Regulations 5, 6, and 8 were deleted in 2009, and the current version relies heavily on incorporation by reference to the Uniform Shipping Laws Code as at 1 October 2009. The legislation has effectively become a 'shell' that imports external standards rather than containing detailed prescriptive rules itself. This represents a shift from original detailed regulations to a simpler 'adopt and adapt' approach using national codes."},"complexity_factors":["Extremely short - only 9 regulations with 2 deleted and 2 omitted from numbering","Minimal defined terms - only 'Code' is defined in regulation 3(1)","Single substantive incorporation by reference (Section 15 of the Uniform Shipping Laws Code)","Simple modification structure - only two specific exclusions from the incorporated Code (Part E items 2.8.5.2 and 2.11.1.3)","Straightforward offence provision with flat penalty","No nested conditions, exceptions to exceptions, or complex cross-referencing within the instrument itself"],"plain_english_summary":"These regulations set out emergency procedures and safety rules for vessels operating in Western Australian waters. They essentially import Section 15 of the Uniform Shipping Laws Code (a national set of maritime safety rules) into Western Australian law, with two specific exceptions. The rules apply to all vessels covered by the Western Australian Marine Act 1982. If a ship's master or crew breach these safety requirements without a reasonable excuse, they face a fine of up to $1,000. The regulations also specify how vessels should be classified for safety purposes."},"flash_summary":{"complexity_score":5,"scope_assessment":{"changed":true,"description":"Yes. The regulations were amended to incorporate Section 15 of the Uniform Shipping Laws Code (reg 4(1)) with two express exclusions (reg 4(2)(a)–(b)), and the definition of 'Code' was fixed to the version existing on 1 October 2009 (reg 3(1)). Those amendments (and deletions of earlier regs 5, 6 and 8 as noted) broaden the instrument’s practical reach by making the external Code provisions directly enforceable under the Marine Act while carving out two specific Standard items. Concretely, masters and other persons now face enforceable duties derived from the Code (reg 7 sets the penalty), but precise obligations depend on the cited 2009 Code and the two exclusions (regs 3, 4, 7, 9)."},"complexity_factors":["Incorporation by reference: Section 15 of the Uniform Shipping Laws Code is incorporated into the regulations, rather than restating rules directly (reg 4(1)).","Targeted modification: two specific items of Part E of the National Standard for Commercial Vessels are expressly excluded from the incorporated Section 15 (reg 4(2)(a)–(b)), creating a hybrid rule set.","Fixed external-version reference: the term 'Code' is defined as the Code 'as in existence on 1 October 2009', so compliance depends on a historical version of an external instrument (reg 3(1)).","External cross-reference for classification: vessel classes are specified by reference to clause 6 of Section 1 of the Code, increasing reliance on the Code for operational detail (reg 9).","Enforcement and penalties are simple but summary: a single offence provision targets masters or others with a $1,000 fine on conviction (reg 7).","Amendment history and deletions: insertions and deletions (regs 3–4 inserted, regs 5–6 and 8 deleted; compilation table) mean readers must track versions to know current scope.","Practical compliance burden: because the regulations mainly point to external standards, regulated parties must consult multiple external documents to know exact obligations (regs 3, 4, 9)."],"plain_english_summary":"These regulations fold Section 15 of the Uniform Shipping Laws Code (with two specified exclusions) into Western Australian law, apply those emergency-procedure and navigation safety rules to all vessels and voyages covered by the Marine Act, and adopt the Code’s vessel classification rules.
