and\n\n(b) to establish the Voluntary Assisted Dying Review Board; and\n\n(c) to make consequential amendments to the **Births, Deaths and Marriages Registration Act 1996**, the **Coroners Act 2008**, the **Drugs, Poisons and Controlled Substances Act 1981** and other Acts.\n\n","sortOrder":2},{"sectionNumber":"2","sectionType":"section","heading":"Commencement","content":"\t2 Commencement\n\n(1) Subject to subsection (2), this Act comes into operation on a day or days to be proclaimed.\n\n(2) If a provision of this Act does not come into operation before 19 June 2019, it comes into operation on that day.\n\n","sortOrder":3},{"sectionNumber":"3","sectionType":"section","heading":"Definitions","content":"\t3 Definitions\n\n(1) In this Act—\n\n***administration request*** means a request made under section 64 for the administration of a voluntary assisted dying substance;\n\n***approved assessment training*** means training approved by the Secretary under section 114;\n\n***Australian Health Practitioner Regulation Agency*** means the Australian Health Practitioner Regulation Agency established by section 23 of the Health Practitioner Regulation National Law;\n\n***Board*** means the Voluntary Assisted Dying Review Board established under section 92;\n\n***Chief Commissioner of Police*** has the same meaning as Chief Commissioner has in the **Victoria Police Act 2013**;\n\n***consulting assessment*** means an assessment  \nof a person conducted in accordance with Division 4 of Part 3 by a consulting medical practitioner for the person;\n\n***consulting assessment report form*** means a form in the form of Form 2 in Schedule 1 completed under section 30;\n\n***consulting medical practitioner*** for a person means a registered medical practitioner who accepts a referral to conduct a consulting assessment of the person;\n\n***contact person*** means a person appointed under section 39;\n\n***contact person appointment form*** means a form in the form of Form 4 in Schedule 1 completed under section 40;\n\n***co-ordinating medical practitioner*** for a person means a person who is—\n\n(a) a registered medical practitioner who accepts the person's first request; or\n\n(b) a consulting medical practitioner for the person who accepts a transfer of the role of co-ordinating medical practitioner under section 33;\n\n***co-ordinating medical practitioner administration form*** means a form in the form of Form 8 in Schedule 1 completed by a witness under section 65 and a co‑ordinating medical practitioner under section 66;\n\n***decision-making capacity*** has the meaning set out in section 4;\n\n***de-identified***, in relation to personal information or health information, means personal information or health information that no longer relates to an identifiable individual or an individual who can be reasonably identified;\n\n***dispensing pharmacy*** means the pharmacy, pharmacy business or pharmacy department from which a pharmacist sold or supplied a voluntary assisted dying substance;\n\n***domestic partner*** of a person means—\n\n(a) a person who is in a registered relationship with the person; or\n\n(b) an adult person to whom the person is not married but with whom the person is in a relationship as a couple where one or each of them provides personal or financial commitment and support of a domestic nature for the material benefit of the other, irrespective of their genders and whether or not they are living under the same roof, but does not include a person who provides domestic support and personal care to the person—\n\n(i) for fee or reward; or\n\n(ii) on behalf of another person or an organisation (including a government, a government agency, a body corporate or a charitable or benevolent organisation);\n\n***drug of dependence*** has the same meaning as in section 4 of the **Drugs, Poisons and Controlled Substances Act 1981**;\n\n***eligibility criteria*** means the criteria set out in section 9;\n\n***family member*** of a person means the person's spouse or domestic partner, parent, sibling, child or grandchild;\n\n***final request*** means a request for access to voluntary assisted dying made under section 37 by a person to the co-ordinating medical practitioner for the person;\n\n***final review*** means a review conducted under section 41 by the co-ordinating medical practitioner for the person;\n\n***final review form*** means a form in the form of Form 5 in Schedule 1 completed under section 41;\n\n***first assessment*** means an assessment of a person conducted in accordance with Division 3 of Part 3 by the co-ordinating medical practitioner for the person;\n\n***first assessment report form*** means a form in the form of Form 1 in Schedule 1 completed under section 21;\n\n***first request*** means a request for access to voluntary assisted dying made under section 11 by a person to a registered medical practitioner;\n\n***health facility*** has the same meaning as in the **Medical Treatment Planning and Decisions Act 2016**;\n\n***health information*** has the same meaning as in the **Health Records Act 2001**;\n\n***health service*** has the same meaning as in the **Health Complaints Act 2016**;\n\n***identifying information*** means health information or personal information about a person whose identity is apparent, or can reasonably be ascertained, from that information;\n\n***ineligible witness*** has the meaning given by section 35(2);\n\n***labelling statement*** means a statement attached to a container as required by section 59(1);\n\nS. 3(1) def. of *mental illness* amended by No. 39/2022 s. 882.\n\n***mental illness***  has the same meaning as in the **Mental Health and Wellbeing Act 2022**;\n\n***palliative care*** has the same meaning as in the **Medical Treatment Planning and Decisions Act 2016**;\n\n***personal information*** has the same meaning as in the **Privacy and Data Protection Act 2014**;\n\n***pharmacist*** means a person registered under the Health Practitioner Regulation National Law to practise in the pharmacy profession (other than as a student);\n\n***pharmacy*** has the same meaning as in the **Pharmacy Regulation Act 2010**;\n\n***pharmacy business*** has the same meaning as in the **Pharmacy Regulation Act 2010**;\n\n***pharmacy department*** has the same meaning as in the **Pharmacy Regulation Act 2010**;\n\n***poison or controlled substance*** has the same meaning as in section 4 of the **Drugs, Poisons and Controlled Substances Act 1981**;\n\n***Poisons Code*** has the same meaning as in section 4 of the **Drugs, Poisons and Controlled Substances Act 1981**;\n\n***practitioner administration permit*** means a permit issued under section 49(2)(a)(ii);\n\nS. 3(1) def. of *professional care services* amended by No. 19/2019 s. 275.\n\n***professional care services*** means any of the following provided to another person under a contract of employment or a contract for services—\n\n(a) support or assistance;\n\n(b) special or personal care;\n\n(c) a disability service within the meaning of the **Disability Act 2006**;\n\n(d) services provided by a registered NDIS provider within the meaning of the National Disability Insurance Scheme Act 2013 of the Commonwealth;\n\n***psychiatrist*** means a person who is registered under the Health Practitioner Regulation National Law as a medical practitioner in the speciality of psychiatry (other than as a student);\n\n***registered health practitioner*** means a person registered under the Health Practitioner Regulation National Law to practise a health profession (other than as a student);\n\n***Registrar*** has the same meaning as in the **Births, Deaths and Marriages Registration Act 1996**;\n\n***request and assessment process*** means, in respect of a person, the making or the conducting of the following under Part 3—\n\n(a) a first request;\n\n(b) a first assessment;\n\n(c) a consulting assessment;\n\n(d) a written declaration;\n\n(e) a final request;\n\n(f) a contact person appointment;\n\n(g) a final review;\n\n***Secretary*** means the Department Head (within the meaning of the **Public Administration Act 2004**) of the Department of Health and Human Services;\n\n***self-administration permit*** means a permit issued under section 49(2)(a)(i);\n\n***special or personal care*** means—\n\n(a) assistance with one or more of the following—\n\n(i) bathing, showering or personal hygiene;\n\n(ii) toileting;\n\n(iii) dressing or undressing;\n\n(iv) meals; or\n\n(b) assistance for persons with mobility problems; or\n\n(c) assistance for persons who are mobile but require some form of supervision or assistance; or\n\n(d) assistance or supervision in administering medicine; or\n\n(e) the provision of substantial emotional support;\n\n***spouse*** of a person means a person to whom the person is married;\n\n***supply*** has the same meaning as in section 4 of the **Drugs, Poisons and Controlled Substances Act 1981**;\n\n***vocationally registered general practitioner*** has the same meaning as in the Health Insurance Act 1973 of the Commonwealth;\n\n***voluntary assisted dying*** means the administration of a voluntary assisted dying substance and includes steps reasonably related to such administration;\n\n***voluntary assisted dying permit*** means—\n\n(a) a self-administration permit; or\n\n(b) a practitioner administration permit;\n\n***voluntary assisted dying substance*** means a poison or controlled substance or a drug of dependence specified in a voluntary assisted dying permit for the purpose of causing a person's death;\n\n***voluntary assisted dying substance dispensing form*** means a form in the form of Form 6 in Schedule 1 completed by a pharmacist under section 60;\n\n***voluntary assisted dying substance disposal form*** means a form in the form of Form 7 in Schedule 1 completed by a pharmacist under section 63;\n\n***written declaration*** means a declaration made under section 34 in the form of Form 3 in Schedule 1.\n\n(2) For the purposes of the definition of ***domestic partner*** in subsection (1)—\n\n(a) ***registered relationship*** has the same meaning as it has in the **Relationships Act 2008**; and\n\n(b) in determining whether persons who are not in a registered relationship are domestic partners of each other, all the circumstances of the relationship are to be taken into account, including any one or more of the matters referred to in section 35(2) of the **Relationships Act 2008** as may be relevant in a particular case; and\n\n(c) a person is not a domestic partner of another person merely because they are co-tenants.\n\n","sortOrder":4},{"sectionNumber":"4","sectionType":"section","heading":"Meaning of *decision-making capacity*","content":"\t4 Meaning of *decision-making capacity*\n\n(1) A person has decision-making capacity in relation to voluntary assisted dying  if the person is able to—\n\n(a) understand the information relevant to the decision relating to access to voluntary assisted dying and the effect of the decision; and\n\n(b) retain that information to the extent necessary to make the decision; and\n\n(c) use or weigh that information as part of the process of making the decision; and\n\n(d) communicate the decision and the person's views and needs as to the decision in some way, including by speech, gestures or other means.\n\n(2) For the purposes of subsection (1), a person is presumed to have decision-making capacity unless there is evidence to the contrary.\n\n(3) For the purposes of subsection (1)(a), a person is taken to understand information relevant to a decision if the person understands an explanation of the information given to the person in a way that is appropriate to the person's circumstances, whether by using modified language, visual aids or any other means.\n\n(4) In determining whether or not a person has decision-making capacity, regard must be had to the following—\n\n(a) a person may have decision-making capacity to make some decisions and not others;\n\n(b) if a person does not have decision-making capacity to make a particular decision, it may be temporary and not permanent;\n\n(c) it should not be assumed that a person does not have decision-making capacity to make a decision—\n\n(i) on the basis of the person's appearance; or\n\n(ii) because the person makes a decision that is, in the opinion of others, unwise;\n\n(d) a person has decision-making capacity to make a decision if it is possible for the person to make a decision with practicable and appropriate support.\n\n**Examples**\n\nPracticable and appropriate support includes the following—\n\n(a) using information or formats tailored to the particular needs of a person;\n\n(b) communicating or assisting a person to communicate the person's decision;\n\n(c) giving a person additional time and discussing the matter with the person;\n\n(d) using technology that alleviates the effects of a person's disability.\n\n(5) A person who is assessing whether a person has decision-making capacity for the purposes of this Act must take reasonable steps to conduct the assessment at a time and in an environment in which the person's decision-making capacity can be most accurately assessed.\n\n","sortOrder":5},{"sectionNumber":"5","sectionType":"section","heading":"Principles","content":"\t5 Principles\n\n(1) A person exercising a power or performing a function or duty under this Act must have regard to the following principles—\n\n(a) every human life has equal value;\n\n(b) a person's autonomy should be respected;\n\n(c) a person has the right to be supported in making informed decisions about the person's medical treatment, and should be given, in a manner the person understands, information about medical treatment options including comfort and palliative care;\n\n(d) every person approaching the end of life should be provided with quality care to minimise the person's suffering and maximise the person's quality of life;\n\n(e) a therapeutic relationship between a person and the person's health practitioner should, wherever possible, be supported and maintained;\n\n(f) individuals should be encouraged to openly discuss death and dying and an individual's preferences and values should be encouraged and promoted;\n\n(g) individuals should be supported in conversations with the individual's health practitioners, family and carers and community about treatment and care preferences;\n\n(h) individuals are entitled to genuine choices regarding their treatment and care;\n\n(i) there is a need to protect individuals who may be subject to abuse;\n\n(j) all persons, including health practitioners, have the right to be shown respect for their culture, beliefs, values and personal characteristics.\n\n(2) In subsection (1), the reference to a person exercising a power or performing a function or duty under this Act includes VCAT.\n\n","sortOrder":6},{"sectionNumber":"6","sectionType":"section","heading":"When may a person access voluntary assisted dying?","content":"\t6 When may a person access voluntary assisted dying?\n\nA person may access voluntary assisted dying if—\n\n(a) the person has made a first request; and\n\n(b) the person has been assessed as eligible for access to voluntary assisted dying by—\n\n(i) the co-ordinating medical practitioner for the person; and\n\n(ii) a consulting medical practitioner for the person; and\n\n(c) the person has made a written declaration; and\n\n(d) the person has made a final request to the co‑ordinating medical practitioner; and\n\n(e) the person has appointed a contact person; and\n\n(f) the co-ordinating medical practitioner has certified in a final review form that the request and assessment process has been completed as required by this Act; and\n\n(g) the person is the subject of a voluntary assisted dying permit.\n\n","sortOrder":7},{"sectionNumber":"7","sectionType":"section","heading":"Conscientious objection of registered health practitioners","content":"\t7 Conscientious objection of registered health practitioners\n\nA registered health practitioner who has a conscientious objection to voluntary assisted dying has the right to refuse to do any of the following—\n\n(a) to provide information about voluntary assisted dying;\n\n(b) to participate in the request and assessment process;\n\n(c) to apply for a voluntary assisted dying permit;\n\n(d) to supply, prescribe or administer a voluntary assisted dying substance;\n\n(e) to be present at the time of administration of a voluntary assisted dying substance;\n\n(f) to dispense a prescription for a voluntary assisted dying substance.\n\n","sortOrder":8},{"sectionNumber":"8","sectionType":"section","heading":"Voluntary assisted dying must not be initiated  by registered health practitioner","content":"\t8 Voluntary assisted dying must not be initiated  by registered health practitioner\n\n(1) A registered health practitioner who provides health services or professional care services to a person must not, in the course of providing those services to the person—\n\n(a) initiate discussion with that person that is in substance about voluntary assisted dying; or\n\n(b) in substance, suggest voluntary assisted dying to that person.\n\n(2) Nothing in subsection (1) prevents a registered health practitioner providing information about voluntary assisted dying to a person at that person's request.\n\n(3) A contravention of subsection (1) is to be regarded as unprofessional conduct within the meaning and for the purposes of the Health Practitioner Regulation National Law.\n\n","sortOrder":9},{"sectionNumber":"Part 2","sectionType":"part","heading":"Criteria for access to voluntary assisted dying","content":"Part 2—Criteria for access to voluntary assisted dying\n\n","sortOrder":10},{"sectionNumber":"9","sectionType":"section","heading":"Eligibility criteria for access to voluntary assisted dying","content":"\t9 Eligibility criteria for access to voluntary assisted dying\n\n(1) For a person to be eligible for access to voluntary assisted dying—\n\n(a) the person must be aged 18 years or more; and\n\n(b) the person must—\n\n(i) be an Australian citizen or permanent resident; and\n\n(ii) be ordinarily resident in Victoria; and\n\n(iii) at the time of making a first request, have been ordinarily resident in Victoria for at least 12 months; and\n\n(c) the person must have decision-making capacity in relation to voluntary assisted dying; and\n\n(d) the person must be diagnosed with a disease, illness or medical condition that—\n\n(iii) is expected to cause death within weeks or months, not exceeding 6 months; and\n\nS. 9(2) amended by No. 39/2022 s. 883.\n\n(2) A person is not eligible for access to voluntary assisted dying only because the person is diagnosed with a mental illness, within the meaning of the **Mental Health and Wellbeing Act 2022**.\n\n(3) A person is not eligible for access to voluntary assisted dying only because the person has a disability, within the meaning of section 3(1) of the **Disability Act 2006**.\n\n(4) Despite subsection (1)(d)(iii), if the person is diagnosed with a disease, illness or medical condition that is neurodegenerative, that disease, illness or medical condition must be expected to cause death within weeks or months, not exceeding 12 months.\n\n","sortOrder":11},{"sectionNumber":"Part 3","sectionType":"part","heading":"Requesting access to voluntary","content":"Part 3—Requesting access to voluntary  \nassisted dying and assessment of eligibility\n\n","sortOrder":12},{"sectionNumber":"Div 1","sectionType":"division","heading":"Minimum requirements for co‑ordinating medical practitioners and consulting medical practitioners","content":"Division 1—Minimum requirements for co‑ordinating medical practitioners and consulting medical practitioners\n\n","sortOrder":13},{"sectionNumber":"10","sectionType":"section","heading":"Minimum requirements for co-ordinating medical practitioners and consulting medical practitioners","content":"\t10 Minimum requirements for co-ordinating medical practitioners and consulting medical practitioners\n\n(1) Each co-ordinating medical practitioner and consulting medical practitioner must—\n\n(a) hold a fellowship with a specialist medical college; or\n\n(b) be a vocationally registered general practitioner.\n\n(2) Either the co-ordinating medical practitioner or each consulting medical practitioner must have practised as a registered medical practitioner for at least 5 years after completing a fellowship with a specialist medical college or vocational registration (as the case requires).\n\n  (3) Either the co-ordinating medical practitioner or each consulting medical practitioner must have relevant expertise and experience in the disease, illness or medical condition expected to cause the death of the person being assessed.\n\n","sortOrder":14},{"sectionNumber":"Div 2","sectionType":"division","heading":"First request","content":"Division 2—First request\n\n","sortOrder":15},{"sectionNumber":"11","sectionType":"section","heading":"Person may make first request to registered medical practitioner","content":"\t11 Person may make first request to registered medical practitioner\n\n(1) A person may make a request to a registered medical practitioner for access to voluntary assisted dying.\n\n(2) A request for access to voluntary assisted dying must be—\n\n(a) clear and unambiguous; and\n\n(b) made by the person personally.\n\n(3) The person may make the request verbally or by gestures or other means of communication available to the person.\n\n","sortOrder":16},{"sectionNumber":"12","sectionType":"section","heading":"No obligation to continue after making first request","content":"\t12 No obligation to continue after making first request\n\n(1) A person who has made a first request may decide at any time not to continue the request and assessment process.\n\n(2) The request and assessment process ends if a person decides not to continue the request and assessment process.\n\n(3) If the request and assessment process has ended under subsection (2), the person may commence a fresh request and assessment process by making a new first request.\n\n","sortOrder":17},{"sectionNumber":"13","sectionType":"section","heading":"Registered medical practitioner must accept or refuse first request","content":"\t13 Registered medical practitioner must accept or refuse first request\n\n(1) Within 7 days after receiving a first request  \nfrom a person, the registered medical practitioner to whom the request was made must inform the person that the practitioner—\n\n(a) accepts the first request; or\n\n(b) refuses the first request because the practitioner—\n\n(i) has a conscientious objection to voluntary assisted dying; or\n\n(ii) believes that the practitioner will  \nnot be able to perform the duties of co‑ordinating medical practitioner due to unavailability; or\n\n(iii) is required under subsection (2) to refuse the first request.\n\n(2) The registered medical practitioner must not accept the first request unless the practitioner—\n\n(a) holds a fellowship with a specialist medical college; or\n\n(b) is a vocationally registered general practitioner.\n\n","sortOrder":18},{"sectionNumber":"14","sectionType":"section","heading":"Registered medical practitioner who accepts first request must record first request and acceptance","content":"\t14 Registered medical practitioner who accepts first request must record first request and acceptance\n\nIf the registered medical practitioner accepts the person's first request, the practitioner must—\n\n(a) record the practitioner's decision to accept the first request in the person's medical record; or\n\n(b) a specialist registered medical practitioner under subsection (2)—\n\nthe co-ordinating medical practitioner may adopt the determination of the registered health practitioner or specialist registered medical practitioner (as the case requires) in relation to the matter in respect of which the person was referred.\n\n(4) If the co-ordinating medical practitioner is able to determine that the person has a disease, illness or medical condition that is neurodegenerative in accordance with section 9(4) that—\n\n(a) will cause death; and\n\n(b) is expected to cause death between 6 and 12 months—\n\nthe co-ordinating medical practitioner must refer the person to a specialist registered medical practitioner who has appropriate skills and training in that particular disease, illness or medical condition that is neurodegenerative, whether or not the co-ordinating medical practitioner had also made a referral under subsection (2).\n\n(5) The specialist registered medical practitioner referred to in subsection (4) must—\n\n(a) determine whether the person has a disease, illness or medical condition that is neurodegenerative that—\n\n(i) will cause death; and\n\n(ii) is expected to cause death between 6 and 12 months; and\n\n(b) provide a clinical report to the co-ordinating medical practitioner that sets out the specialist registered medical practitioner's determination.\n\n(6) If the co-ordinating medical practitioner refers the person to a specialist registered medical practitioner under subsection (4), the co‑ordinating medical practitioner must adopt the determination of the specialist registered medical practitioner in respect of the matter in relation to which the person was referred.\n\n","sortOrder":24},{"sectionNumber":"19","sectionType":"section","heading":"Information to be provided if co-ordinating medical practitioner assesses person as meeting eligibility criteria","content":"\t19 Information to be provided if co-ordinating medical practitioner assesses person as meeting eligibility criteria\n\n(1) If the co-ordinating medical practitioner is satisfied that the person requesting access to voluntary assisted dying meets all the eligibility criteria, the co-ordinating medical practitioner must inform the person about the following matters—\n\n(d) the potential risks of taking a poison or controlled substance or a drug of dependence likely to be prescribed under this Act for the purposes of causing the person's death;\n\n(e) that the expected outcome of taking a poison or controlled substance or a drug of dependence referred to in paragraph (d) is death;\n\n(g) that if the person is receiving ongoing health services from a registered medical practitioner other than the co-ordinating medical practitioner, the person is encouraged to inform the registered medical practitioner of the person's request to access voluntary assisted dying.\n\n(2) In addition to the matters of which the co‑ordinating medical practitioner must inform the person under subsection (1), the co-ordinating medical practitioner must, if the person consents, take all reasonable steps to fully explain to a member of the family of the person—\n\n(a) all relevant clinical guidelines; and\n\n(b) a plan in respect of the self-administration of a voluntary assisted dying substance for the purpose of causing death.\n\n(3) Nothing in this section affects any duty a registered medical practitioner has at common law or under any other enactment.\n\n","sortOrder":25},{"sectionNumber":"20","sectionType":"section","heading":"Outcome of first assessment","content":"\t20 Outcome of first assessment\n\n(1) The co-ordinating medical practitioner must assess the person as eligible for access to voluntary assisted dying if the co-ordinating medical practitioner is satisfied that—\n\n(a) the person meets all the eligibility criteria for access to voluntary assisted dying; and\n\n(b) the person understands the information required to be provided under section 19(1); and\n\n(c) the person is acting voluntarily and without coercion; and\n\n(d) the person's request for access to voluntary assisted dying is enduring.\n\n(2) If the co-ordinating medical practitioner is not satisfied as to any matter in subsection (1)—\n\n(a) the person requesting access to voluntary assisted dying is ineligible for access to voluntary assisted dying; or\n\n(b) refuses the referral because the practitioner—\n\n(i) has a conscientious objection to voluntary assisted dying; or\n\n(ii) believes that the practitioner will not be able to perform the duties of consulting medical practitioner due to unavailability; or\n\n(iii) is required under subsection (2), (3) or (4) to refuse the referral.\n\n(2) The registered medical practitioner must not accept the referral unless the practitioner—\n\n(a) holds a fellowship with a specialist medical college; and\n\n(b) the consulting medical practitioner accepts the transfer of the role.\n\n(2) Within 7 days after being requested by the co‑ordinating medical practitioner to accept a transfer under subsection (1), the consulting medical practitioner must inform the co-ordinating medical practitioner whether the consulting medical practitioner accepts or refuses the transfer of the role.\n\n(3) If the consulting medical practitioner refuses the transfer of the role of co-ordinating medical practitioner, the co-ordinating medical practitioner for the person may—\n\n(a) refer the person to another registered medical practitioner to conduct a further consulting assessment; and\n\n(b) transfer the role of co-ordinating medical practitioner to that registered medical practitioner if that practitioner—\n\n(i) accepts the referral to conduct a further consulting assessment; and\n\n(ii) assesses the person as eligible for access to voluntary assisted dying; and\n\n(iii) accepts the transfer of the role.\n\n(4) If the registered medical practitioner accepts a referral to conduct a further consulting assessment, the consulting assessment that previously assessed the person as eligible for access to voluntary assisted dying becomes  \nvoid.\n\n","sortOrder":40},{"sectionNumber":"Div 5","sectionType":"division","heading":"Written declaration","content":"Division 5—Written declaration\n\n","sortOrder":41},{"sectionNumber":"34","sectionType":"section","heading":"Person assessed as eligible for access to voluntary assisted dying may make written declaration","content":"\t34 Person assessed as eligible for access to voluntary assisted dying may make written declaration\n\n(1) A person may make a written declaration requesting access to voluntary assisted dying if the person has been assessed as eligible for access to voluntary assisted dying by—\n\n(a) the co-ordinating medical practitioner for the person; and\n\n(b) a consulting medical practitioner for the person.\n\n(2) The written declaration must—\n\n(a) specify that the person—\n\n(i) makes the declaration voluntarily and without coercion; and\n\n(ii) understands the nature and the effect of the declaration the person is making; and\n\n(b) be signed by the person making the declaration in the presence of 2 witnesses and the co-ordinating medical practitioner.\n\n(3) Despite subsection (2)(b), a person may sign a written declaration at the direction of the person making the declaration if—\n\n(a) the person making the declaration is unable to sign the declaration; and\n\n(b) the person signing—\n\n(i) is aged 18 years or more; and\n\n(ii) is not a witness to the signing of the declaration.\n\n(4) A person who signs a written declaration on behalf of the person making the declaration must do so in that person's presence.\n\n(5) If a person makes a written declaration with the assistance of an interpreter, the interpreter must certify on the declaration that the interpreter provided a true and correct translation of any material translated.\n\nInterpreters who assist in relation to requesting access to or accessing voluntary assisted dying must meet certain requirements—see section 115.\n\n","sortOrder":42},{"sectionNumber":"35","sectionType":"section","heading":"Witness to making of written declaration","content":"\t35 Witness to making of written declaration\n\n(1) A person is eligible to witness the making of a written declaration if the person is—\n\n(a) aged 18 years or more; and\n\n(b) not an ineligible witness.\n\n(2) A person is an ***ineligible witness*** for the purposes of a written declaration if the person—\n\n(a) knows or believes that the person—\n\n(i) is a beneficiary under a will of the person making the declaration; or\n\n(ii) may otherwise benefit financially or in any other material way from the death of the person making the declaration; or\n\n(b) is an owner of, or is responsible for the day‑to-day operation of,  any health facility at which—\n\n(i) the person making the declaration is being treated; and\n\n(b) state that the witness is not knowingly an ineligible witness.\n\n(2) A witness who witnesses another person signing a written declaration on behalf of the person making it must—\n\n(a) certify in writing in the declaration—\n\n(i) that, in the presence of the witness, the person making the declaration appeared to freely and voluntarily direct the other person to sign the declaration; and\n\n(ii) that the other person signed the declaration in the presence of the person making the declaration and the witness; and\n\n(iii) that, at the time the other person signed the declaration, the person making it appeared to have decision-making capacity in relation to voluntary assisted dying; and\n\n(b) in any case, at least one day after the day on which the consulting assessment that assessed the person as eligible for access to voluntary assisted dying was completed.\n\n(2) Subsection (1)(a) does not apply if the co‑ordinating medical practitioner for the person considers that the person's death is likely to occur before the expiry of the time period specified in that subsection, and this is consistent with the prognosis of the consulting medical practitioner for the person set out in the consulting assessment report form.\n\n","sortOrder":47},{"sectionNumber":"39","sectionType":"section","heading":"Contact person","content":"\t39 Contact person\n\n(1) A person must, after making a final request, appoint a person who is aged 18 years or more as the contact person in respect of the person.\n\n(2) The contact person must return to a pharmacist at the dispensing pharmacy any unused or remaining voluntary assisted dying substance dispensed to the person making the final request either—\n\n(a) if the person dies and the contact person knows that any voluntary assisted dying substance is unused or remaining after the death, within 15 days after the date of death; or\n\n(b) if the person decides to make a request under section 53 for practitioner administration or decides not to self‑administer, at the person's request.\n\n(3) The Board may contact the contact person to request information.\n\n","sortOrder":48},{"sectionNumber":"40","sectionType":"section","heading":"Formal requirements for appointment of contact person","content":"\t40 Formal requirements for appointment of contact person\n\n(1) A person cannot be appointed as the contact person unless the person accepts the appointment.\n\n(2) An appointment of the contact person must—\n\n(a) be made in a contact person appointment form; and\n\n(b) in the presence of another person who is aged 18 years or more, be signed by—\n\n(i) the person making the appointment; and\n\n(ii) the person being appointed.\n\n(3) Despite subsection (2)(b)(i), a person may sign a contact person appointment form at the direction of the person making the appointment if—\n\n(a) the person making the appointment is unable to sign the form; and\n\n(ii) is of a sufficient dose to cause death; and\n\n(b) the person to obtain, possess, store, use and self-administer the voluntary assisted dying substance; and\n\n(c) in the case of the death of the person, within 15 days after the date of the person's death, the contact person specified in the permit—\n\n(i) to possess and store the unused or remaining voluntary assisted dying substance (if any) for the purpose of returning it to a pharmacist at the dispensing pharmacy; and\n\n(ii) to carry and transport the unused or remaining voluntary assisted dying substance to a pharmacist at the dispensing pharmacy; and\n\n(d) in the case that the person decides to make a request under section 53 or decides not to self-administer, or in the case of an order made by VCAT to return the voluntary assisted dying substance to the dispensing pharmacy, a contact person specified in the permit—\n\n(i) to possess and store the voluntary assisted dying substance (if any) that has been dispensed to the person; and\n\n(ii) to carry and transport the voluntary assisted dying substance to a pharmacist at the dispensing pharmacy.\n\n","sortOrder":52},{"sectionNumber":"46","sectionType":"section","heading":"What is authorised by practitioner administration permit?","content":"\t46 What is authorised by practitioner administration permit?\n\nA practitioner administration permit in respect of a person specified in the permit authorises the co-ordinating medical practitioner for the person, for the purpose of causing the person's death—\n\n(a) to prescribe and supply to the person a sufficient dose of the voluntary assisted dying substance specified in the permit; and\n\n(b) in the presence of a witness receive an administration request; and\n\n(c) to possess, use, and administer in the presence of a witness, the voluntary assisted dying substance to the person if—\n\n(i) the person is physically incapable of the self-administration or digestion of the voluntary assisted dying substance; and\n\n(ii) the person at the time of making the administration request has decision-making capacity in relation to voluntary assisted dying; and\n\n(iii) the person in requesting access to voluntary assisted dying is acting voluntarily and without coercion; and\n\n(iv) the person's request to access voluntary assisted dying is enduring; and\n\n(v) the person is administered the voluntary assisted dying substance immediately after making the administration request.\n\nDivision 2—Voluntary assisted dying permits\n\n","sortOrder":53},{"sectionNumber":"47","sectionType":"section","heading":"Application for self-administration permit","content":"\t47 Application for self-administration permit\n\n(1) Subject to subsection (3), the co-ordinating medical practitioner for a person may apply to the Secretary for a self-administration permit in respect of the person if the person is physically able to self-administer and digest the poison or controlled substance or the drug of dependence proposed to be specified in the permit for the purpose of causing the person's death.\n\n(2) An application for a self-administration permit must—\n\n(a) be in the prescribed form; and\n\n(b) identify the person in respect of whom the permit is sought; and\n\n(c) specify the poison or controlled substance or the drug of dependence the applicant seeks to prescribe or supply in a sufficient dose to the person, for the purpose of self-administration to cause the person's death; and\n\n(d) specify the contact person in respect of the person; and\n\n(e) be accompanied by a copy of the completed final review form and all forms referred to in section 41(1)(a); and\n\n(f) be accompanied by a statement that the applicant is satisfied of the matters specified in subsection (3).\n\n(3) The co-ordinating medical practitioner must not apply for a self-administration permit unless the co-ordinating medical practitioner is satisfied that—\n\n(a) the person has decision-making capacity in relation to voluntary assisted dying; and\n\n(b) the person's request for access to voluntary assisted dying is enduring.\n\n","sortOrder":54},{"sectionNumber":"48","sectionType":"section","heading":"Application for practitioner administration permit","content":"\t48 Application for practitioner administration permit\n\n(1) Subject to subsection (3), the co-ordinating medical practitioner for a person may apply to the Secretary for a practitioner administration permit in respect of the person, if the person is to be supplied and administered the poison or controlled substance or the drug of dependence proposed to be specified in the permit by the co‑ordinating medical practitioner for the purpose of causing the person's death.\n\n(2) An application for a practitioner administration permit must—\n\n(a) be in the prescribed form; and\n\n(b) identify the person in respect of whom the permit is sought; and\n\n(c) specify the poison or controlled substance or the drug of dependence the applicant seeks to prescribe, supply and administer to the person in a sufficient dose to cause the person's death; and\n\n(d) specify the contact person in respect of the person; and\n\n(e) be accompanied by a copy of the completed final review form and all forms referred to in section 41(1)(a); and\n\n(f) be accompanied by a statement that the applicant is satisfied of the matters specified in subsection (3); and\n\n(g) if the person in respect of whom the permit is sought was the subject of a self‑administration permit cancelled under section 52, be accompanied by evidence to the satisfaction of the Secretary—\n\n(i) that any prescription under that self‑administration permit which was not filled has been destroyed by the applicant; or\n\n(ii) that any voluntary assisted dying substance supplied under that self‑administration permit has been disposed of by a pharmacist at the dispensing pharmacy.\n\n(3) The co-ordinating medical practitioner must not apply for a practitioner administration permit unless the co-ordinating medical practitioner is satisfied that—\n\n(a) the person is physically incapable of the self‑administration or digestion of an appropriate poison or controlled substance or drug of dependence; and\n\n(b) the person has decision-making capacity in relation to voluntary assisted dying; and\n\n(c) the person's request for access to voluntary assisted dying is enduring.\n\n","sortOrder":55},{"sectionNumber":"49","sectionType":"section","heading":"Secretary to determine application for a voluntary assisted dying permit","content":"\t49 Secretary to determine application for a voluntary assisted dying permit\n\n(1) The Secretary must determine an application for a voluntary assisted dying permit made under section 47 or 48 by the co-ordinating medical practitioner for a person within the prescribed period.\n\n(2) The Secretary—\n\n(a) may issue—\n\n(i) a self-administration permit; or\n\n(ii) a practitioner administration permit; or\n\n(b) may refuse to issue a voluntary assisted dying permit.\n\n(3) Without limiting subsection (2), the Secretary may refuse to issue a voluntary assisted dying permit if the Secretary is not satisfied the request and assessment process has been completed as required by this Act.\n\n(4) After determining the application the Secretary must—\n\n(a) as soon as practicable—\n\n(i) notify the co-ordinating medical practitioner in writing of the decision under subsection (2); and\n\n(ii) if the Secretary refuses an application under subsection (2)(b), provide reasons for the decision; and\n\n(b) within 7 days notify the Board in writing of the decision under subsection (2).\n\n(5) A voluntary assisted dying permit must be in the prescribed form.\n\n","sortOrder":56},{"sectionNumber":"50","sectionType":"section","heading":"Operation of voluntary assisted dying permit","content":"\t50 Operation of voluntary assisted dying permit\n\nA voluntary assisted dying permit comes into force on the day specified in the permit.\n\n","sortOrder":57},{"sectionNumber":"51","sectionType":"section","heading":"Secretary may amend voluntary assisted dying permit","content":"\t51 Secretary may amend voluntary assisted dying permit\n\n(1) The Secretary may amend a voluntary assisted dying permit if satisfied that the permit contains an administrative error or a minor defect.\n\n(2) The Secretary may exercise a power under subsection (1)—\n\n(a) on the request of the relevant  \nco-ordinating medical practitioner; and\n\n(b) that the person is not under any obligation to obtain the voluntary assisted dying substance and may at any time return an unfilled prescription to the co-ordinating medical practitioner; and\n\n(c) that the voluntary assisted dying substance must be stored in a locked box that satisfies the prescribed specifications; and\n\n(d) that the person is not under any obligation to self-administer the voluntary assisted dying substance; and\n\n(e) that any unfilled prescription must be returned to the co-ordinating medical practitioner for destruction on the making of a request under section 53; and\n\n(f) that the person or the relevant contact person must return to a pharmacist at the dispensing pharmacy for disposal any dispensed voluntary assisted dying substance—\n\n(i) that the person decides not to self‑administer; or\n\n(ii) that the person does not  \nself-administer before making  \na request under section 53; and\n\n(g) that the relevant contact person must return to a pharmacist at the dispensing pharmacy for disposal any dispensed voluntary assisted dying substance that is not self-administered after the person dies.\n\n","sortOrder":63},{"sectionNumber":"58","sectionType":"section","heading":"Information to be given by pharmacist dispensing a prescribed voluntary assisted dying substance","content":"\t58 Information to be given by pharmacist dispensing a prescribed voluntary assisted dying substance\n\nA pharmacist must, on dispensing a prescription for a voluntary assisted dying substance, inform the person to whom the voluntary assisted dying substance is being dispensed—\n\n(a) how to self-administer the voluntary assisted dying substance; and\n\n(b) that the voluntary assisted dying substance must be stored in a locked box that satisfies the prescribed specifications; and\n\n(c) that the person is not under any obligation to self-administer the voluntary assisted dying substance; and\n\n(d) that the person or the relevant contact person must return to a pharmacist at the dispensing pharmacy for disposal any dispensed voluntary assisted dying substance—\n\n(i) that the person decides not to self‑administer; or\n\n(ii) that the person does not  \nself-administer before making  \na request under section 53; and\n\n(e) that the relevant contact person must return to a pharmacist at the dispensing pharmacy for disposal any dispensed voluntary assisted dying substance that is not self-administered after the person dies.\n\n","sortOrder":64},{"sectionNumber":"59","sectionType":"section","heading":"Labelling requirements for voluntary assisted dying substance","content":"\t59 Labelling requirements for voluntary assisted dying substance\n\n(1) In addition to any labelling requirements of the Poisons Code or under the **Drugs, Poisons and Controlled Substances Act 1981**, a pharmacist who supplies a voluntary assisted dying substance must attach a labelling statement in writing to the relevant package or container that—\n\n(a) warns of the purpose of the dose of the voluntary assisted dying substance; and\n\n(b) states the dangers of self-administering the voluntary assisted dying substance; and\n\n(c) states that the voluntary assisted dying substance must be stored in a locked box that satisfies the prescribed specifications; and\n\n(d) states that any unused or remaining voluntary assisted dying substance must be returned by the person to whom it was dispensed or the relevant contact person to a pharmacist at the dispensing pharmacy.\n\n(2) A labelling statement must be in the prescribed form.\n\n","sortOrder":65},{"sectionNumber":"60","sectionType":"section","heading":"Pharmacist to record and notify of voluntary assisted dying substance dispensed","content":"\t60 Pharmacist to record and notify of voluntary assisted dying substance dispensed\n\n(1) A pharmacist who dispenses a voluntary assisted dying substance must immediately record in a voluntary assisted dying substance dispensing form—\n\n(a) that the voluntary assisted dying substance was dispensed; and\n\n(b) that the requirements under sections 58 and 59 were satisfied.\n\n(2) The pharmacist must within 7 days after dispensing the voluntary assisted dying substance give a copy of the completed voluntary assisted dying substance dispensing form to the Board.\n\n","sortOrder":66},{"sectionNumber":"61","sectionType":"section","heading":"Secure storage of voluntary assisted dying substance","content":"\t61 Secure storage of voluntary assisted dying substance\n\nThe person in respect of whom a voluntary assisted dying substance has been dispensed must store the substance in a locked box that satisfies the prescribed specifications.\n\n","sortOrder":67},{"sectionNumber":"62","sectionType":"section","heading":"Pharmacist at dispensing pharmacy to dispose of returned voluntary assisted dying substance","content":"\t62 Pharmacist at dispensing pharmacy to dispose of returned voluntary assisted dying substance\n\nIf a person who is the subject of a self‑administration permit or the contact person specified in the permit returns any of the dispensed voluntary assisted dying substance to a pharmacist at the dispensing pharmacy, the pharmacist must as soon as practicable dispose of it.\n\n","sortOrder":68},{"sectionNumber":"63","sectionType":"section","heading":"Pharmacist at dispensing pharmacy to record and notify of disposal of returned voluntary assisted dying substance","content":"\t63 Pharmacist at dispensing pharmacy to record and notify of disposal of returned voluntary assisted dying substance\n\n(1) A pharmacist at the dispensing pharmacy who disposes of a voluntary assisted dying substance under section 62 must immediately record that disposal in a voluntary assisted dying substance disposal form.\n\n(2) The pharmacist must within 7 days after disposing of the voluntary assisted dying substance give a copy of the completed voluntary assisted dying substance disposal form to the Board.\n\nDivision 2—Administration request and administration of voluntary assisted dying substance\n\n","sortOrder":69},{"sectionNumber":"64","sectionType":"section","heading":"Person may make administration request","content":"\t64 Person may make administration request\n\n(1) A person may make an administration request, to the co-ordinating medical practitioner for the person, that the co-ordinating medical practitioner administer to the person the voluntary assisted dying substance specified in a practitioner administration permit, if—\n\n(a) the person is the subject of the permit; and\n\n(b) the person has decision-making capacity in relation to voluntary assisted dying; and\n\n(c) the person's request to access voluntary assisted dying is enduring; and\n\n(d) the person understands that the voluntary assisted dying substance is to be administered immediately after the making of the administration request.\n\n(2) The person must make the request personally.\n\n(3) The person may make the request verbally or by gesture or other means of communication available to the person.\n\n(4) An administration request must be made in the presence of a witness.\n\n(5) The co-ordinating medical practitioner must refuse to accept the person's administration request if the co-ordinating medical practitioner is not satisfied of any matter under subsection (1).\n\n","sortOrder":70},{"sectionNumber":"65","sectionType":"section","heading":"Witness to administration request and administration of voluntary assisted dying substance","content":"\t65 Witness to administration request and administration of voluntary assisted dying substance\n\n(1) For the purposes of section 46(b) and (c) and section 64(4), a witness to the making of an administration request and the administration of the voluntary assisted dying substance must be—\n\n(a) aged 18 years or more; and\n\n(b) independent of the co-ordinating medical practitioner for the person to whom the voluntary assisted dying substance is to be administered.\n\n(2) The witness who witnesses a person making an administration request and who witnesses the administration of the voluntary assisted dying substance must, in a co-ordinating medical practitioner administration form—\n\n(a) certify in writing that—\n\n(i) the person at the time of making the administration request appeared to have decision-making capacity in relation to voluntary assisted dying; and\n\n(ii) the person in requesting access to voluntary assisted dying appeared to be acting voluntarily and without coercion; and\n\n(iii) the person's request to access voluntary assisted dying appeared to be enduring; and\n\n(b) state that the co-ordinating medical practitioner administered the voluntary assisted dying substance to the person.\n\n","sortOrder":71},{"sectionNumber":"66","sectionType":"section","heading":"Certification by co-ordinating medical practitioner following administration of voluntary assisted dying substance","content":"\t66 Certification by co-ordinating medical practitioner following administration of voluntary assisted dying substance\n\n(1) The co-ordinating medical practitioner for a person who has administered the voluntary assisted dying substance to the person must, in the same co-ordinating medical practitioner administration form completed by the relevant witness, certify in writing that the practitioner is satisfied—\n\n(a) the person was physically incapable of the self-administration or digestion of the voluntary assisted dying substance; and\n\n(b) the person at the time of making the administration request had decision-making capacity in relation to voluntary assisted dying; and\n\n(c) the person in requesting access to voluntary assisted dying acted voluntarily and without coercion; and\n\n(d) the person's request to access voluntary assisted dying was enduring.\n\n(2) The co-ordinating medical practitioner must within 7 days after administering a voluntary assisted dying substance to a person under a practitioner administration permit give the Board a copy of the co-ordinating medical practitioner administration form completed under subsection (1).\n\nDivision 3—Notification of cause of death\n\n","sortOrder":72},{"sectionNumber":"67","sectionType":"section","heading":"Notification of disease, illness or medical condition of person to the Registrar and Coroner","content":"\t67 Notification of disease, illness or medical condition of person to the Registrar and Coroner\n\n(1) In addition to section 37(1) of the **Births, Deaths and Marriages Registration Act 1996**, a registered medical practitioner who was responsible for a person's medical care immediately before death, or who examines the body of a deceased person after death and reasonably believes or knows the person was the subject of a voluntary assisted dying permit must notify the Registrar of—\n\n(a) the registered medical practitioner's reasonable belief or knowledge that the person—\n\n(i) was the subject of a voluntary assisted dying permit and the voluntary assisted dying substance specified in the permit was not self-administered by the person or administered to the person; or\n\n(ii) was the subject of a self-administration permit and accessed voluntary assisted dying by self-administering the voluntary assisted dying substance specified in the permit; or\n\n(iii) was the subject of a practitioner administration permit and accessed voluntary assisted dying by being administered the voluntary assisted dying substance specified in the permit; and\n\n(b) the disease, illness or medical condition that was the grounds for the person to access voluntary assisted dying.\n\n(2) A registered medical practitioner who was responsible for a person's medical care immediately before death, or who examines the body of a deceased person after death and reasonably believes or knows the person was the subject of a voluntary assisted dying permit must notify the Coroner of—\n\n(a) the registered medical practitioner's reasonable belief or knowledge that the person—\n\n(i) was the subject of a voluntary assisted dying permit and the voluntary assisted dying substance specified in the permit was not self-administered by the person or administered to the person; or\n\n(ii) was the subject of a self-administration permit and accessed voluntary assisted dying by self-administering the voluntary assisted dying substance specified in the permit; or\n\n(iii) was the subject of a practitioner administration permit and accessed voluntary assisted dying by being administered the voluntary assisted dying substance specified in the permit; and\n\n(b) the disease, illness or medical condition that was the grounds for the person to access voluntary assisted dying.\n\n","sortOrder":73},{"sectionNumber":"Part 6","sectionType":"part","heading":"Review by VCAT","content":"Part 6—Review by VCAT\n\n","sortOrder":74},{"sectionNumber":"68","sectionType":"section","heading":"Application for review of certain decisions by VCAT","content":"\t68 Application for review of certain decisions by VCAT\n\n(1) An eligible applicant may apply to VCAT for review of the following decisions—\n\n(a) a decision of the co-ordinating medical practitioner for a person in a first assessment that the person—\n\n(i) is or is not ordinarily resident in Victoria; or\n\n(ii) was or was not ordinarily resident in Victoria for at least 12 months at the time of making a first request; or\n\n(iii) has or does not have decision-making capacity in relation to voluntary assisted dying;\n\n(b) a decision of a consulting medical practitioner for a person in a consulting assessment that the person—\n\n(i) is or is not ordinarily resident in Victoria; or\n\n(ii) was or was not ordinarily resident in Victoria for at least 12 months at the time of making a first request; or\n\n(iii) has or does not have decision-making capacity in relation to voluntary assisted dying;\n\n(c) a decision of the co-ordinating medical practitioner for a person under section 47(3)(a) or 48(3)(b) that the person has or does not have decision-making capacity in relation to voluntary assisted dying;\n\n(d) a decision under section 64(5) that the person has or does not have decision-making capacity in relation to voluntary assisted dying.\n\n***eligible applicant*** means—\n\n(a) a person who is the subject of a decision referred to in subsection (1); or\n\n(b) an agent of a person referred to in paragraph (a); or\n\n(c) any other person who VCAT is satisfied has a special interest in the medical treatment and care of the person referred to in paragraph (a).\n\n(3) For the purposes of section 59(1)(b)(iv) of the **Victorian Civil and Administrative Tribunal Act 1998**, if an application is made for review of a decision referred to in subsection (1), the person who is the subject of the decision is a party to a proceeding for review of the decision, whether or not the person was the applicant for the review.\n\n","sortOrder":75},{"sectionNumber":"69","sectionType":"section","heading":"Notice requirements","content":"\t69 Notice requirements\n\nIf an application under section 68(1) is made for review of a decision in respect of a person, the principal registrar of VCAT must give notice of the application and any order or determination (however described) of VCAT in respect of the application to—\n\n(a) the co-ordinating medical practitioner for the person; and\n\n(b) the co-ordinating medical practitioner for the person must not apply for a voluntary assisted dying permit for the person while the application is in existence; and\n\n(c) any application for a voluntary assisted dying permit,  for the person is suspended for the period during which the application is in existence; and\n\n(b) VCAT determines that the person had decision-making capacity.\n\n(2) A consulting medical practitioner for a person may refuse to resume any consulting assessment that was not completed in relation to the person before the application was made if—\n\n(a) an application under section 68(1) was made for review of a decision of the consulting medical practitioner that the person did not have decision-making capacity in relation to voluntary assisted dying; and\n\n(b) VCAT determines that the person had decision-making capacity.\n\n(3) A co-ordinating medical practitioner who refuses under subsection (1) to continue to perform the role of co-ordinating medical practitioner must transfer the role of co-ordinating medical practitioner in accordance with section 33.\n\n(4) If a consulting medical practitioner refuses under subsection (2) to resume a consulting assessment, the co-ordinating medical practitioner for the person may refer the person to another registered medical practitioner for a further consulting assessment.\n\n","sortOrder":80},{"sectionNumber":"74","sectionType":"section","heading":"Interim and temporary orders","content":"\t74 Interim and temporary orders\n\nIn an application under this Act, VCAT may make any interim orders or temporary orders that it considers necessary.\n\nPart 7—Notifications and protections from liability\n\nDivision 1—Notifications to Australian Health Practitioner Regulation Agency\n\n\t75 Mandatory notification by registered health practitioner\n\n(1) A registered health practitioner (the ***first health practitioner***) must notify the Australian Health Practitioner Regulation Agency as soon as practicable after forming a belief on reasonable grounds that another registered health practitioner (the ***second health practitioner***)—\n\n(i) in the course of providing those services to the person, initiating a discussion or attempting to initiate a discussion with that person that is in substance about voluntary assisted dying that is not, or would not be, in accordance with this Act; and\n\n(b) no liability for defamation is incurred by the person because of the making of the notification or the giving of the information.\n\nDivision 2—Protection from liability for those who assist, facilitate, do not act or act in accordance with this Act\n\n","sortOrder":84},{"sectionNumber":"79","sectionType":"section","heading":"Protection from criminal liability of person who assists or facilitates request for or access to voluntary assisted dying","content":"\t79 Protection from criminal liability of person who assists or facilitates request for or access to voluntary assisted dying\n\nA person who in good faith does something or fails to do something—\n\n(a) that assists or facilitates any other person who the person believes on reasonable grounds is requesting access to or is accessing voluntary assisted dying in accordance with this Act; and\n\n(b) that apart from this section, would constitute an offence at common law or under any other enactment—\n\ndoes not commit the offence.\n\n\t80 No liability for registered health practitioner who acts in accordance with this Act\n\nA registered health practitioner who, in good faith and without negligence, acts under this Act believing on reasonable grounds that the act is in accordance with this Act is not in respect of that act—\n\n(a) guilty of an offence; or\n\n(b) liable for unprofessional conduct or professional misconduct; or\n\n(c) liable in any civil proceeding; or\n\n(d) liable for contravention of any code of conduct.\n\n\t81 No liability for registered health practitioner or ambulance paramedic present after person administered voluntary assisted dying substance\n\n(1) A registered health practitioner or an ambulance paramedic who, in good faith, does not administer life saving or life sustaining medical treatment to a person who has not requested it, and believes on reasonable grounds that the person is dying after being administered or self-administering a voluntary assisted dying substance in accordance with this Act, is not, in respect of that omission to act—\n\n(a) guilty of an offence; or\n\n(b) liable for unprofessional conduct or professional misconduct; or\n\n(c) liable in any civil proceeding; or\n\n(d) liable for contravention of any code of conduct.\n\n(2) This section does not prevent a registered health practitioner or an ambulance paramedic from providing medical treatment for the purpose of ensuring the person's comfort.\n\n(3) In this section—\n\n***ambulance paramedic*** means a person employed or engaged by an ambulance service, within the meaning of the **Ambulance Services Act 1986**—\n\n(a) as an ambulance paramedic or intensive care paramedic; or\n\n(d) a contact person appointment form; or\n\n(e) a final review form; or\n\n(f) an application for a self-administration permit under section 47; or\n\n(g) an application for a practitioner administration permit under section 48; or\n\n(h) a statement made under section 47(2)(f); or\n\n(i) a statement made under section 48(2)(f); or\n\n(j) a voluntary assisted dying substance dispensing form; or\n\n(k) a voluntary assisted dying substance disposal form; or\n\n(d) a voluntary assisted dying substance dispensing form; or\n\n(e) a voluntary assisted dying substance disposal form; or\n\n(f) a co-ordinating medical practitioner administration form.\n\n","sortOrder":94},{"sectionNumber":"91","sectionType":"section","heading":"Criminal liability of officers of body corporate—failure to exercise due diligence","content":"\t91 Criminal liability of officers of body corporate—failure to exercise due diligence\n\n(1) If a body corporate commits an offence against a provision specified in subsection (2), an officer of the body corporate also commits an offence against the provision if the officer failed to exercise due diligence to prevent the commission of the offence by the body corporate.\n\n(2) For the purposes of subsection (1), the following provisions are specified—\n\n(a) section 85;\n\n(b) section 86;\n\n(c) section 87;\n\n(d) section 88;\n\n(e) section 90.\n\n(3) In determining whether an officer of a body corporate failed to exercise due diligence, a court may have regard to—\n\n(a) what the officer knew, or ought reasonably to have known, about the commission of the offence by the body corporate; and\n\n(b) whether or not the officer was in a position to influence the body corporate in relation to the commission of the offence by the body corporate; and\n\n(c) what steps the officer took, or could reasonably have taken, to prevent the commission of the offence by the body corporate; and\n\n(d) any other relevant matter.\n\n(4) Without limiting any other defence available to the officer, an officer of a body corporate may rely on a defence that would be available to the body corporate if it were charged with the offence with which the officer is charged and, in doing so, the officer bears the same burden of proof that the body corporate would bear.\n\n(5) An officer of a body corporate may commit an offence against a provision specified in subsection (2) whether or not the body corporate has been prosecuted for, or found guilty of, an offence against that provision.\n\n(6) In this section—\n\n***body corporate*** has the same meaning as corporation has in section 57A of the Corporations Act;\n\n***officer*** in relation to a body corporate means—\n\n(a) a person who is an officer (as defined by section 9 of the Corporations Act) of the body corporate; or\n\n(b) a person (other than a person referred to in paragraph (a)), by whatever name called, who is concerned in, or takes part in, the management of the body corporate.\n\nPart 9—Voluntary Assisted Dying Review Board\n\nDivision 1—Establishment\n\n\t92 Establishment of Voluntary Assisted Dying Review Board\n\nThe Voluntary Assisted Dying Review Board is established.\n\nDivision 2—Functions and powers\n\n","sortOrder":95},{"sectionNumber":"93","sectionType":"section","heading":"Functions and powers of the Board","content":"\t93 Functions and powers of the Board\n\n(1) The Board has the following functions—\n\n(a) to monitor matters related to voluntary assisted dying;\n\n(b) to review the exercise of any function or power under this Act;\n\n(c) to provide reports to each House of the Parliament on the operation of this Act and any recommendations for the improvement of voluntary assisted dying;\n\n(d) to promote compliance with the requirements of this Act by the provision of information in respect of voluntary assisted dying to registered health practitioners and members of the community;\n\n(e) to refer any issue identified by the Board in relation to voluntary assisted dying that is relevant to the following persons or bodies—\n\n(i) the Chief Commissioner of Police;\n\n(ii) the Registrar;\n\n(iii) the Secretary;\n\n(iv) the State Coroner;\n\n(v) the Australian Health Practitioner Regulation Agency;\n\n(f) to promote continuous improvement in the quality and safety of voluntary assisted dying to those who exercise any function or power under this Act;\n\n(g) to conduct analysis of, and carry out research in relation to, information or forms given to the Board in accordance with this Act;\n\n(h) to provide information about voluntary assisted dying, and other matters identified by the Board in the performance of a function under this Act;\n\n(i) to collect, use and disclose forms and information provided in accordance with this Act for the purposes of carrying out a function of the Board;\n\n(j) to consult and engage with any of the following persons and groups in relation to voluntary assisted dying—\n\n(i) the Victorian community;\n\n(ii) relevant groups or organisations;\n\n(iii) government departments and agencies;\n\n(iv) registered health practitioners who provide voluntary assisted dying services;\n\n(k) to provide advice to the Minister or the Secretary in relation to the operation of this Act;\n\n(l) to provide reports to the Minister or the Secretary, in respect of any matter relevant to the functions of the Board as requested.\n\n(2) The Board has all the powers that are necessary or convenient to perform its functions under this Act.\n\nDivision 3—Membership and procedure\n\n","sortOrder":96},{"sectionNumber":"94","sectionType":"section","heading":"Membership of the Board","content":"\t94 Membership of the Board\n\n(1) The Board consists of—\n\n(a) the Chairperson; and\n\n(b) any person as the Board determines.\n\n(3) The subcommittee must report to the Board as required by the Board.\n\nDivision 4—Request for information, referral of identifying information held by the Board and notifications\n\n","sortOrder":105},{"sectionNumber":"103","sectionType":"section","heading":"Request for information by the Board","content":"\t103 Request for information by the Board\n\nThe Board may request that any person (including a contact person) give information to the Board to assist the Board in carrying out any of the Board's functions.\n\n","sortOrder":106},{"sectionNumber":"104","sectionType":"section","heading":"Referral of identifying information to others","content":"\t104 Referral of identifying information to others\n\n(1) Subject to subsection (2), the Board may use and disclose any identifying information obtained as a result of the Board performing a function or exercising a power of the Board for the purpose of referring a matter to the following—\n\n(a) the Chief Commissioner of Police;\n\n(b) the Registrar;\n\n(c) the Secretary;\n\n(d) the State Coroner;\n\n(e) the Australian Health Practitioner Regulation Agency.\n\n(2) The Board must not refer a matter under subsection (1) unless the Board reasonably believes the identifying information discloses a matter that is relevant to the functions and powers of that person or body.\n\n","sortOrder":107},{"sectionNumber":"105","sectionType":"section","heading":"Board to notify registered medical practitioner, pharmacist or Secretary on receipt of certain forms","content":"\t105 Board to notify registered medical practitioner, pharmacist or Secretary on receipt of certain forms\n\n(1) The Board must as soon as practicable after receiving a copy of any of the following forms from a registered medical practitioner or a pharmacist (as the case requires), notify the registered medical practitioner or the pharmacist that the copy has been received—\n\n(a) a first assessment report form;\n\n(b) a consulting assessment report form;\n\n(c) a final review form;\n\n(d) a voluntary assisted dying substance dispensing form;\n\n(e) a voluntary assisted dying substance disposal form;\n\n(f) a co-ordinating medical practitioner administration form.\n\n(2) The Board must as soon as practicable after receiving a copy of a completed voluntary assisted dying substance disposal form give a copy of that form to the Secretary.\n\n","sortOrder":108},{"sectionNumber":"106","sectionType":"section","heading":"Board to provide information to the contact person after the notification of the person's death","content":"\t106 Board to provide information to the contact person after the notification of the person's death\n\nThe Board must within 7 days of being notified by the Registrar of the registration of a person's death in accordance with section 40A of the **Births, Deaths and Marriages Registration Act 1996** provide information to the contact person for the person that—\n\n(a) sets out the requirement under section 45(c) to return any unused or remaining voluntary assisted dying substance to a pharmacist at the dispensing pharmacy;
