Compared with the repealed reference, it adds greater specificity and enforcement mechanisms: fixed receptacle types and weight caps (cl.2.1–2.5), structured verge and waste‑facility rules (cl.2.10; Part 4), explicit fee and classification powers (cl.4.4–4.5), formal exemption/approval processes (cl.2.8; cl.3.2–3.3), and a schedule of prescribed offences with modified penalties (Part 5; Sch.2). These changes broaden and formalise the council’s operational and enforcement reach while requiring annual public notice for many determinations (cl.1.6)."},"complexity_factors":["Extensive defined terms setting the regulatory baseline (cl.1.5) which shape scope and duties.","Broad discretionary powers for the local government/authorised persons to determine classifications, weights, collection days/times, fees and exemptions (cl.1.6, cl.2.1, cl.2.3–2.5, cl.4.3–4.5, cl.2.8).","Interplay with two higher Acts (WARR Act and LG Act) for fees, services and enforcement, requiring cross‑statutory reading (cl.1.7–1.8).","Detailed operational rules for premises, verge collections and waste facilities (Parts 2–4) with specific procedural duties (cl.2.6–2.7, cl.2.10, cl.4.1–4.6).","Comprehensive enforcement regime including criminal penalties, daily continuance fines, cost recovery as a civil debt, objection/appeal paths under the LG Act, and prescribed infringement amounts (Part 5; Sch.2).","Variable numeric limits (e.g. 240 L receptacle / 70 kg cap) combined with open ‘determined by local government’ weights for other sizes (cl.2.3–2.5), creating implementation complexity.","Joint and several liability for multiple owners/occupiers where duties are imposed (cl.1.5(2)).","Exemptions and approvals can be conditional and revoked on \"reasonable grounds\", creating administrative discretion and compliance risk (cl.2.8(2)–(4)).","Schedule 1 lists many categories of non‑collectable waste, linking to external regulation (e.g. controlled waste), which complicates compliance for users (Sch.1).","Numerous prescribed offences with different modified penalties (Sch.2) requiring granular compliance and enforcement tracking."],"plain_english_summary":"This local law sets rules for household and public waste within the Town of Cottesloe: how the council supplies and collects bins (general, recycling, organic), what may be placed in them, how public verge and waste‑facility collections operate, fees and penalties, and powers for council officers to direct or exempt residents. It affects owners, occupiers, waste‑facility users and contractors who pay fees, must follow placement/weight rules, and face fines or costs for breaches.
