\n- Sets record and register requirements for access dealings, security interests and water allocation accounts, and prescribes forms and fees for many applications and claims (cls 18–23, 20, 21, 23).\n- Creates a detailed mechanism for issuing replacement floodplain‑harvesting access licences to eligible floodplain landholders, including eligibility criteria (cl 34), methods for determining the share component of a replacement licence (cls 35–43), modelling to allocate a water share across landholders (cls 39–42), notice and consultation requirements (cl 38), and circumstances where no licence will issue (cl 44).\n- Sets out many exemptions from the requirement to hold access licences or approvals (Part 3; Schedule 4). These exemptions cover public authorities, essential infrastructure, emergency works, certain aquifer interference activities, some coastal construction, hydro‑electric projects, drought relief, and many other narrowly described activities (Schedule 4, Parts 2–6 and Part 7 excluded works).\n- Reforms approvals processes: application content, advertising rules, registers of approvals and classes of works, and when the Minister may refuse surrender or accept amendments (Part 4, cls 46–60).\n- Establishes an extensive metering and measurement regime (Part 5 and Schedules 5–6): mandatory metering equipment conditions; technical standards for installation, validation, telemetry, data logging and tamper‑evidence (Schedule 5); dedicated floodplain harvesting metering standards, measurement periods, mandatory point‑of‑intake and storage meters (Schedule 6, cls 79–87); exemptions from metering (Schedule 7); transitional arrangements for older meters (Schedule 12, Schedule 5 transitional provisions); and detailed duties for “duly qualified persons” who install, validate or certify meters (Schedule 8, cls 94–105).\n- Requires frequent records and reporting: telemetry/monthly reports, fortnightly reports during floodplain measurement periods, fortnightly and end‑of‑period reporting of measurement period usage, and record retention (e.g. cls 106–114, 112–113). Faulty metering, secondary metering and repair timeframes are prescribed (cls 90–93).\n- Strengthens enforcement and compliance: compliance audit requirements and who may undertake them (cl 138); a prescribed methodology to value illegally taken water (cl 139 and Schedule 10 gross margin values); an expanded penalty‑notice schedule and amounts for many offences (cl 140 and Schedule 11); and compliance cost notices with prescribed calculation methods and limits (cl 140A).\n- Inserts a landholder negotiation scheme for declared environmental water releases that requires the Ministerial Corporation to invite and negotiate with affected landholders, with procedural safeguards, timelines and guideline requirements (Schedule 9, cls 3–10).\n- Applies a range of operational rules for private water entities, irrigation corporations and public works (Part 6–8, Part 7), including powers about security for unpaid charges, notification obligations, works plans, and auditor qualifications.\n\n**Who it affects**\n\n- Primary affected parties:\n  - Holders of access licences and water supply work approvals (farmers, irrigators, utilities, councils, private water entities). See Parts 3–5, Schedules 3, 5–7.\n  - Floodplain landholders who may be eligible for replacement floodplain harvesting access licences (Division 2 of Part 3, cls 33–44).\n  - Approval holders who must install, validate and report under the metering rules (Part 5, Schedules 5–6, cls 81–87; cls 106–114).\n  - Duly qualified persons (industry practitioners) responsible for metering installation, validation and certification (Schedule 8; cls 95–104).\n  - Public authorities and Network operators granted various exemptions (Schedule 4, Parts 2–6; cl 64–65).\n  - Private water corporations/trusts, and their members — regulated obligations about rules, charges, audits and security (Part 7, cls 122–133).\n  - The Department/Minister and Ministerial Corporation — increased statutory roles in approvals, exemptions, publishing data and conducting or overseeing negotiations and enforcement (multiple provisions, e.g. cls 38, 43, 59, 65, Schedule 9).\n\n**Why it matters (mechanical consequences and incentives)**\n\n- Measurement and reporting become central. The regulation turns metering, telemetry and data‑logging into mandatory compliance levers (Schedule 5 and cl 81). That creates recurring costs for licence and approval holders (purchase, install, validation, telemetry subscriptions, recurring maintenance) and recurring reporting burdens (monthly/fortnightly/within 24‑hour windows). (See cll 70–71, 82, 106–114; Schedules 5–6.)\n\n- For floodplain landholders the regulation introduces a formalised path to replacement floodplain‑harvesting licences with a multi‑model determination process and potential proportional adjustments if proposed shares exceed long‑term extraction limits. That converts historical or de facto practices into quantified licence shares and subjects holders to notice, consultation and potential reduction (Division 2, cls 34–44; cls 39–42). The Minister carries significant decision power in applying models and making final adjustments (clls 35–42, 38). \n\n- Enforcement is operationalised through clearer valuation of illegally taken water (VWAP/gross margin approach in cl 139), explicit penalty notice amounts (Schedule 11), compliance audits with cost recovery on the holder (cl 138), and compliance cost notices with hourly charge bases and set maxima for certain activities (cl 140A). That increases the downside risk and potential cash cost of non‑compliance for individuals and corporations.\n\n- The Minister retains broad discretion to grant or revoke exemptions and to set conditions or adopt technical standards via Gazette and Department publications (see cls 76–78, Schedule 5 cl 10, cll 65 and 59). This creates implementation and regulatory‑discretion risk: ability to vary rules without primary legislation changes, requiring licence/approval holders to monitor administrative instruments (websites, Gazette notices).\n\n- The landholder negotiation scheme for environmental releases (Schedule 9) imposes a formal negotiation process (invitation, 12‑month negotiation period, guidelines) and contemplates potential compulsory acquisition as a discussed outcome (Schedule 9 cls 3–8). That provides an institutional channel to negotiate mitigation and compensation but introduces new administrative processes for affected landholders and the Ministerial Corporation.\n\n**Costs and who pays**\n\n- Licence and approval holders pay for metering hardware, validation and certification (duly qualified persons), telemetry and data fees, maintenance, and compliance reporting. They also bear the cost of compliance audits, security deposits (cl 59), and possible penalties or charges for illegal take (cl 139, Schedule 11).\n- Private water entities may require security from members for rates/charges; they may incur administrative costs to comply with new rules on works plans, member notification and dispute processes (Part 7).\n- The Department/Minister carries the administrative cost of maintaining registers, publishing determinations and exemptions, conducting reviews (Schedule 9 cl 10) and processing applications and reports. These are indirect public costs, but some are recovered via fees (cl 23, Schedule 3, cl 123).\n\n**Incentives, substitution effects and trade‑offs**\n\n- Strong metering and telemetry rules create incentives to minimise non‑metered activity and to regularise water use under licences rather than relying on exemptions or unmeasured takes. That can shift investment from other on‑farm spending towards measurement and compliance.\n- Exemptions remain broad in some contexts (emergency works, essential infrastructure, some mining‑related aquifer activities, basic landholder rights), so actors with access to exemptions or public authority status face fewer measurement costs. That difference concentrates compliance costs on privately held licences without exemption status (see Schedule 4 and Schedule 7). \n- The floodplain replacement licence model can reduce some landholders’ authorised water shares to meet long‑term extraction limits. That creates an opportunity cost: foregone water use or the need to buy water allocations/entitlements on markets. The plan‑limit compliance model (cl 42) spreads adjustments proportionately across eligible landholders — concentrating the burden on a defined cohort rather than system‑wide.\n\n**Implementation risk and administrative complexity**\n\n- High administrative and technical complexity: the regulation relies on technical standards (AS 4747—2025), Ministerially approved telemetry and storage curve standards, and many operational instruments published on the Department’s website or in the Gazette (Schedules 5–6). That requires capacity within government to keep standards current and accessible and will require private parties to consult multiple sources.\n- Large discretion is given to the Minister (exemptions, share adjustments, approval refusals, adoption of storage curves) which raises implementation uncertainty for affected parties (see clls 38, 42, 59, 76–88, Schedule 6 cl 4).\n- Transitional arrangements and temporary exemptions create layered rules depending on installation date, licence type, water source and region; compliance depends on tracking time‑limited exemptions (Schedule 7, Schedule 12). That multiplies compliance checking costs and error risk.\n\n**Concrete effects on private choice and enterprise**\n\n- Farmers and private entitlement holders will need to decide whether to invest in compliant metering and telemetry, accept replacement licence share determinations (or contest them in submissions), or restructure water use (buy allocations, reduce cropping area, or switch water sources). See Division 3A (return flow recredit rules, cls 30A–30C), Division 2 (floodplain licence determinations) and Part 5 (metering).\n- Private water entities gain rulemaking latitude over security, dealings and charging, which affects member‑level risk and liquidity (Part 7, cl 125). They must also provide works plans and make rules for forfeiture and dealings (clls 125–128).\n\n**Where the regulation relies on claims by the source (official rationale) and how that interacts with costs/trade‑offs**\n\n- Officially, the regulation tightens measurement and compliance to protect water sources and to bring floodplain harvesting into a licensed framework (see Division 3A and Division 2 of Part 3). Mechanically, this imposes costs (metering, validation, reporting) to create data that enables enforcement, allocation adjustments and environmental water operations. The trade‑off is clearer enforcement and measurable accountability versus increased capital and operating costs for water users and a heavier administrative burden for the Department.\n\n- The landholder negotiation scheme is presented as a way to consult and reach mitigations for declared environmental releases (Schedule 9). Mechanically, it creates a structured negotiation pathway and timelines but does not eliminate the Minister’s power to declare releases or to end negotiations (Schedule 9 cls 3 and 6). The costs here are negotiation administration and potential transaction costs for landholders; the scheme can reduce adversarial litigation risk but requires resourcing for facilitation and possible compensation.\n\n**Key sections to consult for particular obligations**\n\n- Metering and telemetry: Part 5 and Schedules 5–6 (cls 67–78; Schedule 5 & Schedule 6).  \n- Floodplain replacement licences: Part 3 Division 2 (cls 33–44).  \n- Exemptions (who need not hold licences/approvals): Schedule 4.  \n- Records and reporting: cls 106–114, 112–114 (records during measurement periods and telemetry/monthly reporting).  \n- Enforcement, valuation of illegally taken water, penalties and compliance costs: cls 138–140A and Schedules 10–11.\n\n(If you need a one‑page checklist tailored to a specific role — irrigator, private water entity, council, or meter installer — I can produce it with the exact sections and timelines you must follow.)"}},"importantCases":[],"_links":{"self":"/api/acts/water-management-general-regulation-2025","history":"/api/acts/water-management-general-regulation-2025/history","analysis":"/api/acts/water-management-general-regulation-2025/analysis","conflicts":"/api/acts/water-management-general-regulation-2025/conflicts","importantCases":"/api/acts/water-management-general-regulation-2025/important-cases","documents":"/api/acts/water-management-general-regulation-2025/documents"}}
