to provide for the extended supervision and continuing detention of certain offenders posing an unacceptable risk of committing serious terrorism offences so as to ensure the safety and protection of the community.\n> \n> > (2) Another object of this Act is to encourage these offenders to undertake rehabilitation.","sortOrder":4},{"sectionNumber":"4","sectionType":"section","heading":"Definitions","content":"#### 4 Definitions\n\n4 Definitions\n\n> > (1) In this Act—\n> > \n> > aggregate sentence of imprisonment has the same meaning as in the [Crimes (Sentencing Procedure) Act 1999](/view/html/inforce/current/act-1999-092).\n> > \n> > Australian jurisdiction means—\n> > \n> > > (a) a State, or\n> > \n> > > (b) a Territory, or\n> > \n> > > (c) the Commonwealth.\n> > \n> > business day means any day that is not a Saturday, Sunday or public holiday.\n> > \n> > Commissioner of Corrective Services has the same meaning as Commissioner has in the [Crimes (Administration of Sentences) Act 1999](/view/html/inforce/current/act-1999-093).\n> > \n> > Commonwealth Criminal Code means the [Criminal Code](http://www.legislation.gov.au/) set out in the Schedule to the [Criminal Code Act 1995](http://www.legislation.gov.au/) of the Commonwealth.\n> > \n> > continuing detention order means an order for the detention of an eligible offender made under Division 3.2.\n> > \n> > control order means a control order within the meaning of Part 5.3 of the Commonwealth Criminal Code.\n> > \n> > convicted NSW terrorism activity offender—see section 10.\n> > \n> > convicted NSW terrorist offender—see section 8.\n> > \n> > convicted NSW underlying terrorism offender—see section 9.\n> > \n> > correctional centre has the same meaning as in the [Crimes (Administration of Sentences) Act 1999](/view/html/inforce/current/act-1999-093).\n> > \n> > Corrective Services NSW has the same meaning as in the [Crimes (Administration of Sentences) Act 1999](/view/html/inforce/current/act-1999-093).\n> > \n> > corrective services officer means a correctional officer or community corrections officer within the meaning of the [Crimes (Administration of Sentences) Act 1999](/view/html/inforce/current/act-1999-093).\n> > \n> > cumulative sentence of imprisonment means 2 or more sentences of imprisonment in which each sentence of imprisonment is served concurrently or consecutively, or partly concurrently and partly consecutively, with 1 or more of the other sentences of imprisonment.\n> > \n> > eligible offender—see section 7.\n> > \n> > eligible offender in lawful custody—see section 5.\n> > \n> > emergency detention order means an emergency order for the detention of an eligible offender made under Division 3.6.\n> > \n> > enforcement officer means—\n> > \n> > > (a) a corrective services officer, or\n> > \n> > > (b) a police officer.\n> > \n> > extended supervision order means an order for the supervision of an eligible offender made under Division 2.2.\n> > \n> > function includes a power, authority or duty, and exercise a function includes perform a duty.\n> > \n> > HRO Assessment Committee means the High Risk Offenders Assessment Committee established by section 24AB of the [Crimes (High Risk Offenders) Act 2006](/view/html/inforce/current/act-2006-007).\n> > \n> > interim detention order means an interim order for the detention of an eligible offender made under Division 3.5.\n> > \n> > interim supervision order means an interim order for the supervision of an eligible offender made under Division 2.5.\n> > \n> > Justice Health and Forensic Mental Health Network means the statutory health corporation of that name specified in Schedule 2 to the [Health Services Act 1997](/view/html/inforce/current/act-1997-154).\n> > \n> > NSW indictable offence means an offence against a law of the State for which proceedings may be taken on indictment (whether or not proceedings for the offence may also be taken otherwise than on indictment).\n> > \n> > order under Part 2 or 3 means any of the following orders—\n> > \n> > > (a) an extended supervision order,\n> > \n> > > (b) an interim supervision order,\n> > \n> > > (c) a continuing detention order,\n> > \n> > > (d) an interim detention order,\n> > \n> > > (e) an emergency detention order.\n> > \n> > prescribed terrorism intelligence authority means any authority or other agency (or authority or other agency of a kind) of an Australian jurisdiction that is prescribed by the regulations.\n> > \n> > qualified psychiatrist means a registered medical practitioner who is a fellow of the Royal Australian and New Zealand College of Psychiatrists.\n> > \n> > relevant expert means a person who has expertise in relation to a body of knowledge of a kind prescribed by the regulations.\n> > \n> > sentence of imprisonment for a NSW indictable offence—see section 6A.\n> > \n> > sentencing court, in relation to an eligible offender or other person who has served or is serving a sentence of imprisonment for an offence, means—\n> > \n> > > (a) the court by which the sentence was imposed, and\n> > \n> > > (b) any court that heard an appeal in respect of that sentence.\n> > \n> > serious terrorism offence means an offence against Part 5.3 of the Commonwealth Criminal Code for which the maximum penalty is 7 or more years of imprisonment.\n> > \n> > serving a sentence of imprisonment—see section 6.\n> > \n> > supporting documentation, in relation to proceedings under Part 2 or 3, means the documentation referred to in section 23 (3) or 37 (4), as the case requires.\n> > \n> > terrorism activity means—\n> > \n> > > (a) any statement or other conduct of any person or group of persons involving advocating support for engaging in any terrorist acts or violent extremism, or\n> > \n> > > (b) any conduct or other activity of any person or group of persons involving planning or preparing for, or engaging in, any terrorist acts or violent extremism.\n> > \n> > terrorism intelligence means information relating to actual or suspected terrorism activity (whether in the State or elsewhere) the disclosure of which could reasonably be expected—\n> > \n> > > (a) to adversely affect the capacity of persons or bodies involved in the prevention of terrorist acts from preventing such acts or the capacity of intelligence agencies (for example, the Australian Security Intelligence Organisation) to carry out their functions, or\n> > \n> > > (b) to prejudice criminal investigations or investigations by intelligence agencies, or\n> > \n> > > (c) to enable the discovery of the existence or identity of a confidential source of information relevant to law enforcement or the functions of intelligence agencies, or\n> > \n> > > (d) to endanger a person’s life or physical safety.\n> > \n> > terrorist act has the same meaning as in Part 5.3 of the Commonwealth Criminal Code.\n> > \n> > Note.\n> > \n> > The [Interpretation Act 1987](/view/html/inforce/current/act-1987-015) contains definitions and other provisions that affect the interpretation and application of this Act.\n> \n> > (2) Notes included in this Act do not form part of this Act.\n> \n> **s 4:** Am 2018 No 29, Sch 1.22 \\[1\\]–\\[3\\]; Offender in lawful custody\n\n> In this Act, an eligible offender in lawful custody includes, where used in relation to an eligible offender who is subject to an extended supervision order or interim supervision order, the offender being in lawful custody during a period for which the offender is on remand for any imprisonment\n\n> In this Act, a person is serving a sentence of imprisonment for an offence if—\n> \n> > (a) the person is serving a sentence of imprisonment for the offence by way of full-time indictable offence is a sentence of imprisonment in relation to which there is at least 1 offence that is a NSW indictable offence, including—\n> \n> > (a) an aggregate sentence of imprisonment, continuing to be supervised or detained under this Act after serving, a sentence of imprisonment for a NSW indictable offence.\n> \n> **s 7:** Am 2024 No 6, Sch 2\\[2\\]; 2025 No 15, Sch offender\n\n> > (1) In this Act, an eligible offender is a convicted NSW terrorist offender if—\n> > \n> > > (a) the offender is serving (or is continuing to be supervised or detained under this Act after serving) a sentence of imprisonment for an offence against section 310J of the [Crimes Act 1900](/view/html/inforce/current/act-1900-040), or\n> > \n> > > (b) the offender has previously served a sentence of imprisonment for an offence against section 310J of the [Crimes Act 1900](/view/html/inforce/current/act-1900-040) and is serving (or is continuing to be supervised or detained under this Act after serving) a sentence of imprisonment for a NSW indictable offence that is not an offence against section 310J of the [Crimes Act 1900](/view/html/inforce/current/act-1900-040).\n> \n> > (2) In this section—\n> > \n> > sentence of imprisonment for an offence against section 310J of the Crimes Act 1900 extends to an aggregate sentence of imprisonment or a cumulative sentence of imprisonment in relation to which at least 1 of the offences is an offence against section 310J of the [Crimes Act 1900](/view/html/inforce/current/act-1900-040).\n> \n> **s 8:** Am 2025 No 15, Sch 8\\[4\\] \\[5\\].","sortOrder":12},{"sectionNumber":"9","sectionType":"section","heading":"Convicted NSW underlying terrorism offender","content":"#### 9 Convicted NSW underlying terrorism offender\n\n9 Convicted NSW underlying terrorism offender\n\n> > (1) In this Act, an eligible offender is a convicted NSW underlying terrorism offender if—\n> > \n> > > (a) the offender is serving (or is continuing to be supervised or detained under this Act after serving) a sentence of imprisonment for a NSW indictable offence (the offender’s offence), and\n> > \n> > > (b) the offender’s offence is a serious offence, and\n> > \n> > > (c) the offender’s offence occurred in a terrorism context.\n> \n> > (2) Each of the following kinds of offences (however described) is a serious offence—\n> > \n> > > (a) an offence against the [Firearms Act 1996](/view/html/inforce/current/act-1996-046),\n> > \n> > > (b) an offence against the [Weapons Prohibition Act 1998](/view/html/inforce/current/act-1998-127),\n> > \n> > > (c) an offence that caused the death of, or grievous bodily harm or other serious physical harm to, a person,\n> > \n> > > (d) an offence that caused serious damage to property,\n> > \n> > > (e) an offence that endangered a person’s life (other than the life of the offender),\n> > \n> > > (f) an offence that caused a serious risk to the health or safety of the public or a section of the public,\n> > \n> > > (g) an offence that seriously interfered with, or seriously disrupted, or destroyed, an electronic system including, but not limited to, any of the following—\n> > > \n> > > > (i) an information system,\n> > > \n> > > > (ii) a telecommunications system,\n> > > \n> > > > (iii) a financial system,\n> > > \n> > > > (iv) a system used for the delivery of essential government services,\n> > > \n> > > > (v) a system used for, or by, an essential public utility,\n> > > \n> > > > (vi) a system used for, or by, a transport system,\n> > \n> > > (h) an offence of attempting, assisting, aiding, abetting, counselling, procuring, soliciting, being an accessory to, encouraging, inciting or conspiring to commit any of the kinds of offences mentioned in paragraphs (a)–(g).\n> \n> > (3) An eligible offender’s offence occurred in a terrorism context if—\n> > \n> > > (a) the offender committed the offender’s offence with—\n> > > \n> > > > (i) the intention of advancing a political, religious or ideological cause, and\n> > > \n> > > > (ii) the intention of coercing, or influencing by intimidation, the government of an Australian jurisdiction or foreign country (or of part of an Australian jurisdiction or foreign country) or of intimidating the public or a section of the public, or\n> > \n> > > (b) the offender knew, or was reckless as to whether, the offender’s offence would materially assist any other person to commit—\n> > > \n> > > > (i) an offence against section 310J of the [Crimes Act 1900](/view/html/inforce/current/act-1900-040), or\n> > > \n> > > > (ii) a NSW indictable offence that is a serious offence committed by the other person with the intentions referred to in paragraph (a), or\n> > > \n> > > > (iii) a terrorism offence within the meaning of the [Crimes Act 1914](http://www.legislation.gov.au/) of the Commonwealth.\n> \n> > (4) In this section—\n> > \n> > > (a) a reference to any person or property is a reference to any person or property wherever situated, within or outside the State (including within or outside Australia), and\n> > \n> > > (b) a reference to the public includes a reference to the public of another Australian jurisdiction or of a foreign country.","sortOrder":13},{"sectionNumber":"10","sectionType":"section","heading":"Convicted NSW terrorism activity offender","content":"#### 10 Convicted NSW terrorism activity offender\n\n10 Convicted NSW terrorism activity offender\n\n> > (1) In this Act, an eligible offender is a convicted NSW terrorism activity offender if the offender is serving (or is continuing to be supervised or detained under this Act after serving) a sentence of imprisonment for a NSW indictable offence (the offender’s offence) and any of the following apply in respect of the offender—\n> > \n> > > (a) the offender has at any time been subject to a control order,\n> > \n> > > (b) the offender has at any time been a member of a terrorist organisation,\n> > \n> > > (c) the offender—\n> > > \n> > > > (i) is making or has previously made any statement (or is carrying out or has previously carried out any activity) advocating support for any terrorist act or violent extremism, or\n> > > \n> > > > (ii) has or previously had any personal or business association or other affiliation with any person, group of persons or organisation that is or was advocating support for any terrorist act or violent extremism.\n> \n> > (1A) Without limiting subsection (1) (c)—\n> > \n> > > (a) advocating support for a terrorist act or violent extremism includes (but is not limited to) any of the following—\n> > > \n> > > > (i) making a pledge of loyalty to a person, group of persons or organisation, or an ideology, that supports terrorist acts or violent extremism,\n> > > \n> > > > (ii) using or displaying images or symbols associated with a person, group of persons or organisation, or an ideology, that supports terrorist acts or violent extremism,\n> > > \n> > > > (iii) making a threat of violence of a kind that is promoted by a person, group of persons or organisation, or an ideology, that supports terrorist acts or violent extremism, and\n> > \n> > > (b) an association or other affiliation with a person, group of persons or organisation includes (but is not limited to) any of the following—\n> > > \n> > > > (i) networking or communicating with the person, group of persons or organisation,\n> > > \n> > > > (ii) using social media sites or any other websites to communicate with the person, group of persons or organisation.\n> \n> > (2) Subsection (1) (b) and (c) apply regardless of whether or not the eligible offender has been convicted of an offence for the conduct concerned (whether in Australia or elsewhere).\n> \n> > (3) In this section—\n> > \n> > terrorist organisation has the same meaning as it has in Division 102 of Part 5.3 of the Commonwealth Criminal Code.\n> \n> **s 10:** Am 2018 No 94, Sch 1.8 \\[1\\] \\[2\\].","sortOrder":14},{"sectionNumber":"11","sectionType":"section","heading":"Determining whether eligible offender is convicted NSW underlying terrorism offender or convicted NSW terrorism activity offender","content":"#### 11 Determining whether eligible offender is convicted NSW underlying terrorism offender or convicted NSW terrorism activity offender\n\n11 Determining whether eligible offender is convicted NSW underlying terrorism offender or convicted NSW terrorism activity offender\n\n> In determining whether an eligible offender is a convicted NSW underlying terrorism offender or convicted NSW terrorism activity offender, the Supreme Court may take into account—\n> \n> > (a) the views of the sentencing court at the time the offender was sentenced for the offender’s offence, and\n> \n> > (b) the views of the sentencing court at the time a person other than the offender was sentenced for an offence if the person was a co-accused of the offender or was convicted of assisting, aiding, abetting, counselling, procuring, soliciting, being an accessory to, encouraging, inciting or conspiring to commit the offender’s offence, and\n> \n> > (c) evidence adduced in the proceedings for the offender’s offence or in proceedings against another person for an offence referred to in paragraph (b), and\n> \n> > (d) any relevant terrorism intelligence, and\n> \n> > (e) the offender’s criminal history (including prior convictions and findings of guilt in respect of offences committed in the State or elsewhere), and any pattern of offending behaviour disclosed by that history, and\n> \n> > (f) the results of any assessment prepared by a qualified psychiatrist, registered psychologist, registered medical practitioner or other relevant expert as to the offender’s history of behaviour (including any patterns in, or the progression of, that behaviour to date), and\n> \n> > (g) any information concerning the offender that the Court considers relevant (including developmental or social factors and behaviour while in custody), and\n> \n> > (h) any report prepared by Corrective Services NSW, the NSW Police Force or a prescribed terrorism intelligence authority concerning the offender and the offender’s associates and affiliations, and\n> \n> > (i) information indicating that current or former associates of the offender have been or are involved in terrorism activities, and\n> \n> > (j) any other information that the Court considers relevant.","sortOrder":15},{"sectionNumber":"12","sectionType":"section","heading":"Preliminary proceedings for declaration that person is relevant offender","content":"#### 12 Preliminary proceedings for declaration that person is relevant offender\n\n12 Preliminary proceedings for declaration that person is relevant offender\n\n> > (1) Application for declaration The State may apply to the Supreme Court for a declaration that a person is any of the following for the purposes of this Act—\n> > \n> > > (a) a convicted NSW terrorist offender,\n> > \n> > > (b) a convicted NSW underlying terrorism offender,\n> > \n> > > (c) a convicted NSW terrorism activity offender.\n> \n> > (2) An application for a declaration may be made—\n> > \n> > > (a) before an application for an order under Part 2 or 3 is made in respect of the person (but only during the period in which an application for an extended supervision order or continuing detention order can be made), or\n> > \n> > > (b) at any time while an application for an order under Part 2 or 3 in respect of the person is pending.\n> \n> > (3) When declaration can be made The Supreme Court may make the declaration if satisfied that the person is—\n> > \n> > > (a) a convicted NSW terrorist offender, or\n> > \n> > > (b) a convicted NSW underlying terrorism offender, or\n> > \n> > > (c) a convicted NSW terrorism activity offender.\n> \n> > (4) Duration of declaration A declaration takes effect when it is made and remains in force until it expires or is revoked.\n> \n> > (5) A declaration that a person is a convicted NSW terrorism activity offender expires—\n> > \n> > > (a) on the expiry of the period of 15 months (the default period) after the declaration is made, or\n> > \n> > > (b) if an application for an order under Part 2 or 3 is made, but not finally determined, within the default period—when the application is finally determined.\n> \n> > (6) For the purposes of subsection (5), an application is not finally determined if—\n> > \n> > > (a) any period for bringing an appeal under this Act in respect of the application has not expired (ignoring any period that may be available by way of extension of time to appeal), or\n> > \n> > > (b) any appeal in respect of the application is pending (whether or not it is an appeal brought as of right).\n> \n> > (7) The Supreme Court may revoke a declaration on the application of the State or the person in respect of whom it is made.\n> \n> > (8) Effect of declaration While a declaration is in force in respect of a person, the State is not required to establish for the purposes of proceedings for an order under Part 2 or 3 in respect of the person that—\n> > \n> > > (a) the person is an eligible offender, or\n> > \n> > > (b) the person is a convicted NSW terrorist offender, convicted NSW underlying terrorism offender or convicted NSW terrorism activity offender (as the case requires).\n> \n> > (9) Further applications If the Supreme Court refuses to make a declaration in respect of a person or a declaration expires or is revoked, the refusal, expiry or revocation does not prevent—\n> > \n> > > (a) another application for a declaration being made in respect of the same person, or\n> > \n> > > (b) the Supreme Court granting that application if satisfied of any of the matters referred to in subsection (3) at that time.\n> \n> > (10) Power of Supreme Court to make declarations not limited This section does not limit any other power of the Supreme Court to make eligible offender who is serving a sentence of imprisonment that commenced before the date of assent to this Act in the same way as it applies to and in respect of an eligible offender who is serving intention appears, if a provision of this Act or an instrument made under this Act—\n> > \n> > > (a) would, apart from this section, have an invalid application, but\n> > \n> > > (b) also has at least one valid application,\n> > \n> > it is the intention of the Parliament of New South Wales that the provision is not to have the invalid application, but is to have every valid application.\n> \n> > (2) Despite subsection (1), the provision is not to have a particular valid application if—\n> > \n> > > (a) apart from this section, it is clear, taking into account the provision’s context and the purposes or objects underlying this Act, that the provision was intended to have that valid application only if every invalid application, or a particular invalid application, of the provision had with as terrorism intelligence, or\n> > \n> > > (c) the Supreme Court has granted an application under that Division for the document, report or other information to be dealt with as terrorism intelligence.\n> \n> > (4) A preliminary hearing into the application is to be conducted by the Supreme Court within 28 days after the application is filed in the Supreme Court or within such further time as the Supreme Court may allow.\n> \n> > (5) If, following the preliminary hearing, it is satisfied that the matters alleged in the supporting documentation would, if proved, justify the making of an extended supervision order, the Supreme Court must make orders—\n> > \n> > > (a) appointing—\n> > > \n> > > > (i) 2 qualified psychiatrists, or\n> > > \n> > > > (ii) 2 registered psychologists, or\n> > > \n> > > > (iii) 1 qualified psychiatrist and 1 registered psychologist, or\n> > > \n> > > > (iv) 2 qualified psychiatrists and 2 registered psychologists,\n> > > \n> > > to conduct separate psychiatric or psychological examinations (as the case requires) of the eligible offender and to furnish reports to the Supreme Court on the results of those examinations, and\n> > \n> > > (b) directing the eligible offender to attend those examinations.\n> \n> > (6) Without limiting subsection (5) (a), the Supreme Court may also make orders appointing any other relevant experts to furnish reports to the Supreme Court in respect of the eligible offender on specified matters.\n> \n> > (7) If, following the preliminary hearing, it is not satisfied that the matters alleged in the supporting documentation would, if proved, justify the making of an extended supervision order, the Supreme Court must dismiss the application.\n> \n> **s 24:** Am 2018 No 94, Sch 1.8 community must be the paramount consideration of the Supreme Court.\n> \n> > (3) In determining whether or not to make an extended supervision order in respect of an eligible offender, the Supreme Court must also have regard to the following matters in addition to any other matter it considers relevant—\n> > \n> > > (a) the reports received from the persons appointed to conduct examinations of the offender, and the level of the offender’s participation in any such examination,\n> > \n> > > (b) the results of any other assessment prepared by a qualified psychiatrist, registered psychologist, registered medical practitioner or other relevant expert as to the likelihood of the offender committing a serious terrorism offence, the willingness of the offender to participate in any such assessment, and the level of the offender’s participation in any such assessment,\n> > \n> > > (c) the results of any assessment as to the likelihood of persons with histories and characteristics similar to those of the offender committing a serious terrorism offence,\n> > \n> > > (d) any report prepared by Corrective Services NSW or the NSW Police Force as to the extent to which the offender can reasonably and practicably be managed in the community,\n> > \n> > > (e) any report prepared by a prescribed terrorism intelligence authority relevant to whether the offender can reasonably and practicably be managed in the community,\n> > \n> > > (f) any treatment or rehabilitation programs and other programs or initiatives in which the offender has had an opportunity to participate, the willingness of the offender to participate in any such programs or initiatives, and the level of the offender’s participation in any such programs or initiatives,\n> > \n> > > (g) options (if any) available if the offender is kept in custody or is in the community (whether or not under supervision) that might reduce the likelihood of the offender re-offending over time,\n> > \n> > > (h) the likelihood that the offender will comply with the obligations of an extended supervision order,\n> > \n> > > (i) without limiting paragraph (h), the level of the offender’s compliance with any obligations to which the offender is or has been subject while—\n> > > \n> > > > (i) on release on parole, or\n> > > \n> > > > (ii) subject to a control order, or\n> > > \n> > > > (iii) subject to an earlier extended supervision order or interim supervision order, or\n> > > \n> > > > (iv) subject to any other order of a court,\n> > \n> > > (j) the offender’s criminal history (including prior convictions and findings of guilt in respect of offences committed in New South Wales or elsewhere), and any pattern of offending behaviour disclosed by that history,\n> > \n> > > (k) the views of the sentencing court at the time the sentence of imprisonment was imposed on the offender,\n> > \n> > > (l) any beliefs or commitments of the offender (whether of an ideological, religious, political, social or other nature) that support engaging or participating in terrorism activities,\n> > \n> > > (m) any other information that is available as to the likelihood that the offender will commit a serious terrorism offence.\n> \n> > (4) In determining whether or not to make an extended supervision order in respect of an eligible offender, the Supreme Court is not to consider any intention of the offender to leave New South Wales (whether permanently or temporarily).\n> \n> **s 25:** Am 2018 No 94, Sch 1.8 However the Supreme Court may, if an extended supervision order is made in proceedings on an application for a continuing detention order, defer the operation of an extended supervision order for a period of up to 7 days (the deferral period) if—\n> > \n> > > (a) the Court considers that it is necessary to detain the eligible offender for the deferral period to enable arrangements to be made for supervision of the offender in the community, and\n> > \n> > > (b) it does not appear to the Court that an interim detention order can be made for the interim detention of the eligible offender.\n> \n> > (3) On the deferral of the operation of an extended supervision order, the Supreme Court may order that the eligible offender concerned be detained for such period (not exceeding the deferral period) after the offender’s current custody expires as is specified in the order.\n> \n> > (4) As soon as practicable after making an order under subsection (3), the Supreme Court must issue a warrant for the committal of the eligible offender for the specified period after the offender’s current custody expires.\n> \n> > (5) The warrant is sufficient authority for the eligible offender to be kept in custody in accordance with the terms of the warrant.\n> \n> > (6) An extended supervision order expires at the end of—\n> > \n> > > (a) such period (not exceeding 3 years from the day on which it commences) as is specified in the order, or\n> > \n> > > (b) if the order is suspended for any period, the period specified in paragraph (a) plus each period during which the order is suspended.\n> \n> > (7) An eligible offender’s obligations under an extended supervision order are suspended while the offender is in lawful custody, whether under this or any other Act or law.\n> \n> > (8) Nothing in this section prevents the Supreme Court from making a second or subsequent extended supervision order in respect of the same eligible to detain the offender for the deferral period to enable arrangements to be made for supervision of the offender in the community, and\n> > \n> > > (b) it does not appear to the Court that an interim detention order can be made for the interim detention of the offender.\n> \n> > (3) On the deferral of the operation of an interim supervision order, the Supreme Court may order that the eligible offender concerned be detained for a specified period (not exceeding the deferral period) after the offender’s current custody expires.\n> \n> > (4) As soon as practicable after making an order under sufficient authority for the eligible offender to be kept in custody in accordance with the terms of the warrant.\n> \n> > (6) An interim supervision order, and the eligible offender’s obligations under that interim supervision order, are suspended during any period the offender is in lawful custody, whether under this or any other Act or law.\n> \n> > (7) An interim supervision order may be renewed from time to time, but not so as to provide for the supervision of the eligible offender under such an order for periods totalling more than 3 months.\n> \n> > (8) Any day or part of a day on which an interim supervision order is suspended does not count towards the 3-month limit referred to in subsection following—\n> > \n> > > (a) to permit any enforcement officer to visit the offender at the offender’s residential address at any time and, for that purpose, to enter the premises at that address,\n> > \n> > > (b) to permit any enforcement officer to access any of the following—\n> > > \n> > > > (i) a computer or related electronic equipment that is at the offender’s residential address or in the possession of the offender,\n> > > \n> > > > (ii) data held within, or accessible from, the computer or related electronic equipment (including data accessible by means of an electronic identity),\n> > \n> > > (c) to permit any enforcement officer to seize any computer or other object at the offender’s residential address or in the possession of the offender for the purpose of enabling it to be forensically examined,\n> > \n> > > (d) to use specified services or facilities,\n> > \n> > > (e) to make periodic reports to an enforcement officer,\n> > \n> > > (f) to notify an enforcement officer of any change in the offender’s address,\n> > \n> > > (g) to participate in intervention programs or initiatives,\n> > \n> > > (h) to wear electronic monitoring equipment,\n> > \n> > > (i) to reside at an address approved by an enforcement officer,\n> > \n> > > (j) not to reside in or resort to specified locations or classes of locations,\n> > \n> > > (k) not to associate or make contact with specified persons or classes of persons,\n> > \n> > > (l) not to engage in specified conduct or classes of conduct,\n> > \n> > > (m) not to engage in specified financial, property or business dealings (including not to enter into specified agreements or hold specified interests in connection with such dealings),\n> > \n> > > (n) not to possess or use specified objects or substances,\n> > \n> > > (o) not to engage in specified employment or classes of employment,\n> > \n> > > (p) not to change the offender’s name,\n> > \n> > > (q) to comply with any obligation that could be imposed on the offender under Part 3 of the [Child Protection (Offenders Registration) Act 2000](/view/html/inforce/current/act-2000-042) if the offender were a registrable person within the meaning of that Act and were not the subject of an interim supervision order or an extended supervision order,\n> > \n> > > (r) to comply with specified requirements in connection with the offender’s access to and use of the internet,\n> > \n> > > (s) to provide any enforcement officer with information about any one or more of the following—\n> > > \n> > > > (i) a carriage service used, or intended to be used, by the offender (including any telephone number used, or intended to be used, by the offender),\n> > > \n> > > > (ii) an internet service provider or carriage service provider used, or intended to be used, by the offender,\n> > > \n> > > > (iii) an internet connection used, or intended to be used, by the offender (including whether the connection is a wireless, broadband, Asymmetric Digital Subscriber Line (ADSL) or dial-up connection),\n> > > \n> > > > (iv) an electronic identity used, or intended to be used, by the offender,\n> > \n> > > (t) to provide any enforcement officer with requested information in relation to any employment or any financial affairs of the offender.\n> \n> > (1A) Unless the Supreme Court orders differently (and without limiting the conditions that the Court may impose under subsection (1)), an extended supervision order or interim supervision order must include conditions requiring the eligible offender—\n> > \n> > > (a) to submit to the supervision and guidance of any enforcement officer responsible for the supervision of the offender for the time being and obey all reasonable directions of an enforcement officer (including in respect of providing a schedule of movements), and\n> > \n> > > (b) to wear electronic monitoring equipment as directed and not tamper with, or remove, the equipment, and\n> > \n> > > (c) to live at an address approved by an enforcement officer and notify an enforcement officer of any intention to change the offender’s address or living arrangements, and\n> > \n> > > (d) not to leave New South Wales except with the approval of the Commissioner of Corrective Services, and\n> > \n> > > (e) to submit to the search of the offender’s person and residence and the search and seizure of the offender’s vehicle, computer, electronic and communication device or any storage facility, garage, locker or commercial facility under the offender’s control, and\n> > \n> > > (f) to comply with rules or by-laws (or both) of any approved accommodation for the offender, and\n> > \n> > > (g) not to use prohibited drugs, or obtain drugs unlawfully or abuse drugs lawfully obtained, and\n> > \n> > > (h) to submit to drug and alcohol testing, and\n> > \n> > > (i) not to possess or use any of the following—\n> > > \n> > > > (i) a firearm, firearm part or ammunition within the meaning of the [Firearms Act 1996](/view/html/inforce/current/act-1996-046),\n> > > \n> > > > (ii) a prohibited weapon within the meaning of the [Weapons Prohibition Act 1998](/view/html/inforce/current/act-1998-127),\n> > > \n> > > > (iii) a spear gun,\n> > > \n> > > > (iv) an explosive substance intended, by the eligible offender, to be used in an explosive device,\n> > > \n> > > > (v) a fuse capable of use with an explosive or a detonator, or a detonator, that is intended, by the eligible offender, to be used as a fuse or detonator for an explosive device (as the case may be), and\n> > \n> > > (j) to be available for interview at such times and places as an enforcement officer (or the officer’s nominee) may from time to time direct, and\n> > \n> > > (k) to undergo ongoing psychological or psychiatric assessment or counselling (or any combination of these) as directed by an enforcement officer, and\n> > \n> > > (l) not to start on the offender’s own initiative any job, volunteer work or educational serious terrorism offence,\n> > \n> > > (d) any report prepared by Corrective Services NSW or the NSW Police Force as to the extent to which the offender can reasonably and practicably be managed in the community,\n> > \n> > > (e) any report prepared by a prescribed terrorism intelligence authority relevant to whether the offender can reasonably and practicably be managed in the community,\n> > \n> > > (f) any treatment or rehabilitation programs and other programs or initiatives in which the offender has had an opportunity to participate, the willingness of the offender to participate in any such programs or initiatives, and the level of the offender’s participation in any such programs or initiatives,\n> > \n> > > (g) options (if any) available if the offender is kept in custody or is in the community (whether or not under supervision) that might reduce the likelihood of the offender re-offending over time,\n> > \n> > > (h) for an extended supervision order—the likelihood that the offender will comply with the obligations of the extended supervision order,\n> > \n> > > (i) without limiting paragraph (h), the level of the offender’s compliance with any obligations to which the offender is or has been subject while—\n> > > \n> > > > (i) on release on parole, or\n> > > \n> > > > (ii) subject to a control order, or\n> > > \n> > > > (iii) subject to an extended supervision order or interim supervision order, or\n> > > \n> > > > (iv) subject to any other order of a court,\n> > \n> > > (j) the offender’s criminal history (including prior convictions and findings of guilt in respect of offences committed in New South Wales or elsewhere), and any pattern of offending behaviour disclosed by that history,\n> > \n> > > (k) the views of the sentencing court at the time the sentence of imprisonment was imposed on the offender,\n> > \n> > > (l) any beliefs or commitments of the offender (whether of an ideological, religious, political, social or other nature) that support engaging or participating in terrorism activities,\n> > \n> > > (m) any other information that is available as to the likelihood that the offender will commit a serious terrorism offence.\n> \n> >
