The original intent appears to have been direct Commonwealth-to-State financial transfers, but the approved body mechanism broadens the range of entities that can ultimately receive and spend the funds."},"complexity_factors":["Relatively short and straightforward legislative text with limited provisions","Some technical financial terminology (e.g., 'long-term bond rate', 'yield to maturity') that requires explanation","The Act relies heavily on a Schedule (not reproduced) that defines the actual scope of 'urban and regional development', creating hidden complexity","Intergovernmental nature (federal-state relations) adds a layer of constitutional context not visible in the text alone","The concept of 'approved bodies' introduces a delegated approval mechanism that could expand the Act's reach without further legislative change"],"plain_english_summary":"This Act lets the Australian government provide loans or grants to States and Territories to fund urban and regional development projects, with funds sometimes channelled to local councils or approved non‑profits. Here's what it does:\n\n**The big picture:** The Australian Government can give money (as grants or loans) to States and Territories to fund specific development programs.\n\n**Who can get money:**\n- **States and Territories** (including the ACT)\n- **Approved bodies** — these can be state government authorities, local councils, or non-profit corporations (organisations not run for private profit)\n\n**How it works:**\n1. The federal Minister approves specific programs that match items listed in a Schedule (a separate list of eligible project types)\n2. The Minister consults with the relevant state minister before approving programs\n3. The federal government negotiates written agreements with states about how much money will be provided and on what terms\n4. If the money is a **loan**, the state must pay it back with interest based on government bond rates\n\n**Key safeguards:**\n- All agreements must be tabled in Parliament within 15 sitting days (made public and open to scrutiny)\n- Funding comes from money specifically voted for by Parliament each year\n- Agreements can be reviewed and amended over time\n\n**Why it matters:** This creates a formal, transparent way for the federal government to invest in local infrastructure and development projects — things like roads, community facilities, or regional planning — while ensuring states are accountable for how the money is spent."}},"importantCases":[],"_links":{"self":"/api/acts/urban-and-regional-development-financial-assistance-act-1974","history":"/api/acts/urban-and-regional-development-financial-assistance-act-1974/history","analysis":"/api/acts/urban-and-regional-development-financial-assistance-act-1974/analysis","conflicts":"/api/acts/urban-and-regional-development-financial-assistance-act-1974/conflicts","importantCases":"/api/acts/urban-and-regional-development-financial-assistance-act-1974/important-cases","documents":"/api/acts/urban-and-regional-development-financial-assistance-act-1974/documents"}}
