(ss 42A–42GD)\n- Gives the board powers to investigate complaints, to authorise external investigators, to require documents and attendance, and to conduct searches and seize evidence with consent or a magistrate's warrant. (ss 43–48)\n- Establishes disciplinary routes: the board can take administrative disciplinary action (admonition, undertaking, small penalties) or refer serious matters to QCAT (Queensland Civil and Administrative Tribunal), which has wider powers including suspension, cancellation and larger penalties. (ss 50–59)\n- Prohibits people who are not registered valuers from holding themselves out as valuers or carrying on the valuer business (with limited exceptions). (s 63)\n- Enables the Governor in Council to make regulations, including prescribing a professional code of conduct. (s 66)\n\n**Who it affects:**\n\n- Individuals who value land and want to operate in Queensland — they must register, maintain CPD, pay fees, and comply with discipline rules (ss 29–36B, 36D, 42FA). \n- Firms that provide valuation services — corporate practice is regulated because a body corporate may avoid the unregistered-practice offence only if at least one director or board member or an employee is a registered valuer (s 63(2)). \n- Users of valuation services (banks, developers, landlords, tenants) — rely on the register and disciplinary powers as a quality signal and enforcement mechanism (ss 26–28, 51–59). \n- Professional institutes that nominate members to the board (Australian Property Institute, Real Estate Institute of Queensland) have formal input to board composition (ss 6–8, 7). \n\n**Why it matters (stated purposes and actual mechanisms):**\n\nThe Act's stated or implicit objective is to regulate entry and conduct in the valuation profession to maintain competency and public confidence (see the registration/discipline architecture in Parts 3 and 4). Mechanically, it does this by: 1) setting minimum qualifications and experience for registration (s 30); 2) requiring annual renewal with CPD proof (s 36B); 3) keeping a public register and publishing it annually (ss 26, 28); and 4) giving investigatory and disciplinary powers to the board and QCAT (ss 44–59).\n\nThose mechanisms create costs and incentives: \n\n- Compliance costs and time burden fall on valuers (application fees, annual roll fee, CPD hours and record-keeping, possible restoration fees if removed). (ss 29, 34, 36, 36B, 36A)\n- The board is funded from fees and penalties it receives; penalties payable under the Act go to the board (s 64). That creates an internal funding incentive to run the scheme from its own receipts (s 25, 64). \n- The prohibition on unregistered practice (s 63) restricts whom the market can present as a valuer; exceptions (corporate arrangements, architects/engineers/quantity surveyors for cost assessments) narrow the restriction’s scope (s 63(2)–(3)).\n\n**Key trade-offs, implementation issues and incentive questions:**\n\n- Entry control vs competition: registration and CPD can raise the quality floor but also raise barriers to entry (s 30, s 36B). The Act gives institutes a formal role in nominating board members (s 6) which concentrates influence with professional bodies — that can improve technical governance but may tilt decisions toward incumbent interests.\n\n- Enforcement resources and legal complexity: investigators can require documents and attendance and may search/seize with a warrant (ss 45–48). Those are robust powers that require legal safeguards (warrant standard, magistrate oversight) and create administrative burden in practice (record storage, confidentiality rules). \n\n- Confidentiality and records: the Act allows police-criminal-history checks for appointments and registration (ss 10A, 31) but treats those reports as confidential with strict destruction and non-disclosure obligations (ss 10B, 31B). That balances screening with privacy/compliance obligations but requires careful record-handling by the department and the board.\n\n- Dual enforcement paths and procedural choices: the board can handle lesser matters itself with modest penalties (up to 20 penalty units) or refer serious matters to QCAT where larger penalties (up to 100 penalty units), suspensions or cancellations are possible (ss 51, 59). That bifurcation requires the board to decide which route suits each case and creates variable litigation costs for valuers.\n\n- Public information and signalling: the Act mandates publication of the register annually and permits posting disciplinary notices on the board’s website and newspapers (ss 28, 51, 59). That provides market information but also imposes reputational costs on practitioners.\n\n**Concrete behavioural effects (who pays, who decides, and what changes):**\n\n- Who pays: applicants and registered valuers pay application, roll, renewal, late and restoration fees (ss 29, 34, 36, 36A, 42FA). Penalties for offences are payable to the board (s 64). \n- Who decides: the board (with members nominated by the valuer‑general and professional organisations) controls registration, investigations and much disciplinary activity; QCAT is the appellate/tribunal route for significant disciplinary outcomes (ss 6–8, 29, 44, 50–59). \n- Behaviour changes: valuers must meet training and experience thresholds to enter (s 30), must maintain CPD and renew annually (s 36B), and must respond to board notices and investigations (ss 29, 45–52). Non-compliant providers are deterred by penalties and the risk of removal from the register (ss 36–40, 59, 63).\n\n**Notable statutory features to watch in practice (implementation risk and trade-offs):**\n\n- Board composition and nominations by professional bodies (ss 6–8) — concentrated influence with incumbent groups.\n- CPD compliance enforcement and exemptions (ss 36B–36C; 42FA–42FC for retail specialists) — administrative burden for record-keeping and verification.\n- Investigator search/seizure powers, and magistrate-warrant safeguards (ss 46–48) — operational and legal risk for both investigators and subjects.\n- Two-tier discipline (board-administered penalties vs QCAT) with differing penalties and publication rules (ss 51, 59) — procedural strategy risk for practitioners.\n- Confidentiality requirements for criminal-history checks with mandatory destruction of reports (ss 10A–10B, 31–31B) — practical privacy and records-management obligations.\n\nOverall, the Act is a traditional occupational registration statute: it defines who may call themselves a valuer, sets entry and continuing-competence requirements, creates a public register, funds a statutory board, and provides investigatory and disciplinary powers with Tribunal oversight. Its mechanical design combines professional self-regulation inputs (institute nominations and CPD certification) with statutory enforcement powers (investigators, warrants, QCAT outcomes)."},"issue_detection":{"absurdities":[],"contradictions":[]},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
