speech—*\n\n*Legislative Assembly: 16 November 1994*\n\n*Legislative Council: 7 December 1994*\n\nThe long title for the Bill for this Act was \"A Bill to provide for the reform of the water industry, to amend the **Melbourne and Metropolitan Board of Works Act 1958**, the **Water Act 1989**, the **Melbourne Water Corporation Act 1992** and certain other Acts and for other purposes.\".\n\nThe **Water Industry Act 1994** was assented to on 20 December 1994 and came into operation as follows:\n\nSections 1, 2 on 20 December 1994: section 2(1); rest of Act on 1 January 1995: Special Gazette (No. 105) 23 December 1994 page 1.\n\nINTERPRETATION OF LEGISLATION ACT 1984 (ILA)\n\nStyle changes\n\nSection 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided section or clause of a Schedule is amended by the insertion of one or more subsections or subclauses, the original section or clause becomes subsection or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original section or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in an Act which is passed on or after 1 January 2001 form part of that Act. Any heading inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. This includes headings to Parts, Divisions or Subdivisions in a Schedule; sections; clauses; items; tables; columns; examples; diagrams; notes or forms. See section 36(1A)(2A).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in an Act which is passed on or after 1 January 2001 form part of that Act. Any examples, diagrams or notes inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, form part of that Act. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in an Act which is passed on or after 1 January 2001 forms part of that Act. Any punctuation inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. See section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in an Act form part of that Act, whether inserted in the Act before, on or after 1 January 2001. Provision numbers include section numbers, subsection numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of an Act is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of an Act.  \nSee section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the **Water Industry Act 1994** by Acts and subordinate instruments.\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––\n\n**Water Industry Act 1994, No. 121/1994**\n\n| Assent Date: | 20.12.94 |\n\n| *Commencement Date:* | Ss 202−205 on 1.7.24: s. 201; The Commission can set prices, service standards, and market conduct rules through \"Water Industry Regulatory Orders\" and \"Water Industry Standards.\"\n2. **Funds parks and waterways**: Part 4 allows the government to levy special rates on metropolitan landowners to pay for the management of waterways, open space, and reservoir parks. This money goes into a \"Parks and Reserves Trust Account\" rather than general revenue.\n3. **Charges an environmental levy**: Part 9 requires water supply authorities across Victoria to pay \"environmental contributions\" into the state budget. These funds are ring-fenced for projects that promote sustainable water use or fix environmental damage caused by water infrastructure.\n\n**Who it affects**\n- **Water corporations**: From the big metropolitan retailers (City West Water, South East Water, Yarra Valley Water) to regional and rural authorities. They must comply with pricing rules, service standards, and pay environmental contributions.\n- **Landowners**: If you own land in specified metropolitan areas, you may pay rates to help maintain local waterways and parks.\n- **Consumers**: Anyone who pays a water bill is affected by the pricing decisions made under this Act.\n- **Recreational users**: People who use jetties, moorings, or visit reservoir parks are affected by the land management powers in Part 4.\n\n**Why it matters**\nOriginally passed in 1994 to break up the old Melbourne and Metropolitan Board of Works (MMBW) monopoly, the Act now functions as the main economic regulator for water services. It ensures water companies can't charge whatever they want, requires them to meet minimum service standards, and creates a dedicated funding stream to keep Melbourne's waterways and parks maintained without relying on general taxes."}},"importantCases":[],"_links":{"self":"/api/acts/water-industry-act-1994","history":"/api/acts/water-industry-act-1994/history","analysis":"/api/acts/water-industry-act-1994/analysis","conflicts":"/api/acts/water-industry-act-1994/conflicts","importantCases":"/api/acts/water-industry-act-1994/important-cases","documents":"/api/acts/water-industry-act-1994/documents"}}
