Here's what it does:\n\n**The Big Picture**\nUnder Australia's Constitution, the Commonwealth can only make laws on certain topics. Education is primarily a State responsibility. However, section 51(xxxvii) of the Constitution lets States \"refer\" (hand over) their law-making powers to the Commonwealth. This Act does exactly that for vocational education and training.\n\n**What Gets Handed Over**\nThe Act \"adopts\" two Commonwealth laws (the National VET Regulator Act 2011 and its transitional provisions) and \"refers\" specific matters to the Commonwealth Parliament, including:\n- Registering and regulating VET organisations (like TAFEs and private colleges)\n- Accrediting VET courses and programs\n- Issuing and cancelling VET qualifications\n- Setting standards for VET regulators\n- Collecting and sharing information about VET\n- Investigation and enforcement powers\n\n**Important Limits**\nThe State keeps control over:\n- Primary and secondary schooling\n- University-level higher education\n- Apprenticeships and traineeships\n- Occupational licensing for non-VET businesses\n- State funding for VET\n- State-run VET agencies (like TAFE Queensland)\n\n**The Escape Hatch**\nThe State can pull out of this arrangement. The Governor can issue a proclamation to terminate the referral, though there's a 6-month cooling-off period. The State can also revoke a termination notice before it takes effect.\n\n**Why This Matters**\nThis creates a national system for regulating vocational education while letting States keep control of funding and their own training providers.
