and\n\n(b) promotes uniformity with other jurisdictions in the management and prevention of vexatious behaviour.\n\n","sortOrder":1},{"sectionNumber":"2","sectionType":"section","heading":"Commencement","content":"\t2 Commencement\n\n(1) Subject to subsection (2), this Act comes into operation on a day or days to be proclaimed.\n\n(2) If a provision of this Act does not come into operation before 31 October 2014, it comes into operation on that day.\n\n","sortOrder":2},{"sectionNumber":"3","sectionType":"section","heading":"Definitions","content":"\t3 Definitions\n\nIn this Act—\n\n***acting in concert*** has the meaning given by section 4;\n\n***acting in concert order*** means an order made—\n\n(a) by the Supreme Court, the County Court, the Magistrates' Court or VCAT under section 35; or\n\n(b) in relation to intervention order legislation, by the Magistrates' Court or the Children's Court under section 36;\n\n***appeal restriction order*** means an order made—\n\n(a) by the Supreme Court under section 37; or\n\n(b) by the County Court, the Magistrates' Court or VCAT under section 38; or\n\n(c) in relation to intervention order legislation, by the Magistrates' Court or the Children's Court under section 39;\n\n***application for leave to proceed*** means—\n\n(a) an application under section 50 by a person subject to a limited litigation restraint order for leave to make or continue an interlocutory application in a proceeding; or\n\n(b) an application under section 52 by a person subject to an extended litigation restraint order for leave to commence or continue a proceeding; or\n\n(c) an application under section 54 by a person subject to a general litigation restraint order for leave to commence or continue a proceeding;\n\n***Australian court or tribunal*** means—\n\n(a) a Victorian court or tribunal; or\n\n(b) a court or tribunal of the Commonwealth or of another State or a Territory;\n\n***child*** means a person who is under the age of 18 years;\n\n***Court*** means the following courts—\n\n(a) the Supreme Court;\n\n(b) the County Court;\n\n(c) the Magistrates' Court;\n\n(d) in relation to an order under this Act that relates to intervention order legislation, the Children's Court;\n\n***extended litigation restraint order*** means an order made—\n\n(a) by the Supreme Court, the County Court, the Magistrates' Court or VCAT under section 17; or\n\n(b) in relation to intervention order legislation, by the Magistrates' Court or the Children's Court under section 19;\n\n***general litigation restraint order*** means an order made under section 29;\n\n***interlocutory application*** has the meaning given by section 5;\n\n***intervention order legislation*** means—\n\n(a) the **Crimes (Family Violence) Act 1987** as in force immediately before its repeal; and\n\n(b) the **Family Violence Protection Act 2008**; and\n\n(c) the **Personal Safety Intervention Orders Act 2010**; and\n\n(d) the **Stalking Intervention Orders Act 2008** as in force immediately before its repeal;\n\nS. 3 def. of *legal practitioner* amended by No. 38/2017 s. 95(1).\n\n***legal practitioner*** means an Australian legal practitioner;\n\n***limited litigation restraint order*** means an order made under section 11;\n\n***litigation restraint order*** means any of the following orders—\n\n(a) an extended litigation restraint order;\n\n(b) a general litigation restraint order;\n\n(c) a limited litigation restraint order;\n\n***parent***, of a child, includes—\n\n(a) a person who has responsibility for the long-term welfare of the child and has, in relation to the child, all the parental powers, rights and duties that are vested by law or custom in the guardian of a child; and\n\n(b) a person with whom the child normally or regularly resides;\n\n***proceeding*** means any matter in an Australian court or tribunal, whether civil or criminal, including—\n\n(a) any cause, matter, action, suit, proceeding, trial, complaint or inquiry of any kind within the jurisdiction of an Australian court or tribunal;\n\n(b) any proceeding (including any interlocutory application) taken in connection with or incidental to a proceeding before an Australian court or tribunal;\n\n(c) any appeal, review or other challenge, including an application for judicial review or an application for leave to appeal.\n\n***variation or revocation application prevention order*** means an order made—\n\n(a) by the Supreme Court, the County Court, the Magistrates' Court or VCAT under section 74(1); or\n\n(b) in relation to intervention order legislation, by the Magistrates' Court or the Children's Court under section 74(2);\n\n***vexatious application*** includes the following—\n\n(a) an interlocutory application that is an abuse of the process of a court or tribunal;\n\n(b) an interlocutory application made to harass or annoy, to cause delay or detriment, or for another wrongful purpose;\n\n(c) an interlocutory application made or pursued without reasonable ground;\n\n(d) an interlocutory application pursued in a way so as to harass or annoy, cause delay or detriment, or achieve another wrongful purpose;\n\n***vexatious proceeding*** includes the following—\n\n(a) a proceeding that is an abuse of the process of a court or tribunal;\n\n(b) a proceeding commenced to harass or annoy, to cause delay or detriment, or for another wrongful purpose;\n\n(c) a proceeding commenced or pursued without reasonable grounds;\n\n(d) a proceeding conducted in a way so as to harass or annoy, cause delay or detriment, or achieve another wrongful purpose;\n\n***vexatious proceeding order*** means any of the following orders made by an Australian court or tribunal—\n\n(a) an order that a proceeding be stayed or dismissed for being vexatious;\n\n(b) an order that a person commencing or conducting a proceeding is a vexatious litigant;\n\n(c) any other order that requires the person subject to the order to seek leave of an Australian court or tribunal before commencing or continuing a proceeding;\n\n***Victorian court or tribunal*** means any of the following—\n\n(a) the Supreme Court;\n\n(b) the County Court;\n\n(c) the Magistrates' Court;\n\n(d) the Children's Court;\n\n(e) VCAT;\n\n(f) VOCAT;\n\n***VOCAT*** means the Victims of Crime Assistance Tribunal established by the **Victims of Crime Assistance Act 1996**.\n\n","sortOrder":3},{"sectionNumber":"4","sectionType":"section","heading":"Meaning of *acting in concert*","content":"\t4 Meaning of *acting in concert*\n\n(1) Subject to subsection (2), in this Act, a person is ***acting in concert*** with another person if the first mentioned person is—\n\n(a) acting on behalf of the other person; or\n\n(b) acting for the predominant benefit of the other person; or\n\n(c) acting on the instructions of the other person; or\n\n(d) acting in collusion with the other person.\n\n(2) A person who makes an interlocutory application or commences and conducts a proceeding on behalf of a person is not acting in concert with that person if the first mentioned person is—\n\n(a) a legal practitioner acting for the person; or\n\n(b) a litigation guardian of the person; or\n\n(c) a professional advocate within the meaning of section 62(8) of the **Victorian Civil and Administrative Tribunal Act 1998**; or\n\n(d) any other person authorised or required by law to act on behalf of the person.\n\nPersons who may be authorised or required by law to act on behalf of a person include insurers conducting proceedings under a right of subrogation, administrators, guardians, liquidators, receivers and any other person who has a legal right or obligation to represent the person.\n\n","sortOrder":4},{"sectionNumber":"5","sectionType":"section","heading":"Meaning of *interlocutory application*","content":"\t5 Meaning of *interlocutory application*\n\n(1) In this Act, an ***interlocutory application*** means any process by which an interlocutory proceeding is commenced in an Australian court or tribunal, including a subpoena.\n\n(2) Despite subsection (1), the following are not interlocutory applications for the purposes of this Act—\n\n(a) an application under the **Family Violence Protection Act 2008** in respect of which a court makes—\n\n(i) an interim order under section 53 or 101 of that Act; or\n\n(ii) an interim extension order under section 107 of that Act; or\n\n(b) an application under the **Personal Safety Intervention Orders Act 2010** in respect of which a court makes—\n\n(i) an interim order under section 35 or 81 of that Act; or\n\n(ii) an interim extension order under section 84 of that Act.\n\n","sortOrder":5},{"sectionNumber":"6","sectionType":"section","heading":"Application of Act","content":"\t6 Application of Act\n\n(1) This Act applies to all civil proceedings and all criminal proceedings in a Victorian court or tribunal.\n\n(2) The powers conferred on a Victorian court or tribunal by this Act are additional to the powers of a Victorian court or tribunal to control its own proceedings.\n\n","sortOrder":6},{"sectionNumber":"7","sectionType":"section","heading":"Act prevails to extent of inconsistency","content":"\t7 Act prevails to extent of inconsistency\n\nSubject to section 8, to the extent of any inconsistency, this Act prevails over—\n\n(a) any statutory jurisdiction of a Victorian court or tribunal; or\n\n(b) any powers of a Victorian court or tribunal arising or derived from the common law; or\n\n(c) any powers of a Victorian court or tribunal arising or derived under any other Act (including any Commonwealth Act), rule of court, practice note or practice direction.\n\n","sortOrder":7},{"sectionNumber":"8","sectionType":"section","heading":"Act does not limit certain other jurisdictions","content":"\t8 Act does not limit certain other jurisdictions\n\nNothing in this Act limits—\n\n(a) in the case of the Supreme Court, the Court's inherent jurisdiction or implied jurisdiction; or\n\n(b) in the case of a Court other than the Supreme Court, the Court's implied jurisdiction.\n\nS. 9 amended by No. 38/2017 s. 95(2).\n\n","sortOrder":8},{"sectionNumber":"9","sectionType":"section","heading":"Constitution of VCAT","content":"\t9 Constitution of VCAT\n\nWhen exercising a power under this Act, VCAT must be constituted by a member who is an Australian lawyer.\n\n","sortOrder":9},{"sectionNumber":"Part 2","sectionType":"part","heading":"Limited litigation restraint orders","content":"Part 2—Limited litigation restraint orders\n\n","sortOrder":10},{"sectionNumber":"10","sectionType":"section","heading":"Applying for limited litigation restraint order","content":"\t10 Applying for limited litigation restraint order\n\n(1) Subject to subsection (2), any of the following persons may apply to a Court or VCAT for a limited litigation restraint order against a person who is a party to a proceeding in that Court or in VCAT (as the case requires)—\n\n(b) if the person has made a vexatious application against another person, that other person;\n\n(c) a person who has a sufficient interest in the matter.\n\nA person who is a party to a proceeding and who is not the person against whom a vexatious application has been made may be a person who has a sufficient interest in the matter.\n\n(2) A person referred to in subsection (1)(b) or (c) must not apply for a limited litigation restraint order against a person who is a party to a proceeding—\n\n(a) without leave of the Court in which the proceeding is being heard; or\n\n(b) if the proceeding is being heard in VCAT, without leave of VCAT.\n\n(3) A Court or VCAT may grant leave to apply for a limited litigation restraint order if the Court or VCAT is satisfied that—\n\n","sortOrder":11},{"sectionNumber":"11","sectionType":"section","heading":"Court or VCAT may make limited litigation restraint order","content":"\t11 Court or VCAT may make limited litigation restraint order\n\n(1) A Court or VCAT may make a limited litigation restraint order against a person who is a party to a proceeding if the Court or VCAT is satisfied that—\n\n(a) the person has made 2 or more interlocutory applications in the proceeding; and\n\n(b) the interlocutory applications are vexatious applications.\n\n(2) When making an order under subsection (1), a Court or VCAT may in its discretion take into account any matter it considers relevant, including but not limited to the following—\n\n(a) any interlocutory application made by the person, or an entity controlled by the person, in any Australian court or tribunal;\n\n(b) the existence of any order made by an Australian court or tribunal against the person or an entity controlled by the person, including—\n\n(iii) a vexatious proceeding order; or\n\n(iv) an order striking out a vexatious application;\n\n(3) A Court or VCAT may take into account a matter referred to in subsection (2) that relates to an interlocutory application made or a proceeding commenced or conducted before, on or after the commencement of this section.\n\n(4) A Court or VCAT may make a limited litigation restraint order—\n\n(b) on an application under section 10.\n\n","sortOrder":12},{"sectionNumber":"12","sectionType":"section","heading":"Content of limited litigation restraint order","content":"\t12 Content of limited litigation restraint order\n\n(1) A limited litigation restraint order may direct that the person must not, without leave of the Court or VCAT (as the case requires), do either or both of the following—\n\n(a) make an interlocutory application or specified type of interlocutory application in the proceeding;\n\n(b) continue an interlocutory application or specified type of interlocutory application in the proceeding.\n\n(2) A limited litigation restraint order may include any other direction or order in relation to the proceeding that the Court or VCAT considers appropriate.\n\n(3) Without limiting subsection (2), the Court or VCAT may direct that the person who is subject to the limited litigation restraint order may make  or continue  a specified type of interlocutory application in the proceeding.\n\n","sortOrder":13},{"sectionNumber":"13","sectionType":"section","heading":"Effect of limited litigation restraint order","content":"\t13 Effect of limited litigation restraint order\n\nOn the making of a limited litigation restraint order, subject to the terms of the order—\n\n(a) an interlocutory application in the proceeding to which the order relates is stayed; and\n\n(b) an interlocutory application that is made in contravention of the order is of no effect.\n\n","sortOrder":14},{"sectionNumber":"14","sectionType":"section","heading":"Limited litigation restraint order does not affect certain applications or proceedings","content":"\t14 Limited litigation restraint order does not affect certain applications or proceedings\n\nA limited litigation restraint order made against a person in respect of a proceeding does not affect the person's right—\n\n(a) to make or continue an interlocutory application in another proceeding in a Victorian court or tribunal; or\n\n(b) to commence or continue another proceeding in a Victorian court or tribunal.\n\n","sortOrder":15},{"sectionNumber":"15","sectionType":"section","heading":"Duration of limited litigation restraint order","content":"\t15 Duration of limited litigation restraint order\n\nUnless a Court or VCAT otherwise orders, a limited litigation restraint order remains in force for the duration of the proceeding to which the order relates.\n\n","sortOrder":16},{"sectionNumber":"Part 3","sectionType":"part","heading":"Extended litigation restraint orders","content":"Part 3—Extended litigation restraint orders\n\n","sortOrder":17},{"sectionNumber":"16","sectionType":"section","heading":"Application for extended litigation restraint order","content":"\t16 Application for extended litigation restraint order\n\n(1) Subject to subsection (2), any of the following persons may apply to a Court or VCAT for an extended litigation restraint order against a person—\n\n(b) if the person has commenced or conducted a vexatious proceeding against another person, that other person;\n\n(c) a person with a sufficient interest in the matter.\n\n(2) A person referred to in subsection (1)(b) or (c) must not apply for an extended litigation restraint order—\n\n(a) without leave of the Court of the jurisdiction in which the order is sought; or\n\n(b) if the order is sought in respect of proceedings in VCAT, without leave of VCAT.\n\n(3) A Court or VCAT may grant leave to apply for an extended litigation restraint order if the Court or VCAT is satisfied that—\n\n","sortOrder":18},{"sectionNumber":"17","sectionType":"section","heading":"Court or VCAT may make extended litigation restraint order","content":"\t17 Court or VCAT may make extended litigation restraint order\n\n(1) A Court or VCAT  may make an extended litigation restraint order against a person if the Court or VCAT is satisfied that the person has frequently commenced or conducted vexatious proceedings—\n\n(a) against a person or other entity; or\n\n(b) in relation to a matter.\n\nThe Magistrates' Court may also make an extended litigation restraint order that relates to intervention order legislation under section 19.\n\n(2) In determining whether it is satisfied of the matters specified in subsection (1), a Court or VCAT may take into account any matter it considers relevant, including but not limited to any of the following—\n\n(a) a proceeding commenced or conducted by the person, or an entity controlled by the person, in any Australian court or tribunal;\n\n(b) the existence of an order made by an Australian court or tribunal against the person, or an entity controlled by the person, including—\n\n(iii) a vexatious proceeding order;\n\n(3) A Court or VCAT may take into account a matter referred to in subsection (2) that relates to a proceeding commenced or conducted before, on or after the commencement of this section.\n\n(4) A Court or VCAT may make an extended litigation restraint order—\n\n(b) on an application under section 16.\n\n","sortOrder":19},{"sectionNumber":"18","sectionType":"section","heading":"Application for extended litigation restraint order—intervention order legislation","content":"\t18 Application for extended litigation restraint order—intervention order legislation\n\n(1) Subject to subsection (2), any of the following persons may apply to the Magistrates' Court or the Children's Court for an extended litigation restraint order that relates to intervention order legislation against a person—\n\n(b) if the person has commenced or conducted a vexatious proceeding under intervention order legislation against another person, that other person;\n\n(c) a person with a sufficient interest in the matter.\n\nFor the purposes of an extended litigation restraint order that relates to intervention order legislation, a person with a sufficient interest in the matter may include a police officer or a guardian or family member who seeks to apply for an intervention order under intervention order legislation on behalf of a person.\n\n(2) A person referred to in subsection (1)(b) or (c) must not apply for an extended litigation restraint order without leave of the Magistrates' Court or the Children's Court (as the case requires).\n\n(3) The Children's Court or the Magistrates' Court may grant leave to apply for an extended litigation restraint order that relates to intervention order legislation if the Court is satisfied that—\n\n","sortOrder":20},{"sectionNumber":"19","sectionType":"section","heading":"Magistrates' Court or Children's Court may make extended litigation restraint order—intervention order legislation","content":"\t19 Magistrates' Court or Children's Court may make extended litigation restraint order—intervention order legislation\n\n(1) The Magistrates' Court or the Children's Court may make an extended litigation restraint order that relates to intervention order legislation against a person if the court is satisfied that the person has frequently commenced or conducted vexatious proceedings under intervention order legislation—\n\n(a) against a person; or\n\n(b) in relation to a matter.\n\n(2) In determining whether it is satisfied of the matters specified in subsection (1), the Magistrates' Court or the Children's Court may take into account any matter it considers relevant.\n\n(3) The Magistrates' Court or the Children's Court may make an extended litigation restraint order that relates to intervention order legislation—\n\n(b) on an application under section 18.\n\nSee section 154 of the **Family Violence Protection Act 2008** or section 111 of the **Personal Safety Intervention Orders Act 2010** in relation to costs for a proceeding for an order made under this section.\n\n","sortOrder":21},{"sectionNumber":"20","sectionType":"section","heading":"Content of extended litigation restraint order made by Supreme Court","content":"\t20 Content of extended litigation restraint order made by Supreme Court\n\n(1) An extended litigation restraint order made by the Supreme Court against a person may direct that the person must not do either or both of the following for the period specified by the Supreme Court—\n\n(a) continue a proceeding in a Victorian court or tribunal against a person or other entity named in the order, or in respect of a matter described in the order, without leave of—\n\n(ii) the Victorian court or tribunal in which the proceeding is being heard;\n\n(b) commence a proceeding in a Victorian court or tribunal against a person or other entity named in the order, or in respect of a matter described in the order, without leave of—\n\n(ii) the Victorian court or tribunal in which the proceeding is to be commenced.\n\n(2) An extended litigation restraint order made by the Supreme Court may include any other direction or order that the Supreme Court considers appropriate.\n\n(3) Without limiting subsection (2), the Supreme Court may direct that the person who is subject to the order may commence or continue  a specified proceeding in a Victorian court or tribunal.\n\n","sortOrder":22},{"sectionNumber":"21","sectionType":"section","heading":"Content of extended litigation restraint order made by County Court","content":"\t21 Content of extended litigation restraint order made by County Court\n\n(1) An extended litigation restraint order made by the County Court against a person may direct that the person must not, without leave of the County Court, do either or both of the following for the period specified by the County Court—\n\n(a) continue a proceeding in the County Court against a person or other entity named in the order or in respect of a matter described in the order;\n\n(b) commence a proceeding in the County Court against a person or other entity named in the order or in respect of a matter described in the order.\n\n(2) An extended litigation restraint order made by the County Court may include any other direction or order in relation to a proceeding or the commencement of a proceeding in the County Court that the court considers appropriate.\n\n(3) Without limiting subsection (2), the County Court may direct that the person who is subject to the order may commence or continue  a specified proceeding in the County Court.\n\n","sortOrder":23},{"sectionNumber":"22","sectionType":"section","heading":"Content of extended litigation restraint order made by Magistrates' Court","content":"\t22 Content of extended litigation restraint order made by Magistrates' Court\n\n(1) An extended litigation restraint order made by the Magistrates' Court against a person under section 17 may direct that the person must not, without leave of the Magistrates' Court, do either or both of the following for the period specified by the Magistrates' Court—\n\n(a) continue a proceeding in the Magistrates' Court against a person or other entity named in the order or in respect of a matter described in the order;\n\n(b) commence a proceeding in the Magistrates' Court against a person or other entity named in the order or in respect of a matter described in the order.\n\n(2) An extended litigation restraint order that relates to intervention order legislation made by the Magistrates' Court against a person under section 19 may direct that the person must not, without leave of the Magistrates' Court, do either or both of the following for the period specified by the Magistrates' Court—\n\n(a) continue a proceeding in the Magistrates' Court or the Children's Court under intervention order legislation—\n\n(i) against a person protected by the extended litigation restraint order and, if the person is a parent of a child, his or her child; or\n\n(ii) in respect of a matter described in the order;\n\n(b) commence a proceeding in the Magistrates' Court or the Children's Court under intervention order legislation—\n\n(i) against a person protected by the extended litigation restraint order and, if the person is a parent of a child, his or her child; or\n\n(ii) in respect of a matter described in the order.\n\n(3) An extended litigation restraint order made by the Magistrates' Court may include any other direction or order that the Magistrates' Court considers appropriate in relation to a proceeding or the commencement of a proceeding—\n\n(a) in the case of an extended litigation restraint order made under section 17, in the Magistrates' Court; or\n\n(b) in the case of an extended litigation restraint order that relates to intervention order legislation made under section 19, in the Magistrates' Court or the Children's Court.\n\n(4) Without limiting subsection (3), the Magistrates' Court may direct that the person who is subject to the order may commence or continue  a specified proceeding—\n\n(a) in the case of an extended litigation restraint order made under section 17, in the Magistrates' Court; or\n\n(b) in the case of an extended litigation restraint order that relates to intervention order legislation made under section 19, in the Magistrates' Court or the Children's Court.\n\n","sortOrder":24},{"sectionNumber":"23","sectionType":"section","heading":"Content of extended litigation restraint order made by Children's Court","content":"\t23 Content of extended litigation restraint order made by Children's Court\n\n(1) An extended litigation restraint order that relates to intervention order legislation made by the Children's Court against a person may direct that the person must not, without leave of the Children's Court, do either or both of the following for the period specified by the Children's Court—\n\n(a) continue a proceeding in the Magistrates' Court or the Children's Court under intervention order legislation—\n\n(i) against a person protected by the extended litigation restraint order and, if the person is a parent of a child, his or her child; or\n\n(ii) in respect of a matter described in the order;\n\n(b) commence a proceeding in the Magistrates' Court or the Children's Court under intervention order legislation—\n\n(i) against a person protected by the extended litigation restraint order and, if the person is a parent of a child, his or her child; and\n\n(b) the terms of the extended litigation restraint order are the terms of the order made under section 193 of the **Family Violence Protection Act 2008** as in force immediately before its repeal, unless those terms are otherwise varied or revoked under this Act.\n\n(3) If an application for leave to make an application under the **Family Violence Protection Act 2008**, made by a person who is declared to be a vexatious litigant under Part 11 of that Act or Part 10 of the **Personal Safety Intervention Orders Act 2010**, is decided in accordance with subsection (1) by the Magistrates' Court or the Children's Court under section 194 of the **Family Violence Protection Act 2008** as in force immediately before its repeal, on the deciding of that application—\n\n(a) the applicant is taken to have been granted or refused leave under section 53 of this Act to commence or continue a proceeding (as the case requires); and\n\n(b) the order declaring the person to be a vexatious litigant is taken to be—\n\n(i) in the case of an order made by the Magistrates' Court, an extended litigation restraint order that relates to intervention order legislation made by the Magistrates' Court under section 19 of this Act; or\n\n(ii) in the case of an order made by the Children's Court, an extended litigation restraint order that relates to intervention order legislation made by the Children's Court under section 19 of this Act; and\n\n(c) the terms of the extended litigation restraint order are the terms of the order made under section 193 of the **Family Violence Protection Act 2008** as in force immediately before its repeal, unless those terms are otherwise varied or revoked under this Act.\n\n(4) If an order varying an order declaring a person to be a vexatious litigant is made in accordance with subsection (1) by the Magistrates' Court or the Children's Court under section 197 of the **Family Violence Protection Act 2008** as in force immediately before its repeal, on and from the date of the variation order, the order declaring a person to be a vexatious litigant is taken to be—\n\n(a) in the case of an order made by the Magistrates' Court, an extended litigation restraint order that relates to intervention order legislation made by the Magistrates' Court under section 19 of this Act, the terms of which are varied in accordance with the variation order; or\n\n(b) in the case of an order made by the Children's Court, an extended litigation restraint order that relates to intervention order legislation made by the Children's Court under section 19 of this Act, the terms of which are varied in accordance with the variation order.\n\n(5) If the Supreme Court or the County Court, on an appeal under section 195 of the **Family Violence Protection Act 2008** being dealt with in accordance with subsection (1), determines that an order declaring a person to be a vexatious litigant is to remain in force, on and from the date of that determination—\n\n(i) in the case of an order made by the Magistrates' Court, an extended litigation restraint order that relates to intervention order legislation made by the Magistrates' Court under section 19 of this Act;
