(See by‑laws 3–12.)\n\n**Who it affects**\n\n- Visitors to the centre (adults and children). Terms “adult” and “child” are defined by age (15 years is the cutoff). (by‑law 2)\n- The council (which fixes hours, admission charges and conditions). (by‑law 3(2))\n- The centre manager (appointed by council) who enforces the rules, keeps registers and may refuse or remove people. (by‑laws 2, 7, 12)\n- People who coach or seek exclusive hire: both need the council’s written permission and may be subject to conditions and fees. (by‑laws 10, 11)\n\n**Key operative effects (what people must do or avoid)**\n\n- Enter only by turnstile or gate and either pay the admission charge or show a valid season ticket. Failure can attract a penalty. (by‑law 3)\n- The council decides opening times and charges and may post temporary closures. (by‑law 3(2), 5)\n- Season tickets are issued in the council’s form, non‑transferable, and may require photographic or other identity evidence on request; misuse attracts a penalty. (by‑law 4)\n- Users enter at their own risk; the council/manager disclaim liability for lost or stolen valuables and must post a notice to that effect. (by‑law 6)\n- The manager may give reasonable directions; users must obey. There is a specific list of prohibited behaviours (intoxication, smoking where posted, not showering before entering a pool, mistreating facilities, leaving young children unattended, running, etc.). Many items carry a penalty. (by‑laws 7, 8)\n- Lost articles must be handed to the manager, recorded in a register and kept for one month before disposal through the police. The manager reports monthly to the clerk. (by‑law 9)\n- Exclusive use of the centre requires a written application, council approval and a programme to be submitted in advance; the hirer is responsible for ensuring by‑laws are observed. (by‑law 10)\n- Teaching or coaching for reward requires written council consent and may carry conditions. (by‑law 11)\n- Enforcement powers: the manager can remove or detain rule‑breakers and hand them to police, refuse re‑admission of convicted persons, and act under council directions barring named persons. A copy of the by‑laws must be kept at the centre. (by‑law 12)\n\n**Stated purposes and how the instrument pursues them**\n\nThe by‑laws operate to (as can be inferred from the rules): maintain public order and hygiene at the pool, protect council property, manage access and revenue, and provide a framework for exclusive events and commercial instruction. They pursue those ends by:\n\n- Granting the council power to set hours and fees (revenue and access control). (by‑law 3(2))\n- Empowering the manager to direct behaviour, refuse admission and remove or detain offenders (day‑to‑day control and safety). (by‑laws 7, 12)\n- Listing hygiene and safety requirements (e.g. shower first, restrictions on contagious persons, no running). (by‑law 8(3)(c), 8(3)(s), 8(3)(v))\n- Controlling commercial activity (coaching for reward requires council consent). (by‑law 11)\n\n**Costs, incentives, trade‑offs and practical implementation points**\n\n- Who pays: users pay admission or season‑ticket fees set by council (by‑law 3(1), 3(2)(b), 4). Exclusive hirers and paid coaches will likely pay charges or be subject to conditions when council grants permission (by‑laws 10, 11). The by‑laws do not set fee levels — council discretion creates the revenue stream.\n\n- Compliance burden on users: must carry or produce identity for season tickets (by‑law 4(4)), obey a long list of conduct rules (by‑law 8), and comply with manager directions (by‑law 7). Parents/adults supervising children under 8 have explicit duties (by‑law 8(4)).\n\n- Administrative burden on council/manager: keeping season‑ticket lists and lost‑property registers, monthly reporting of lost property to the clerk, assessing and approving exclusive‑use and coaching applications, posting notices of hours/closures and liability warnings. (by‑laws 4(3), 4(4), 9(2)–(3), 5, 10(4)–(6), 11)\n\n- Discretion and enforcement risk: the manager has broad discretion to judge behaviour (e.g. whether someone is indecently clothed, intoxicated, or creating a nuisance) and may detain and hand offenders to police (by‑laws 8(1)–(2), 12(1)). Council can bar named persons by written direction (by‑law 12(3)). That concentrates operational decision power at the manager/council level, which speeds decisions but creates potential for inconsistent enforcement and complaints.\n\n- Effects on private enterprise and activity: charging for coaching and requiring written consent creates a regulatory gate for people who want to run paid lessons; exclusive hires shift availability away from general public use in exchange for fees or conditions set by council. (by‑laws 10, 11)\n\n- Trade‑offs: the by‑laws prioritize facility preservation, hygiene and orderly use (detailed prohibitions and manager powers). The trade‑off is reduced freedom for informal commercial activity (coaching) and increased administrative overhead for the council.\n\n**Practical legal effects to note**\n\n- Penalties: several breaches attract a stated penalty ($200 appears as the penalty in multiple places). (see by‑laws 3(1), 4(4)–(5), 8(3) & 8(8))\n- Liability: the council/manager disclaim liability for valuables and lost property while on premises. Users therefore bear risk of loss for items left at the manager’s custody. (by‑law 6)\n\n**Bottom line — who decides, who pays, what changes in behaviour**\n\n- Council decides hours, admission/season fees, form of season tickets, exclusive‑use and coaching permissions and may issue exclusions. (by‑laws 3(2), 4(3), 10, 11, 12(3))\n- Users pay admission or season‑ticket charges and must follow manager directions and posted rules (by‑laws 3, 4, 7, 8).\n- The manager enforces rules, keeps registers (season tickets, lost property), may refuse admission, remove or detain offenders and request ID for season ticket verification. (by‑laws 4(3)–(4), 9(2)–(3), 12)\n\nThis instrument thus operationalises typical municipal control over a local swimming facility: it creates a package of entry controls, behaviour rules, manager enforcement powers and administrative processes (registration, record‑keeping, approvals) to regulate use and generate revenue. The main implementation risks are concentrated managerial discretion in enforcement, administrative costs for record keeping and potential limits on commercial coaching unless the council grants consent."}},"importantCases":[],"_links":{"self":"/api/acts/tennant-creek-swimming-centre-by-laws-1989","history":"/api/acts/tennant-creek-swimming-centre-by-laws-1989/history","analysis":"/api/acts/tennant-creek-swimming-centre-by-laws-1989/analysis","conflicts":"/api/acts/tennant-creek-swimming-centre-by-laws-1989/conflicts","importantCases":"/api/acts/tennant-creek-swimming-centre-by-laws-1989/important-cases","documents":"/api/acts/tennant-creek-swimming-centre-by-laws-1989/documents"}}
