This allowed the ACT Legislative Assembly to amend and repeal the\nlaws. This Act was converted into an ACT enactment on 11 May 1989 (self-\ngovernment day).\nThe Ordinance was renamed Trespass on Territory Land Ordinance 1932 by the\nSelf-Government (Consequential Amendments) Ordinance 1989 No 38 (see sch 1).\nAs with most ordinances in force in the ACT, the name was changed from\nOrdinance to Act by the Self-Government (Citation of Laws) Act 1989 A1989-21, s\n5 on 11 May 1989 (self-government day).\nBefore 11 May 1989, ordinances commenced on their notification day unless\notherwise stated (see Seat of Government (Administration) Act 1910 (Cwlth), s 12).\nAfter 11 May 1989 and before 10 November 1999, Acts commenced on their\nnotification day unless otherwise stated (see Australian Capital Territory (Self-\nGovernment) Act 1988 (Cwlth) s 25).\nLegislation before becoming Territory enactment\nTrespass on Territory Land Act 1932 Ord 1932–20\nnotified 10 November 1932\ncommenced 10 November 1932\nas amended by\nTrespass on Commonwealth These changes retain the Act’s core aim but expand administrative and evidentiary tools and align definitions with other modern ACT laws."},"complexity_factors":["Cross-references to other legislation for key definitions (eg. vehicle; city area; protected tree) increase interpretive complexity (Dictionary; Urban Forest Act 2023 amendment to s 7).","Broad, fact‑intensive standards such as “reasonable excuse” shift evidential burdens to courts and defendants (eg. s 4(2), s 6, s 7).","Discretion granted to the Minister to authorise persons and to appoint inspectors (s 3A, s 8) creates administrative decision points and potential variation in enforcement practice.","Powers to use force and remove persons (s 8) raise operational and liability questions for enforcement officers.","Evidentiary certificate presumption simplifies prosecutions but creates a reverse onus risk if the certificate is challenged (s 8C).","Operational overlap with other frameworks (Road Transport Acts, City Area Leases Act, Urban Forest Act) requires coordination between agencies.","Penalty structure is simple but tied to penalty‑unit values set elsewhere, so monetary impacts change over time (penalty amounts noted in republication preface referencing Legislation Act)."],"plain_english_summary":"Makes it an offence to enter or damage unleased ACT land, roads and plantations without reasonable excuse; sets penalties, empowers appointed inspectors and Minister‑authorised persons to prevent or remove trespassers (including use of force), and lets officials require names and certify land status as evidence. It affects people who enter Territory land, owners or keepers of animals that stray, and anyone who damages fences or trees — matters for enforcement discretion, compliance costs and liability for damage (see ss 4, 4A–7, 8, 8C, 9)."},"kimi_summary":{"content_quality":"ok","complexity_score":2,"scope_assessment":{"changed":true,"description":"The Act has shrunk significantly from its original scope. Originally enacted in 1932 as the Trespass on Commonwealth Lands Ordinance, it once included provisions for camping permits (s 8A) and permits to occupy unleased land (s 8B), which were removed in 2013 by the Public Unleased Land Act 2013. The 1973 amendments attempting to add camping provisions were disallowed by the Senate, showing historical scope creep that was later reversed. The current Act is now narrowly focused on trespass, animal control, and property protection on unleased land, having shed its administrative/permitting functions to other legislation."},"complexity_factors":["Short statute with only 9 operative sections plus a dictionary","Minimal cross-referencing—only refers to 3 other Acts for definitions (Road Transport Acts, Urban Forest Act 2023, City Area Leases Act 1936)","Simple conditional structure: 'if X, then offence' with basic exceptions ('without reasonable excuse', 'without lawful excuse')","Only 7 defined terms in the dictionary, plus signpost definitions to standard terms in the Legislation Act","No nested exceptions or complex deeming provisions","Straightforward penalty structure (5, 10, or 20 penalty units)","Evidence provision (s 8C) uses standard certificate-of-authority language common across ACT legislation"],"plain_english_summary":"This law makes it an offence to enter certain unleased Commonwealth/ACT public land without authorization and sets rules to prevent damage to fences, gates, trees and plants, and to control animals that stray onto roads or public land. It affects anyone accessing government land, livestock owners and drivers. Originating in 1932, it protects public land from unauthorised use and damage, with regulatory penalties (modest fines) and powers for inspectors to enforce compliance."}},"importantCases":[],"_links":{"self":"/api/acts/trespass-on-territory-land-act-1932","history":"/api/acts/trespass-on-territory-land-act-1932/history","analysis":"/api/acts/trespass-on-territory-land-act-1932/analysis","conflicts":"/api/acts/trespass-on-territory-land-act-1932/conflicts","importantCases":"/api/acts/trespass-on-territory-land-act-1932/important-cases","documents":"/api/acts/trespass-on-territory-land-act-1932/documents"}}
